Gicheru at ICC: Whose play is it?

Earlier this week, Kenyans were treated to some rather unexpected news after it emerged that renowned Eldoret-based lawyer Paul Gicheru had surrendered to the International Criminal Court (ICC).

Gicheru activities had reportedly been under the court’s radar for over 5 years ever since he was accused of being part of a web of suspects responsible for bribing witnesses who were set to testify against Deputy President William Ruto with the aim of persuading them to withdraw or recant their statements.

Gicheru’s surrender raised more questions than answers as the ever speculative netizens across social media platforms attempted to decipher why an ordinary man who had previously been working for the government and living a free life in his home country suddenly decided to hand himself over to foreign authorities at the Hague.

Many insisted they felt it was yet another politically motivated schemed by Ruto’s adversaries in what has turned to be quite an interesting time in his political life.

However, unlike what many expected on Friday evening, Lawyer Paul Gicheru failed to spill any beans when he made his first appearance at the ICC, and instead, told the court that he would deny all charges against him.

“I do not intend to admit the charges under Article 65. The allegations read out to me are not true. They are false. All six of them are false,” Gicheru the Dutch based court.

Gicheru is suspected of corruptly influencing court witnesses in Kenya in 2013, and committing offences against the administration of justice.

Among the charges read to him include bribing the witness with Sh2.5 million and a job offer in exchange to drop the witness against the suspect.

During the first appearance, the Pre-Trial Chamber confirms the identity of the suspect, ensures that the suspect understands the charges, confirms that language in which the proceedings should be conducted, and sets a date to begin the confirmation of charges hearing.

Gicheru who was appearing before Pre-Trial Chamber Judge Reine Adelaide Sophie Alaphini-Gansou, is representing himself.

He said that the step to present himself to the international court was a voluntary move and was not bribed to fly off to Europe.

According to his personal lawyer John Khaminwa, Gicheru left the country quietly leaving no clue that he was turning himself in to the Dutch police.

Ndalana Mutheu, daughter of the late traffic constable Alfred Ndalana who was based in Kisumu has revealed that nearly a year after she came public about their woes trying to solve their dad’s apparent murder, Directorate of Criminal Investigations (DCI) has not helped in any way.

Ms Mutheu in January 2020 through a Twitter thread exposed how her family has been trailed by unknown men and threatened, the threats, she says, have persisted to this day even after DCI summoned her promising to take over the case.

For a moment I trusted the DCI would help in getting justice for my father but you proved me wrong. After having me in your offices I was hopeful that we will get justice but that was not the case.

 Weeks after meeting the DCI in January 2020, one of us was attacked and shot. Nothing happened after we reported and filed a case at the Buruburu Police Station. Noone was arrested nothing. It was a dead end. Few weeks later we started being followed.

 My mother was getting followed each and every day by men using motorbikes as left work for home. Yet we still reported to DCI. The weird thing about all this was she saw one of your officers at her place of work talking to a boda boda man then she began being followed

 That is not all one of your officers again DCI has decided he will miss all court proceedings that he is demanded to attend. Why is this? So as to drag the case behind and have us give up on fighting for justice.

I believe a prosecutor missing almost 5 court hearings due to excuses is an offense. The prosecutor handling this case has been missing proceedings claiming she is sick each time. This is a waste of resources as we have to travel to Kisumu each and every time not forgetting

We have to pay legal fees. This is tiring! For a fact you prove that my father didn’t commit suicide as you claim since you are trying to get rid of this case. Its now 4 years down the line and we have to wait till 2021 February because an officer was a no show.

 Not for the first time all he does is give excuses. We have to wait for 5 years because a prosecutor doesn’t show up in court too? We have to live watching over our shoulders because we don’t know who is chasing us! Are we not citizens of this country?

The push by politicians to open the Building Bridges Initiative (BBI) report for reviews is gaining momentum after it emerged that President Uhuru Kenyatta and opposition leader Raila Odinga have not been persuaded to accept further reviews.

Raila was bombarded with demands to review the document during the burial of former Committee of Experts chairman Nzamba Kitonga.

This comes days after he met party leaders where he suggested that the document could be improved without clawing back hard-fought gains.

The proposals of the report if adopted as it is will however rubbish all the gains brought by the 2010 constitution.

Raila had also met the Council of Governors (CoG) but failed to come to a consensus on some of the contentious articles, including governors’ opposition to having running mates of the opposite sex, and revenue flow to the counties.

All the governors are converging in Naivasha today to revise the document before they are by President Uhuru Kenyatta or Odinga on Monday or Tuesday.

President Kenyatta is currently on an official visit to the Vatican City, Italy.

Politicians are demanding change but they have veiled interests.  Someone like the Deputy President William Ruto is pretending to have slightly conceded when Raila’s camp does not want to back down but wants him to make good his threat to oppose the report.

Other leaders including former Vice President Kalonzo Musyoka are calling for a non contested BBI and drumming its support at the same time.

But Makueni Governor Kivutha Kibwana who seems to be headed to the DP’s camp called for involvement of all leaders for a consensus.

Ruto who spoke at the bride price ceremony  for Nakuru Senator Susan Kihika in Marmanet, Laikipia County also called for a consensus.

“Let us all listen to one another as members of one family. This is a journey that we started and it should not divide us. We want to make good of everything on this journey. Let us respect one another and give room for dialogue. Just like a family, we should talk and listen to one another,” Ruto said.

Raila has flatly rejected any call to review the document further, telling Ruto to talk his boss with whom they sit in the cabinet.

DP allies including former Agriculture Mwangi Kiunjuri have said they will only support the document only if it addresses issues affecting the common mwananchi.

But the document has been criticised for expanding the executive and the parliaments but having nothing substantial for the people apart from lining up and voting.

BBI task force member Major (Rtd) John Seii came out accusing the system of inserting the PM and his two deputies in the report, contrary what they had proposed.

CoG Chairman Wycliffe Oparanya said they were pushing for amendments on some sections touching on devolution and they will not relent.

“We had a meeting but we never concluded the issues. We have scheduled another meeting in Naivasha on Monday and Tuesday that will be attended by Uhuru and Raila.” Oparanya said.

The Wednesday meeting at State House had the governors mount pressure on Uhuru and Raila to agree to change the document.

The president is on record saying that the document is not cast on stone and can be improved.

Odinga says the same in presence of the president but he is against any change as the document opens a political battle front between him and DP William Ruto.

Governors want to have Article 218 of the Constitution amended to compel the Controller of Budget to release funds to counties in the absence of the County Allocation Act.

“The CoG proposes for gender parity in representation. However, it does not propose the running mate of every candidate for the position of governor being the opposite gender,” reads the governor’s draft proposal.

Ex-Family Bank CEO Peter Munyiri in court over Money-Laundering

In 2018, Family Bank committed to pay Sh64.5 million for its role in the Sh1.6 billion National Youth Service money laundering saga. This followed a plea bargain agreement with the Director of Public Prosecutions (DPP), in which the bank agreed to plead guilty to failure to report money transactions involving the suspects.

Though this was highly criticized by Kenyans, some economists argued that banks are just institutions and it is people that are behind the frauds. 

The bank almost collapsed after panic withdrawals when the Central Bank Of Kenya governor indicated that the bank had been used to launder the corruption monies for Waiguru, Kabura and Ben Gethi, the banker being Peter Maina Munyiri. 

The bank had approached DPP three times seeking an out-of-court settlement.

Reports indicated that the CBK championed for the settlement to avoid another Imperial Bank scenario and stabilize the Kenyan banking system hence the acceptance of ODPP. 

After the settlement, Peter Munyiri tried to use the backdoor to evade justice. He immediately petitioned court to be exonorated now that the bank had been set free. Arguing in court, Deputy DPP Ms Dorcas Oduor indicated that a  bank is an entity which carries out its operations through its appointed agents who are required to observe the banking rules,” she argued.

And that is how Peter Munyiri’s dream to be ever cleared died but what happened to the case? 

Even after almost collapsing the bank, Mr Munyiri sued them for unfair dismissal and was awarded Ksh. 30 million, exposing the weak Kenyan judicial system that was quick to award money-launderer money and not hold him to account for NYS money laundering.

An Italian national living in Kenya is at the centre of an assault case.

Monticello Maurizio reportedly assaulted his neighbour, at Edenville Estate Phase 1, yesterday.

A video seen by cnyakundi.com (shared below) shows him approaching a lady, whom he slaps hard on the face as a guard watches and other residents scream in shock. He was later confronted by another man wearing a white T- shirt and it appeared that things would escalate.

He was picked by police but is out on bond.

Residents say he is notorious for doing this as he has been to Kiambu Police Station a couple of time, each time he secures release.

‘He is a nuisance, a drug addict and the landlord has failed to hear our pleas to have him evicted’, a resident wrote online

Residents are scared to let their kids play outside for fear of psychotic behavior.

“He’s a nut case I live in the same court. He poured gasoline on the wife the other day..he’s been chasing residents with knives and hammers. Scared to even let me child out to play honestly”, a resident told blogger Cyprian Nyakundi.

Benson Wairegi is in the sunset years of his career as a top insurance executive. He gave a final interview to Business Daily to wrap up his 40 years ‘at the corner office’

His sentiments describing the fallout between him and his former employees, as a matter of “values and integrity”, didn’t go down well with one of them.

“When we ran into a problem with some of my employees here and we had to go to court because it was a matter of values and integrity. I’m an introvert, publicity-shy and going to court, before cameras, newspapers writing about you…That made me feel really really naked,” he told Business Daily’s Jackson Biko.

In a long Facebook post, Edwin Dande, responded to his former boss, accusing him of fabricating a multi-billion case based on non-existent audit reports, that have never been produced to date.

“With all due respect you can’t fabricate allegations of theft of billions based on non-existent audits “from KPMG and Couslon Harney” and still talk of values and integrity,” wrote Dande, a former CEO of Britam.

Dande further said of the case that has already been ruled:

“I successfully sued for the release of those non-existent audits, and Britam remains in contempt of court orders up to today… 2 years since the high court ordered the release of the so-called forensic audits. Those audits don’t exist, it was an attempt to confuse the investing public. Just stop,” he added.

Britam had sued its former employees Edwin Dande, Elizabeth Nkukuu, Shiv Arora and Particia Njeri accusing them of theft of Sh1.2 billion but the case later collapsed for lack of evidence.

The four, upon leaving, formed Cytonn Investment which has interest in real estate and asset management.

The case between the four vs Britam

In the judgment given by Justice Chacha Mwita in 2019, the aforementioned four who were at one-time staff of Britam (British American Assets Management Ltd) were let off on the alleged theft.

“An order is hereby issued compelling the respondents to provide the petitioners with the forensic audit conducted by KPMG on the books of BAAM as mentioned in paragraph 5 of Ms Carol Akinyi Ouko-Misiko’s witness statement sworn on 27th October 2014 and filed in HCCC No 354 of 2014 and the legal audit performed by Messrs Coulson Harney of all transactions handled by the petitioners as referred to in paragraph 17 of Mr Jude Anyiko’s affidavit sworn on 27th October 2016 and filed in HCCC No. 354 of 2014,” ruled Justice Mwita.

Britam failed to produce the necessary documents to support their claims arguing that audits would be “prejudicial to their commercial interests”, which the judge found unpersuasive.

“I find the respondents’ contention that allowing access will be prejudicial to their commercial interests unpersuasive given the nature of the information sought. This is because the Constitution and the law place a positive obligation on the state and other persons to give information in their possession for purposes of exercising or protecting rights or fundamental freedoms,” ruled Mwita.

Edwin Dande maintains that Wairegi filed a report with the Directorate of Criminal Investigations (DCI) based on lies, “since no such theft existed”.

The bitter war between Homa Bay county finance minister Nicholas Koriko and county secretary Isaiah Ogwe is all out, messy and nasty.

Their beef heightened after a mysterious death of a local contractor was blamed on their war.

But Governor Cyprian Awiti has remained silent and unconcerned as members of his kitchen cabinet continue to engage in nasty fights.

The two officers in plum positions were good friends until Governor Awiti’s succession politics got serious. They are all thinking of succeeding Awiti whose leadership has been marred with massive looting of public funds.

The contractor who was ‘killed’ had been subjected to a series of frustrations after he fell out with Ogwe.

But things worsened when the deceased identified as Opany Deklan publicly showcased his allegiance to Koriko.

Since then Opany began battling procurement technicalities that were laid by Ogwe to frustrate his payments, as a revenge.

The delayed payments kept the deceased at odds with lending banks and his employees.

That was a shocking let down, when Opany rushed to the bank to process the Sh2 million voucher, he discovered that he had been duped.

The voucher was a dummy meaning his account still had nothing. He developed high blood pressure instantly and died hours later.

Opany died a frustrated man who could not even fuel his car, he resorted to bodabodas to dodge auctioneers and other debtors.

But Koriko who describes the deceased as his friend said Opany’s death has no political hand.

“Yes it’s true that Opany is dead but all those theories surrounding his death are just the work of rumour-mongers,” he said.

Koriko and Ogwe landed the lucrative positions courtesy of the the corrupt governor of Homa Bay, Mr. Cyprian Awiti.

But Ogwe is acting overzealous, powerful and with authority to stamp over all the departments under the watch of the governor.

He is a shot caller in many dockets including the finance that is headed by his rival, Nicholas Koriko.

His own sycophants describe him as a phony man that a lazy governor like Awiti can not control.

Ogwe has also pocketed chief officers, directors, accountants and auditors on top of gifting his friends and relatives with appointments across the 11 departments.

But Koriko has crafted a working scheme that has seen the corrupt Ogwe sidelined key opinion leaders in Homa Bay County.

Ogwe has been sidelined by notable figures from his Kanyada village including veteran politician Jerry Ndong.

Koriko is telling the voters that Mr. Ogwe is an outsider who has his roots in Ngiya, Siaya county.

But Koriko’s men who are in Ogwe’s payroll have warned him against challenging the county secretary’s political moves.

Joho puts the serious questions correctly then hides his tail behind his Party leader just as a typical designer clothes model he is.

It is unfortunate so because,  despite the fact that the current-in this case Jubilee- which has both the government Uhuru and perhaps Raila and the opposition Ruto and other political hawkers have portrayed clearly that GoK gives no shit about the majority of Kenyans.

In fact, while other nations vote for a leader that will propel the nation out of poverty,  Kenyan politicians want millions of both schooled and unschooled population to remain in absolute poverty because,  they see and count them as voting bots.

Since independence, GoK has been fighting hunger, poverty and ignorance yet, they steal funds for starving Kenyans- remember Kenyans for Kenya?

They leave Kenyans in poverty by giving farmers bad fertilizers to reduce their farm yields, import laced sugar and when Kenyans get sick, Hospitals have only expired panadols because of MAFYA House cartels, KEMSA frauds, Mismanaged National referral Hospitals (they want you to fly your sickness to the sickening Indian private hospitals)…

They looted even COVID-19 funds- we have published articles and name shamed them.

Unfortunately, the Kenyan education system has been designed to graduate, more so, annually rolled out millions of fools. As Miguna Miguna would put it, Graduates that are functionally illiterate.

While Kenyans are furious that Education CS Professor Magoha, who clearly is struggling to run that docket, is insulting Teachers because the schools uncleanness the C in C with only 2 years left in office has decided to militarized everything?

Ogada also says that Kenya is losing its species because the people in charge of our biodiversity are soldiers and accountants. Their interest is in filling the paperwork and paying the fees, because they have no knowledge of the value and impact of what foreigners are carrying.

The Kenya National Union of Teachers (KNUT) has been on the forefront in fighting for teachers’ rights since I can remember.

Ambrose Adongo was the fiercest teacher defender in our time when we were growing up (late 90s).

The sabotaging of teachers did not begin then. The real dismantling of the powerful KNUT, began in 2015 after Dr Nancy Macharia took over at Teachers Service Commission (TSC).

Nancy has overseen the demoralization of teachers though sponsoring squabbles at KNUT, double registration of teacher representative organizations, illegal deduction of salaries and outright corruption.

This has been supported by the Government which feared and continues to fear a united teachers’ movement.

KNUT Secretary General is currently facing mounting pressure from teachers and staff of KNUT for failing to protect the union.

Over 100 KNUT offices have been closed countrywide due to lack of funds to run them.

TSC is the one that collects membership fee for KNUT by deducting it from teachers’ salaries (members of KNUT) and wiring it into KNUT’s account.

Outgoing TSC CEO Nancy Macharia whom the ‘system’ wants to unlawfully give another 5 years at the helm so as to continue destroying teachers’. The Law Society of Kenya has moved to court to resist this impunity and homeguardism. It might be that her hand can be seen in the way a tribe-mate at the Registrar of Trade Unions is quick to act on KNUT to ‘correct illegalties’ and not on any other union. Kubai too comes from Central Kenya.

Ways TSC has been sabotaged KNUT

In a increasingly gender-sensitive world, TSC and Kenya Women Teacher’s Association (KEWOTA) lied to the government and all NGOs supporting education that female teachers need their own organization for empowerment.

KEWOTA which is a new entrant into the fight for control of teachers has been accused of colluding with TSC to deduct Sh200 from female teachers’ salaries.

Those teachers who noticed double deductions from their pay slips complained to TSC to stop the deductions but these fell on deaf ears.

“We wrote to both KEWOTA and TSC to stop the deductions but the deductions are continuing”, a teacher who spoke on condition that her identity should not be revealed said.

KEWOTA is formed by a few women, Ms Benta Opande as the CEO, Ms Jacinta Ndegwa as the treasurer and Ms Dorothy Muthoni as the chairperson, some of whom left KNUT, having been paid handsomely by the deep state and Nancy Macharia to cause harm to teachers’ movement.

Ms Jacinta Ndegwa is a former KNUT official. She resigned in June 2019 citing frustration from Wilson Sossion, the KNUT Secretary General.

KNUT was against the registration of KEWOTA and had written to Ethics and Anti-Corruption Commission (EACC) and Directorate of Criminal Investigations (DCI) to investigate the Teachers’ Service Commission (TSC) and in extension KEWOTA over membership row.

KEWOTA, on its website, boasts of being an association that consists of female teachers employed by the TSC, privately employed female teachers, ECDE female teachers, SNE female teachers and other women in the education sector.

KEWOTA says it addresses issues to do with Women Empowerment but in this case, it seems like a dis-empowerment.

KEWOTA is impacting negatively on the lives of teachers.

Some other teacher who also spoke on condition of anonymity said that teachers were forcefully conscripted into the organization and that’s why it is hard to remove them.

Blacklisting KNUT Members

Sossion says that since July 1, 2019, TSC unilaterally suspended the Knut/TSC CBA against its members, further blacklisting Knut members from benefiting from promotions saying the move was meant to cripple operations.

The blacklisting of some teachers makes them leave KNUT for other Unions such as Kenya Union of Post Primary Education Teachers (KUPPET) under General Akelo Misori or forced to joine KEWOTA.

These scheme denies KNUT the much needed revenue to operate.

Most of these are done illegally by TSC as Sossion revealed that KNUT has not received any letter from its members resigning from the body.

“TSC violates the constitution by denying teachers to be part of a trade union”, Sossion said.

“Further, they have gone to hire staff at the IPPD to offload Knut members illegally, the law is clear when a member resigns from the union,” he added.

The reduced revenue has seen KNUT shut down 110 branches courtesy of meddling on the UNION’s internal affairs by TSC, particularly Nancy Macharia.

Sossion, a nominated MP is a frustrated man, having fought off attempts by TSC to install a puppet at Mfangano Street.

“Some lazy characters in this country who have taken over TSC cannot wake up in the year 2017 and their business at TSC is nothing but to plan for the destruction of the union and sale a narrative that a strong union is bad for the government,” he said.

In August 2019, KNUT top organ which was attended by 22 out of 37 members removed Sossion and replaced him with his deputy Hesbon Otieno. The court overruled this change and Sossion was reinstated.

Once Kenya’s largest bookmaker,  SportPesa is now facing an ultimate demise after a new probe by The Financial Reporting Centre (FRC) established that the sports betting firm wired $278 million (Sh30 billion) from its local accounts to offshore banks illegally.

FRC which is a State agency tasked with tracking illicit money will seek to establish if the billions of shillings earned by the online betting website in Kenya were declared to the gaming regulator, the Betting Control and Licensing Board (BCLB).

SportPesa allegedly transferred the Sh30 billion to the tax havens that are of Isle of Man, the Canary Islands as well as Dubai over a three-year period.

The FRC will also be tasked with finding out if the bookmaker paid taxes on the Sh30 billion.

In fear of being found guilty and losing the billions of shillings, Wealthy, politically influential Kenyans and Bulgarian investors who helped to found SportPesa have started losing their calm triggering a bitter fallout.

According to Kenyan entrepreneurs Paul Wanderi Ndung’u and Asenath Maina, who own a combined 38 percent stake in SportPesa’s holding company Pevans East Africa, there has been a shareholder war that has been simmering since 2017 over the transfer of the billions of shillings to the offshore accounts.

The shareholder fight in the sports betting platform is pitting local majority shareholders against its foreign owners from Bulgaria in a row that erupted into public light when SportPesa announced its return under Milestone, a business licensed last month.

Mr. Ndung’u had said that local top shareholders of Pevans East Africa, were illegally excluded from buying shares in the holding company — SportPesa Global Holding Limited (SGHL) — leading to dilution of their ownership in the UK-based firm.

It is after the fallout that the shareholders demanded a forensic audit on the company starting from 2015, a push that has been resisted.

“After persistent push, the management report indicated that within three years Pevans has transferred over $250 million (Sh27.1 billion) to various offshore accounts in Isle of Man, Dubai, and Las Palmas/Canary Islands,” Mr. Ndung’u said.

“Shareholders have also come to learn that subsequent to ceasing operations, $500,000 (Sh54.3 million) has been transferred from Pevans to SportPesa South Africa while another $17.5 million (Sh1.9 billion) has been transferred to Sportpesa Tanzania. We want to know who the beneficiaries of these accounts are.”

“The matter is of public interest, and we will investigate to establish if there was criminality in the movement of the billions offshore,” said Saitoti Maika, the Director-General of FRC.

The war  between the embattled Nairobi Governor Mike Sonko and Nairobi Metropolitan Services (NMS) Director General Mohammed Badi has stalled the utilisation of Sh127.2 million.

The disputed money was received as a grant from the World Bank and the Danish government after the National Treasury suspended the operating system of the budget sector.

Sonko who appeared before the senate’s health committee said that the condition of the grant was to support  Level 2 and Level 3 hospitals under the Universal HealthCare projects.

The governor had transferred four functions including health to the NMS in line with Article 187 of the Constitution.

Sonko transferred the functions to the National Government through the NMS in March but supremacy wars later erupted between the governor and Badi resulting to hampered service delivery to Nairobi residents.

Treasury CS Ukur Yatani has refused to release the funds to NMS claiming that move lacks a legal backing.

Sonko tabled a letter by the treasury CS which explained that the funds can only be given to Nairobi County Government through the County Revenue Fund.

The CS cited Section 4(2) of County Allocation of Revenue Act, 2020 which stipulates that each county government allocations shall be made to the respective County Revenue Fund.

“The funds are still lying idle in the Central Bank account as a result of suspension of the health sector budget Integrated Financial Management Information System (Ifmis) operating system by the National Treasury whereby it is now impossible for our accounting staff to process any payments for the transferred function through Ifmis,” Sonko told the Senate’s Health committee.

The Senate Health committee was also told that Sh17.6 million conditional grant from the Danish government were received on April 30, 2020.

The funds are still idling in the County Revenue Fund account since the county has been blocked from accessing Ifmis.

“The funds are currently held at the County Revenue Fund Account as it has become practically impossible to utilise them due to Ifmis budget withdrawal thus the county cannot process their disbursements,” Sonko said.

Sonko also added that his administration owes the Kenya Medical Supplies Agency (Kemsa) Sh374.9 million noting that debt was incurred before the health functions were transferred to NMS.

“The health sector has pending bills amounting to Sh1,072,998390 comprising Sh801.9 million being recurrent expenditure and Sh270 million being development expenditure pending bills,” he added.

The name of Kakamega deputy governor Philip Kutima is prominently featuring in the wars around the burial of Governor Wycliffe Oparanya’s chief-of-staff Robert Sumbi who ‘succumbed’ to covid-19.

Kutima who had plans of nominating Sumbi as his running mate to succeed Oparanya in 2022 first ensured he hooked Sumbi to a Kabras lady when he worked as a minister in Oparanya’s first term.

The gullible Sumbi ended up living with the lady as his second wife despite being officially married, wedded and with children.

He had not even paid dowry at the time of his death, in ‘affair’ that his first wife Sussy Sumbi still considers  a big disappointment .

Mrs Sumbi who lectures in a local university in Kakamega literally fed and dressed him when he went broke after losing in the Mumias East parliamentary race in 2013.

He spent all his fortunes in the campaigns to an extent that he would only depend on his wife (Sussy) for survival until Oparanya came to his rescue with a cabinet job.

Deceitful Kutima only needed skirts and beer to manipulate Sumbi to make political advancements as he tore the deceased’s family apart.

He further blinded Sumbi by ensuring his mistress secured a job at the Kakamega County office as the illegal couple also rented a new place at the Kenfico Estate in the outskirts of Kakamega town.

Pundits point that Kutima’s intention was to cement his political base in Kabras to add to his populous Wanga community.

The crafty man also wanted to sell the notion that having Sumbi move with a lady from Kabras would tighten ties with the Wangas.

And now his role in Sumbi’s burial saga has been exposed after the first wife rushed to court to stop the funeral proceedings being rushed by county officers and the mistress.

Kutima is secretly working ways to have the relatives of the mistress to be recognized by Sumbi’s parents as the second wife.

He is also pushing the family of the deceased to pay dowry in death but the battle of the two women has shifted to wealth that includes a Prado on loan and some property in Nairobi.

Mrs Sussy Nandama Sumbi, the officially wedded wife and the mistress, Ms Yvonne Tanui are also battling over Sumbi’s benefits at the county where he worked as Trade minister and then chief-of-staff.

The orders  issued by magistrate H Wandera on November 3 came as a shocker to Sumbi’s colleagues with the widow camping at the Kakamega funeral parlour.

Mrs Sumbi took made the move after she heard of the mistress’s plans to steal the body for a secret burial elsewhere.

“I have served the orders to all parties involved. I will camp at the parlour so that the planned stealing of my husband’s remains, as word has gone round, is not fruitful,” said Mrs. Sumbi.

The standoff over the burial Governor Oparanyas aide is expected to could take longer given the several demands by Mrs Sumbi.

But Ms Tanui who works at the county offices is using some officers at the county assembly to stiffen the standoff.

Kakamega County assembly clerk Laban Maloba and speaker Morris Buluma are secretly funding Tanui who works in the trade department to deny Mrs Sumbi the property and county benefits.

Maloba and Buluma are hell bent to ensure that the mistress succeeds in disinheriting Mrs. Sumbi and her children off prime plots in Kajiado and house in Kitengela.

Ms Tanui is not officially married to the deceased and does not have children with him.

But the property the two women does not belong to Sumbi another corrupt senior official in Oparanya’s administration who use  county officer but to a senior county official who only used Sumbi as a conduit.

Mrs Sumbi is fighting for the property that was not actually bought by her late husband but phony senior officials including Kutima are manipulating  the mistress (Ms Tanui) to take charge and return the property that belongs to the county cartels.

A UK-based Kenyan man now risks running into trouble with foreign authorities following claims that he was part of an African aid group accused of fraudulently using millions of pounds donated as grants to help eradicate poverty in local Kenyan communities.

Samson Ochieng, a 58-year-old man from South Woodford, East London, and the Director and founder of the Kenya Community Support Network (KCSN) is accused of splashing up to Sh55 million of charity on mortgage payments and restaurant bills.

The London-based organisation known as “Comic Relief” is said to have awarded about 800,000 sterling pounds (Sh115 million) to the community NGO which is headed by Ochieng.

The intended purpose of the money was to alleviate poverty, sickness and distress among Kenyans as well as to carry out research into living conditions in some parts of the country.

According to a report by the UK’s Daily Mail, the commission claimed it had established that Ochieng made countless withdrawals from ATM machines and also spent a significant amount on high-end hotels and restaurants in the famous city of London.

During the probe ordered by the top hierarchy at Comic Relief, it was also revealed that Ochieng had made two payments, totalling to £8,400 (about Sh1.2 million) from the charity to his and wife’s bank mortgage accounts.

The inquiry launched back in 2018 following a complaint to the Charity Commission by Comic Relief ruled that Ochieng treated the foundation as a private business and also fraudulently spent millions of pounds.

In his own defence, Ochieng claimed that he does not have knowledge of such a probe, further stating that his “lifestyle of spending” is only courtesy of sponsorships of the many Kenyan athletes who compete abroad.

Interestingly, part of the money which Ochieng embezzled was to be given to an aid group in Homa Bay county but according to investigations, only about half was remitted.

He however later reportedly dismissed the probe as flawed since the investigators had not travelled to Kenya to examine the funding.

But even before conducting their own probe, Comic Relief chiefs had asked another charity to help investigate its concerns over Ochieng and his charity.

The inquiry found there was evidence to indicate ‘significant concerns’ about the charity’s account.

Comic Relief was founded in 1985 by screenwriter Richard Curtis and comedian Sir Lenny Henry in response to famine in Ethiopia.

In 2015 it was revealed that Comic Relief, together with its associated Red Nose Day and Sport Relief, had raised more than a billion dollars for “good causes”.

3 medical officers from a public Hospital in Nairobi have been arrested in connection with a child trafficking syndicate following a year-long investigation by the BBC Africa Eye that revealed the intricate operations of baby buying and selling syndicate in Kenya.

Inspector-General of Police Hilary Mutyambai says the 3 will be arraigned in Court, even as investigations continue, with the IG saying there is a likely hood that more people will be arrested.

Mutyambai said the police working with other partners have unearthed a child trafficking syndicate in Nairobi that involves local public hospitals and children’s homes.

”As the investigations continue there’s a possibility that more persons will be arrested,” read part of the official statement.

“In the course of investigations and operations, it is unfortunate that it was realized that senior medical officers in collusion with child smugglers are highly involved,” He said.

According to BBC, the racket involves ‘trusted members of the community, well-placed government officials including employees in public hospitals in a trade that has robbed hundreds of women of their children for the financial benefit of a few leaving behind a trail of pain and despair.’ The syndicate involves street child-snatching, Pregnant poor women coercion, and even disappearing babies in hospitals.

Mutyambai has now directed all County Police Commanders to work closely with local children officers and other local security agencies to immediately undertake investigations on matters touching on child trafficking in their respective regions especially in local public, private hospitals and children homes.

The Kenyan government has also constituted a multi-agency team to investigate allegations of child theft and trafficking in the country.

He also appealed to members of the public to volunteer information on any suspicious activities involving child trafficking saying the information will be used with the utmost confidentiality.

Police have arrested the CEO of Mama Lucy Kibaki Hospital Dr Emma Mutio and two others as investigations into the theft of babies scandal at the controversial health facility intensify.

The Directorate of Criminal Investigations (DCI ) said Dr. Mutio is leading a baby theft syndicate at the hospital that involves many players and not only the health workers.

She is was arrested together with the facility’s administrator Dr. Regina Musembi and one Makallah Fred Leparan.

Mutio appeared before the Milimani court on Wednesday where Inspector Wanga Masake from the Kilimani police station told the court that the DCI has received information that the three are trafficking children in Umoja and Embakasi areas.

The arrest follows an expose by BBC on baby theft at the facility and information obtained from Mr Leparan about their involvement in the crime.

According to the BBC exposé, innocent babies are sold at Mama Lucy Kibaki hospital at a cost of between Sh100,000 and Sh300,000.

Mr Leparan was captured negotiating with undercover reporter in a scheme to sell a child who had been abandoned at the hospital.

He was also captured receiving a large sum of money after handing over the three babies to the journalist.

“We have reasons to believe this is a well organized criminal gang that is operating within the country whose other players are yet to be established,” Masake said.

Mutio and Musembi have been overseeing the operations by Leparan in their baby theft syndicate. They sell as young as one day old babies.

Former Churchill Show comedian David Kagongo, famously known in Kenya as “David The Student” has recently been the talk of social media in the United States.

This followed the emergence of the video of a racist mzungu passenger hurling verbally abusive words towards David, who works as a cab driver in the country, for simply being asked to wear a mask before boarding the taxi.

The incident took place in Issaquah, Washington, shortly after David, who works under San Francisco based taxi-hailing app “Lyft”, picked up the passenger, whose first name is Joe.

Upon entering the vehicle, Kangogo asked Joe, accompanied by his wife, to wear a face mask but he refused and proceeded to launch a profanity-laced verbal assault at the driver that eventually led to him being banned from the app’s service.

When the man became outright abusive, David The Student took out his cellphone and started recording before sharing the footage on Twitter.

The now-viral clip started off with the passenger calling David the N-word.

“You’re a sand n*gger. That’s what you are. You’re a f*cking sand n*gger, F*ck you!,” he says after exiting the vehicle.

“Do you know what a sand n*gger is?” the mzungu, who appears heavily inebriated, intimidatingly asks David.

At this point, his wife steps in and urges him to stop, adding that she’s filming.

As the wife continues filming the driver, the racist mzungu continues to hurl obscenities in the background.

“You will never drive Lyft again,” she can be heard telling David, which her husband reiterates.

Still clearly not satisfied, the man then threatens to urinate inside the vehicle before backtracking and calling David the N-word one more time.

“Thank you so much. Have a good night,” David tells his unruly passengers before the video runs out.

Not long after the video went viral on social media, Lyft issued a statement saying that the passenger was permanently banned from the service.

“There is no place for discrimination of any sort in the Lyft community, and this behaviour is unacceptable. We have permanently removed the rider from the Lyft community and are in touch with the driver to offer our support,” they wrote in a statement on Twitter.

At the peak of his comedy career, David The Student was a huge star on the Churchill Live Show.

His unique way of performing was a hit with many Kenyans which led to him having a wide following. He always left the audience in stitches, especially when using his native Kalenjin accent.

But as time went on, the comedian soon almost completely went under the radar, only to turn out that David had relocated to the US to chase the much sought after American dream.

At around 2018, it was heavily rumoured that David, who had left in search of greener pastures, had ended up borrowing heavily from Kenyans in diaspora in order to make ends meet.

He was also accused of soliciting money using fake stories about his family and promising to pay up later.

The amounts he borrowed ranged from $50 (about Ksh5, 000) to $100 (about Ksh10, 000).

Later the same year, tabloids reported that David had silently made a return into the country.

Since then, not much has been heard about him.

On Saturday morning, the Directorate of Criminal Investigations (DCI) announced that they have begun investigations into an alleged “cartel” accused of luring Kenyan high school girls from their homes to wild orgy parties within the city.

Through the thread of posts shared on Twitter, they revealed that following preliminary investigations into the incident, detectives established that the girls had been lured out of their homes through a social media account identified at “Carty-gang-ent.”

The said cartel is said to have been using internationally-registered telephone numbers, although they operate from Nairobi.

Detectives were prompted to look into the event following complaints from a number of worried parents from various Nairobi estates that their daughters had gone missing for days.

Their missing person case went viral after their plight was highlighted by Fiona Otieno, one of the missing girl’s cousin.

Three of the girls were traced by detectives from the Child Protection Unit based at the Directorate of Criminal Investigations (DCI) while four others are said to have gone back to their homes in Komarock and Kamulu after the three showed up at Central Police Station in Nairobi.

The three girls told police that they were at a friend’s house, who is aged 21 years old.

Upon their return, the girls disclosed that they were bored at home having stayed indoors since the Covid-19 outbreak in March.

“When asked where she was, she said she just needed to get away,” a relative of one of the girls told journalists at the station.

Interestingly, however, detectives found it interesting is that the teenagers seemed to have had a “good time” all through as was captured on an Instagram page where they posted their daily pictures.

The page has since been deleted.

While being interrogated by detectives attached to DCI’s Anti-Human Trafficking and Child Protection Unit and the Crime Research and Intelligence Bureau, the young girls revealed how they were lured from their home and linked up in partying joints in Nairobi.

Who are Carty-gang-ent?

As at now, information on who exactly Carty-gang-ent are is rather scanty but a quick search into the internet portrays the alleged gang as some sort of an upcoming underground musical group based in Nairobi.

From their YouTube page, it’s clear the group only have a modest following with only two of their songs named “Zoza” and “Bloody Bloody” hitting the 1,000 (1K) views mark.

The rest of their work, like “Suicidal” and “F*ck The Snitch”, tell all you need to know on the style of music they produce.

Detectives are now said to be hunting down members of the alleged cartel, with some of the members expected to be arrested and interrogated soon.

“All of them will be interrogated to establish where they were and with who,” DCI boss George Kinoti said, “we are also seeking to know more about the gang involved,” he added.

In a message to Kenyan parents attached at the bottom of the mid-morning brief, detectives warned that children’s activities at home and on social media networks should be keenly taken note of.

Additionally, the sleuths also issued a stern warning addressed to individuals taking advantage of the current pandemic to prey on school girls who are at home, noting that their days are numbered.

Just recently, detectives arrested a man who posed as a wealthy businessman willing to sponsor young girls to holiday destinations of their choice.

He would then lure them to hotels and eventually in lodgings where most reported losing their belongings as the ‘businessman’ disappeared.

They believe this latest incident is linked to such tricks.

Chief Justice David Maraga is retiring from the Supreme Court as he introduces new practice rules that will restrict presidential election petitioners to a maximum of 30 pages worth of arguments.

LN No6, 2020 published by CJ Maraga will also cut down wordy and talkative lawyers to size in 2022.

The new rules also includes the use of coded colors  for easy navigation and limiting the number of  applications for appellate matters to just 15 pages.

They knock out “interested parties” from participating in advisory opinion proceedings of the court.

“A volume of any document shall be bound in book form, printed on one side of the paper, and shall not exceed one hundred and fifty pages in length,” the rules say.

Maraga wants pages of each application to be consecutively numbered on the top right-hand corner and every tenth line of each document must be numbered in sequence, on the right-hand margin.

He also wants the documents to be double-spaced with font-size 12, Times New Roman font type, margins of 3.0 centimetres and above on the left, 2.0 centimetres on top and bottom and 1.5 centimetres on the right.

The retiring CJ also wants the record of appeal to be filed in both electronic form as well as in hard copy in 2022, should there be a petition.

The  laws will also bar lawyers from making extensive quotations from documents or authorities.

Lawyers will instead be required to make urgent applications “not later than noon on a Court working day”.

Only the Supreme Court will decide where the authorities lawyers can aide their case but they can give the full citation and make reference to paragraphs.

“Where the authorities are other decisions, the parties shall give the full citation, attach the hard-copy case law and highlight the relevant portion being relied on,” the rules say.

But when the lawyers will be relying on the constitution, statutes or other legal instruments such as treaties, protocols and conventions, they will give the full citation and an excerpt of the relevant provision.

Decisions to allow one to participate in the proceedings shall be arrived at at the pre-trial conference once the application has been certified urgent by the court registrar.

The decision to allow an amicus curie shall also be determined at the pre-trial conference.

According to the former KenGen Director who bagged the appointment under DP Ruto’s recommendation back in 2013, the post that purported to declare her support for the BBI was published by an impersonator who illegally accessed her account and not by her.

Omanga added that she had contacted legal authorities over the incident and demanded that immediate action be taken on the perpetrators found guilty.

In regards to the contentious BBI report, the Senator stated that she has her own views regarding the document but which she will share with Kenyans when the given time comes.

This came just after DP Ruto said that even with the signature collection launch, there still is a chance at a consensus for a non-divisive referendum.

The collection of the required one million signatures kicked off today where the President Uhuru Kenyatta and his new best buddy Former Prime Minister Raila Odinga signed the document alongside other heads of various political parties.

Popular Nairobi uptown restaurant chain Artcaffe once again found itself on the receiving end from angry netizens after a customer took to social media to expose an incident perceived to be a case of employee harassment.

The user only identified as “Paushinski” from his ten-year-old Twitter account which holds a draws quite a reasonable following sparked the uproar after he shared out a post claiming he had witnessed a senior Artcaffe superintendent publicly humiliating a waitress on the floor at one of the institution’s branches within the city.

According to the self-professed witness, patrons were left in disbelief after Artcaffe Lavington Branch Manager Jane Amonje shouted her lungs out at the waitress since identified as Beatrice, calling her “stupid” multiple after she apparently messed up an order.

“Must be the worst experience for her. Hakuna dignity pale,” he wrote on the now viral tweet.

Paushinski’s thread of tweets was met with immediate anger from other social media users who condemned the rogue treatment of the waitress, with some demanding that the coffee joint take immediate action on the branch manager Ms. Jane Amonje.

“Artcaffe these days trends for wrong reasons. Last time ilikuwa kulipa na exposure. Sahii ni harassment ya employees. Sasa what about what is never told pale. I would be curious to know…” Bravin Yuri, a popular Twitter user, wrote.

“I’m just wondering about all these chances we keep giving to Artcaffe,” Kenyan singer Carol Atemi replied.

“Start by training the floor managers, shouting at staff is unacceptable,” noted another unhappy Kenyan.

Among the responses, some took the chance to spill even more beans on the institution’s poor choice of administrators.

“Kuna manager mwingine pia wa Kitengela ana attitude kushinda paka yangu,” claimed a social media user.

After a long night of reactions and complaints, Artcaffe finally broke their silence over the incident on Friday morning when through a reply to Paushinski’s post, the restaurant chain promised to look into the matter “immediately”.

Artcaffe and Negative Press: A love story?

For those who keep up the tabs with local news, Artcaffe restaurant is not very new to trending over negative headlines.

In August this year, they incurred the wrath of Kenyans on social media after they invited entries to an art competition in which the winners would only be paid with free coffee and exposure of their artistic work on takeaway coffee cups, and not any form of monetary reward.

As their excuse, the restaurant claimed that the contest was only meant to enable Kenyan creatives to showcase their artwork and not necessarily to earn from it.

Most recently, the management once again had to fight off food poisoning rumours after popular Kenyan blogger-cum-YouTuber Edgar Obare revealed how he fell unconscious and had to spend the night at a hospital after having a meal at an Artcaffe branch along Mombasa Road.
