A Kenyan man who won a Ksh. 100 million lottery in Dubai but could not be traced has finally been found.

44-year-old Paul Wachira won the lottery on Tuesday after his ticket number 2162 in Series 302 was drawn.He went silent after being announced winner.

According to Gulf News, a news outlet in United Arabs Emirates, Wachira has finally been located in Nairobi after several mails and follow-up emails went unanswered.

“Frantic calls to his number kept failing. Email and a reminder email finally caught the attention of the winner who had no clue until when he opened his mailbox, to find he had won a jackpot,” Gulf News reported.

Paul said that he purchased the winning ticket online on May 22 and that he is a regular participant in the lottery.

“Thank you Dubai Duty Free for this blessing. I am happy to win Sh100 million,” said a joyful Wachira.

Twitter announced on Thursday that it would censor President Trump’s tweets going into the 2020 election by “down-ranking” those which violate their rules via algorithms.

Offensive material from the POTUS will also receive a label that applies to all verified political candidates and government officials with over 100,000 followers, according to the Washington Post.

Before users can view the language in newly flagged tweets, they will need to click on a screen that says, “The Twitter Rules about abusive behavior apply to this Tweet. However, Twitter has determined that it may be in the public’s interest for the Tweet to remain available.”

The company also said it will set up a special team tasked with enforcing the policy, and the notification label would appear only on rare occasions. -Washington Post

Twitter will deprioritize the labeled tweets so that they would be seen by fewer people according to the report, which adds that the policy will go into effect immediately and will not apply to other influencers and leaders. It is also not retroactive.

“In the past, we’ve allowed certain Tweets that violated our rules to remain on Twitter because they were in the public’s interest, but it wasn’t clear when and how we made those determinations,” the company wrote in a Thursday blog post. “To fix that, we’re introducing a new notice that will provide additional clarity in these situations, and sharing more on when and why we’ll use it.”

This morning, Kenya’s biggest teleco Safaricom experienced a major glitch in their systems that allowed subscribers to acquire data bundles for free.

The news that “Safaricom Platinum” — an integrated plan that gives customers a personalized bill manager — was undergoing some technical problems, spread like wildfire.

The glitch allowed subscribers to purchase data bundles and call minutes without airtime and soon enough, word was all over the interwebs as everyone rushed to grab a piece of this extremely rare cake from a company that has often been accused of ripping Kenyans off.

Busia County Governor Sospeter Ojaamong is a corrupt man.

In July, 2018, the governor was arrested by detectives and taken to court on multiple corruption charges.

He also spent over four hours with detectives from Ethics and Anti-Corruption Commission (EACC) who questioned him over Kshs. 8 million loss of public funds to a German company, Madam R Enterprises, for waste management services.

Ojaamong fiercely defended his conduct at some point stating that the money was not lost but paid for cleaning of ‘all the towns across the county for one year and training staff on waste management’.

How can one believe this lie?

Ojaamong had, without following proper procedures, unilaterally signed a memorandum of understanding with the aforementioned German company.

Director of Public Prosecutions (DPP) Noordin Haji had at that time stated that, there was ‘sufficient evidence to warrant prosecution’.

Where did this case reach?

An application from the DPP to adduce further evidence gathered in the corruption case against Governor Ojaamong was dismissed.

The High Court ruled that the prosecution is geared towards pre-emptying production of exhibits by the defense which have been identified by the prosecution witnesses

Police in North Imenti Constituency, Meru County on Saturday morning arrested a middle-aged woman on suspicion of killing her husband.

The suspect allegedly reached for a machete and severed her spouse’s limbs from his torso following a domestic disagreement on Friday night.

The cause of the macabre attack remains unknown.

The body parts of the victim, identified only as Joel, were found stashed in a plastic bag and hidden under the sofa set in their house in Gitimbine Village.

Joel’s workmates at a nearby slaughterhouse made the shocking discovery early Saturday when they visited his home to inquire why he hadn’t reported to work on Friday.

Joel’s body was moved to Meru County Referral Hospital morgue, while his wife was arrested and is being held at Meru Police Station.

Imenti North OCPD Robinson Mboloi confirmed the incident, saying investigations into the incident have been begun.

The rogue media house owned by the Aga Khan was recently shown dust by an employee they sacked in 2018.

The Case Number 844 of 2018 pitting Edward Ngarega Gacheru against Nation Media Group Limited (NMG) was before the Employment and Labour Relations Court judge Honorable Justice Byram Ongaya, who judged that NMG had erred in sacking Edward and that the media house should pay Kshs. 2.5 million to the claimant.

‘The declaration that parties were in a contract of service governed by the terms and conditions in the letter of appointment dated 15.03.2013 and any deficiencies in the letter supplemented with the minimum terms and conditions of service under the Employment Act, 2007. The respondent to pay the claimant: Kshs. 2, 500,000 in compensation’…’, Stated part of the ruling.

What Happened?

Edward Ngarega Gacheru was employed at NMG in effective May 2013, where he worked as a consultant/casual employee in the sales and marketing department, earning a salary of Kshs, 40,000 per month, till his abrupt dismissal in February 2018.

The sacking letter Edward received read as follows:

“Dear Edward,

RE: TERMINATION OF EMPLOYMENT

We refer to your letter of appointment as a freelance Business Executive for the Company.

This is to give you notice of 15 days that the company intends to terminate the Agreement.

The notice shall take effect on the date of this letter and shall expire on 9^th February, 2018.

You will be paid your commissions earned for the work done up to 9^th February, 2018 but will also be required to off set any liabilities owed to the company as you pursue your clearance.

On behalf of the management of Nation Media Group Limited, I thank you for your contribution to NMG and wish you every success in your future endeavours.

The judge ruled that Mr. Edward’s rights were violated for instance, he could not enjoy other privileges that permanent staff had enjoyed yet they were doing the same kind of job:

1. It was his case and evidence that colleagues he had joined with and undertook the training together but categorised as Permanent Sales Executives who carried out similar duties (of selling advertising spaces) as the claimant were offered better salary and commission and he was left out and discriminated against in that regard.
2. His evidence was that he reported on duty at 8.00amm to 5.00pm and sometimes worked overtime. Thus, the claimant testified that he was under the respondent’s complete control in terms of working hours, place, appraisal, reporting and paid commissions just like permanent staff but he was without a salary because he was designated a Freelance Sales Executive
3. Further, the claimant testified that he was deducted PAYE remitted to Kenya Revenue Authority (KRA) and so he considered that he had been enlisted as an employee and not an independent contractor and in which event, withholding tax at 5% would apply and not the PAYE of about 24%. He submitted annual KRA returns on prescribed KRA form P9 as an employee instead of being subjected to withholding tax of 5% with monthly returns.

Court awarded the former NMG staff 2.5 million among other things, to be paid by 1st August, 2019

So, in conclusion judgment is hereby entered for the claimant against the respondent for:

1. The declaration that parties were in a contract of service governed by the terms and conditions in the letter of appointment dated 15.03.2013 and any deficiencies in the letter supplemented with the minimum terms and conditions of service under the Employment Act, 2007.
2. The respondent to pay the claimant:

a) Kshs. 2, 500, 000.00 in compensation;

b) half month pay in lieu of outstanding month’s termination notice at the rate of half last full monthly commissions paid to the claimant;

c) 5 months’ pay in service pay or gratuity at the rate of the last full monthly commission paid to the claimant; and

d) 120 leave days and to be paid the same at the rate of 120 divided by 30 days of a month multiply the last gross full monthly commission paid to the claimant.

3. The claimant to compute, file and serve the amount in 2 above within 7 days for recording quantum on appropriate mention date.

4. The respondent to pay the amount in 2 above by 01.08.2019 failing interest to be payable thereon at Court rates from the date of filing the suit.

5. The respondent to pay the claimant’s costs of the suit.

This case serves as an example and has sent shivers down the spine of media house bosses. With the harsh economic times, where most media houses are planning to lay off employees, what is the worst that can happen?

While it’s true that our Kenya police Service has undergone a notable transformation, there are still a few elements hell bent on advancing the old oppressive and corrupt culture against innocent Kenyans!

So, the Deputy OCS – Kikuyu Police Station decides to personally conduct an early night operation with the assistance of his ‘boys’ on the night of Friday 28th June 2019.

By 9:30pm, there’s this police lorry packed at Thogoto Shopping Centre. Target: to get as many people as possible on board.

Police officers in plain clothes alight and go in different directions roughing up everyone on site regardless of their usual, genuine activities and bundle them into the lorry. Their boss, D/OS hovers around the packed lorry receiving the unlucky Kenyans whose only crime is going about their businesses.

He continues urging his boys to move a little interior from the main road and bring more people to fill the truck. Whether you’re buying milk from the shop, walking home from work or selling ground nuts to revellers, you’re a criminal and so you’re bundled into the police lorry!

This goes on for about 3 hours and the arrested population is now sizeable. Being a weekend, there are no intentions of presenting the supposed offenders to court within the stipulated time frame.

The police lorry drives off back to the station and of course meanders along the way, as officers continue picking up other petty offenders who are mostly booked as such in the Occurrence Book at the station.

What’s even more curious is that the same D/OS later sits pretty in the office for petty offenders at the station, and has the authority to release them after they’ve unlawfully spent a day or two in the cells and after collecting between three and ten thousand Kenya shillings from each one of them!

The D/OS at Kikuyu Police station is a law unto himself.

He sets a curfew in an area without publication for the general public, goes ahead to arrest anyone found out of their houses within the area, arrests them, prosecutes them at the police cells, judges them and fines them before he releases them.

Question is: Where does all this money he extorts from the already burdened Kenyans go?

You walk to his office to seek to know why your relative / friend was arrested and he shamelessly asks you to pay 10K for their release. If you’re lucky depending on whatever false charges they’ve preferred against your person, he would ask for 3 or 5K.

May he be ashamed and cursed, together with members of this corrupt chain.

Please inform interior CS Hon Fred Matiang’i and IG Hillary Mutyambai to dare check records in the OB at Kikuyu Police Station for all people arrested on evening of Friday 28th June 2019 for petty offences and seek an explanation on why they had to spend a night in the cells only to be released the following day by the same man who arrested them.

What investigations had he done in the same night, to establish that these people were not criminals after all? And if that be the case, why should they still pay for their release? Was it cash bail? Then why not issue a receipt? Can he declare how much he collected and surrender the same to the state? Who is his immediate boss? Is s/he aware of this?

This is a very unfair scheme by rogue and corrupt officers to fleece innocent Kenyans and must be stopped. I’m sure very many Kenyans have been victims of such unlawful arrests and detentions across the country and something must be done about it by the authorities. Now.

Matiang’i has tried to crash on the den of thieves but selectively, in the sense that, many are still going around with their scam games. Few foreigners many of whom are the majority shareholders in the betting industry were deported. Kenya is a rich ground for scammers. Kenya leads in gambling firms regionally.

Shabiki Gamblers are beyond disappointed Following a familiar scamming pattern where the company admits to error. They’ve announced and even called many winners only to flip the tables that it was a mere error.

There was a major scandal at betting company Shabiki.Com that was never resolved. Apparently there were 8 winners who won KSH 2 million each but the company refused to pay!

We’ve followed up on many but will just highlight a few and forward the rest of complaints to the BCLB to conduct their own investigations.

While these are not isolated cases, the persistent complaints at S.K. Macharia’s betting firm alludes to a well organized crime in which unsuspecting Kenyans continue to get duped and those not doing due diligence getting scammed through Shabiki.

In the latest scam, Facebook user Asali Chungu writes on the Shabiki Facebook page, “CON ALERT! Shabiki is a scam
Shabiki is a scam that is there to defraud those who bet, how can you make such an error and go ahead and congratulate winner? Were it not that most of us are keen it could have just passed by, where was BCLB? I thought they are supposed to verify the results before you announce the winner? Your adverts are misleading because most of us joined thinking of bonus! Its ok there is no bonus what a coincidence that you announced a winner for 13/13 and after correction it’s the only person same game that scored 12/13? As usual you have your predetermined winner or those you pay to act on TV.
SHABIKI IS A CON AVOID AVOID AVOID!!!!!!. Lets go back to sportpesa and others, how can you predict 12 games they say its 13? Predict 11 they say its 12!”

This followed an admission by Shabiki that there was an error on the winners announced. What raises the suspicions is the consistent ‘bug’.

A United Arab Emirates royalty said to have been targeted by Kenyan gold scammers is caught up in a new storm: his wife has fled Dubai.

Sheikh Mohammed bin Rashid Al Maktoum, Dubai’s ruler is reported by several foreign media outlets as being inconsolable after his second wife, Princess Haya Bint Al Hussein fled, taking with her the couple’s two children, aged seven and 11.

According to a UK tabloid, The Sun, the Sheikh expressed his distress in a series of poems published on his poetry website, including one titled ‘Affection in Your Eyes’.

“He writes about noticing ‘reproach’ in the other person’s eyes in his poem, assumed to be addressed to his wife. A “fatal arrow” has “pierced my soul and left me insane,” The Sun writes, adding, ‘But,’ he pleads, ‘Let the past be; soften your heart, Forgive my mistakes, and reward my good deeds’.”

The Daily Beast quotes the Sheikh referring to Princess Haya as a traitor, quoting lines from the poem, including one that goes, “You no longer have any place with me/ Go to who you have been busy with!/ And let this be good for you; I don’t care if you live or you die.”

Over the weekend, it was reported that the 45-year-old princess, who is Sheikh Maktoum’s second wife, fled Dubai. Aside from taking with her the couple’s two children, The Sun reports that she carried Sh4 billion (£31 million) to enable her “start a new life.”

According to The Sun, the princess requested for asylum in Germany and filed for divorce immediately after fleeing to Europe.

Australian website, news.com.au reports that Princess Haya preferred Germany to the UK as she feared UK authorities would hand her back to Sheikh al Maktoum.

However, while The Sun notes that Princess Haya’s exact whereabouts are a mystery, The Daily Beast reveals that the princess is currently at a secret location in UK, also adding that she prefers to live in London.

Diplomatic Crisis

According to The Sun, the event presents a diplomatic crisis between Germany and the United Arab Emirates, after German authorities declined the Sheikh’s request to return his wife.

Several foreign media outlets report that Princess Haya and the couple’s two children, 11-year-old daughter Al Jalila and seven-year-old son, Zayed, have been granted asylum in Germany, after a successful escape that was reportedly aided by a German diplomat.

According to The Sun, there were signs that all was not well as the princess has not been seen publicly since February.

The escape presents a new complication for Sheikh Al Maktoum. In March last year, 33-year-old Princess Latifa disappeared after a foiled escape attempt. In a video, Princess Latifa alleged that her family had imprisoned her. However, the Dubai royal family has since assured that Princess Latifa is safe.

Meanwhile, in Kenya, investigations into the alleged conning of the Sheikh out of Sh400 million in a gold scam are still underway. The Director of Criminal Investigations (DCI) George Kinoti said a team of detectives is set to leave for Dubai as part of an ongoing probe to talk to various concerned parties.

“Let no one lie to you that the probe has stalled because we will get there soon,” said Mr Kinoti, speaking from the United States.

He said a team of detectives that has been handling the matter has covered much ground locally, and that they “just need to talk to a few people” before finalising the probe.
“We know the parties involved and it will be a matter of summoning them for statements. Let them be patient,” said Kinoti.

Sources said Michael Kuria, the lead investigator in the case, and his team have been granted visas to travel to UAE where investigations are set to continue. But the team is yet to leave for the Arab nation.

Since the incident unraveled, police have raided various properties, from the Jomo Kenyatta International Airport to smelting joints, offices and residential buildings, from which they have confiscated fake gold.

More than 20 suspects linked to various gold scams have also been arrested and presented in court.
Some of the dealers have since gone underground.

Previous reports had suggested the ruler of Dubai had been swindled by fake gold dealers in Kenya. But the UAE ambassador to Kenya was quoted in a local daily disowning the reports.

No Gold

The dealers had allegedly posed as genuine suppliers of the mineral from DRC Congo before they were detailed to fly it to Dubai.

It has since emerged there was no gold and the dealers in fact planned to swindle the Dubai royal family.
When the news of the fake gold broke, Director of Public Prosecution Noordin Haji told police to investigate and give him a file for action.

“I have personally received a complaint and representation from victims of the scam claiming that the personality has been dealing with them for some time now and invoking the Presidents name in their dealings and conversations,” Mr Haji said.

He condemned the release and circulation of a recording on the deal, saying: “Such claims and their circulation through social media, specifically through leaked phone recordings in today’s age of real-time, border-less publishing, are alarmist and may needlessly cause disaffection.”

Haji warned that unless all facts are obtained and analysed, it was irresponsible and unlawful to publish such material.
“Having realised that they were conned on the availability of the gold, and the misleading knowledge and involvement of the President (Uhuru Kenyatta), the former Prime Minister (Raila Odinga) and Interior CS Fred Matiang’i, they resolved to (file) a report (with) Kenyan authorities and cooperate with law enforcement in unearthing the under-dealings,” he said.

The complaint and subsequent probe into the matter forced police to raise concerns over rising cases where foreigners are conned of money by Kenyans dealing in fake gold.

Kinoti urged embassies and high commissions to advise their nationals to be more vigilant. “The gold scam has now reached alarming levels as unsuspecting foreign nationals are being swindled off large amounts of money by fraudsters.”

The source of a fake letter that sparked claims there were plans to assassinate Deputy President William Ruto has been identified.

Officials aware of the probe said the US Federal Bureau of Investigation (FBI) has given the Directorate of Criminal Investigations preliminary findings on the source of the letter and those who uploaded it on social media platforms including Twitter.

What remains now is to summon the suspects for questioning to establish the motive.

Police have also visited a cyber café in Karen and confiscated some materials related to the probe.

“What is remaining is to recover their (the suspects) gadgets including mobile phones for further scrutiny. Even if they delete data it won’t help them. We have all that is needed,” said an officer who asked not to be named.

The officer said two individuals have been identified as the most probable suspects who either authored the fake letter or uploaded it on the social media.

The DCI had asked FBI to help them in the probe.

“They have the preliminary findings. It was a small process. Please ask them for details,” said an official close to the probe.

After the report was handed over to the Kenyan authorities, DCI boss George Kinoti offered to interview the DP on the assassination claims.

“He will however go with the investigating officer. He is ready and waiting for the DP’s signal for the questioning if he agrees,”said another officer.

The assassination claims have divided the executive with those mentioned denying the claims.

The Director of Public Prosecutions Noordin Haji defended the involvement of the FBI saying the agency had the expertise to establish the origin of the letter that set off the saga.

Haji said the reason for inviting the agency was to seal any perception of bias.

Haji told the National Assembly’s Justice and Legal Affairs Committee that so sensitive and complex was the matter that only FBI with its technological muscle would be able to solve it and bring suspects to book.

“We decided to bring and independent body to carry out the investigations and report who authored the suspicious letter and the origin of the allegations,” said Haji.

According to Haji, FBI was better equipped with skills and expertise to undertake an independent investigation.
“We will get an independent report so that we are not accused of dishonesty,” said Haji.

Police have concluded that the letter is forgery and are now working on motives.
Some of the theories detectives are pursuing include the letter being an attempt to divert attention, to seek sympathy, to cause a reshuffle in Cabinet or to cause confusion in government.

“It was well calculated, but we will get to the bottom soon,” said an official aware on the probe.

The DP has maintained silence on the saga.

Police have arrested a man who stabbed his wife 20 times and killed her yesterday morning.

Police sources say the suspect attempted to hide his wife’s body in a room before he was discovered and arrested.

The killing sparked a huge uproar especially among women leaders who called for strict enforcement of laws on gender-based violence.

Most of those interviewed blamed substance abuse for the rising cases of domestic violence in the county.

Hindia Hussein, a nominated MCA in the Mandera County Assembly, said time has come for everyone to stand up against gender-based violence.

Ms Hussein said the local dispute resolution mechanism dubbed Maslaha favours culprits, especially those with the financial means to navigate through a criminal case.

“We are saddened by this incident. This is unusual for Muslim communities. We want the law to take its full course,” Hussein said.

Mandera OCPD Erick Ngetich said when police on patrol were alerted, they found the 28-year-old woman lying on the floor in a pool of blood.

“We have arrested the suspect and he will be arraigned,” said Mr Ngetich.

He noted that a post-mortem had been conducted and the body released for burial according to Islamic laws.

Ward representatives who spoke to journalists said they will pass legislation at the county assembly that will address cases of domestic violence.

“Men have forgotten their responsibilities. It is women who are fending for their families while men are engaging in drugs that lead to such kind of violence,” said Sokorey Maalim another MCA.

Police urged the women to report cases of violence at home.

Embattled Deputy Chief Justice Philomena Mwilu closed property deals worth Ksh. 315 million within three months on the back of irregular dealings with collapsed Imperial Bank.

Justice Mwilu’s loan dealings with Imperial Bank and property deals that are linked to tax evasion are at the heart of petition in which the Director of Public Prosecutions (DPP) is seeking the sacking of Kenya’s second senior-most judge.

She sold three parcels of land for Ksh. 315 million deal between March 2016 and July 2016, more than doubling her return from the plots bought months back for Ksh. 155 million with cash from Imperial Bank.

The DPP says Ms Mwilu failed to pay capital gains tax on the return and stamp duty of four per cent on value of the land she bought between December 2014 and March 2016 for Ksh. 160 million.

Part of the Ksh. 132 million in loans were granted interest free without applications from Ms Mwilu nor appraising her creditworthiness, others granted using letters with Judiciary letters head.

DPP say she also fraudulent recovered securities of the loans and sold them, leading to losses of Ksh. 60 million at the collapsed Imperial Bank.

“The respondent therefore used her judicial office to improperly enrich herself,” the DPP says.

The petition says Ms Mwilu bought two plots in Nairobi for Ksh. 80 million in December 2014 (reference numbers 3734/202 and 3734/209) and used them as security for a Ksh. 60 million long-term loan.

She took another short-term loan of Ksh. 60 million for purchase of half-acre property registered as 3734/1129 and successfully used it as substitution of the earlier loan security, leading to release of the two plots.

She was meant to sell the two plots and use proceeds to clear the Ksh. 65 million short term loan and half of the long term loan.

The DPP say the judge sold all the properties for Ksh. 315 million, and only cleared the Ksh. 65 million and failed to offer Imperial Bank property 3734/1129 as security.

“The respondent clearly had no intention of charging the said property to Imperial and thus obtained said securities by making false representations,” says the DPP.

The CEO of Safaricom Bob Collymore dies aged 61.

In October 2017, Collymore took leave due to an ‘undisclosed ailment’ which turned out later to be cancer.

Collymore came back after 9 months of medical leave, in August 2018.

SAFARICOM CEO Bob COLLYMORE PASSES ON

It is with deep sorrow that we announce the passing away of Robert (Bob) William Collymore CEO of Safaricom PLC, which occurred at his home in the morning of 1st July 2019.

In October 2017, Bob proceeded to the UK to receive treatment for Acute Myeloid Leukemia (AML) and returned in July 2018 to resume duties.

He has been undergoing treatment for this condition since then in different hospitals and most recently at Aga Khan University Hospital in Nairobi.

In recent weeks, his condition worsened and he succumbed to the cancer at his home in the early hours of Monday 1st July 2019.

Bob Collymore leaves behind a wife and four children.
