Kiraitu points out ‘devils’ in the BBI report

Meru Governor Kiraitu Murungi has lauded the recently released BBI report as a fairly good document but with devils in the details.

“By and large, the report is good and we support it.. but we say the devil is always in the details. So we have to read the report very keenly to see if there are any games in it,” Kiraitu said.

The man whose county hosted a BBI rally for the larger Mt Kenya said the CoG’s main interest was increase of allocation to the counties.

“We are looking for a solution in the BBI… I’ve seen at least it will give double the allocation, which will allow us to do a lot of grassroot projects in Meru,” he said.

Kiraitu said he is supporting the BBI report because it proposes an increase in allocation to counties from the current 15% to 35%.

“Chapter 11 should be amended by increasing the resources to the counties from the current 15% to at least 35% of the last audited accounts and ensuring that the focus is on service delivery in the settled and serviced areas, including for people living near the furthest boundaries of each county,” read part of the report.

But the Meru Governor is trashing BBI’s idea that governors and their deputies be of the opposite gender.

“A candidate always looks at the votes. If having a man as a running mate will make you have more votes than having a woman, then you go for a man anytime. We have to play politics with the rules of politics,” Kiraitu said.

BBI aims to scrap the 47 woman representative positions and replace them with an equal number in the Senate as a win-win scenario.

The taskforce led by Garissa Senator Yusuf Haji proposes the country elects 94 senators, with each county electing one man and one woman.

If adopted, the report will delete Article 98 1 (a), which set the number of senators to 47 and other additional 16 members nominated by political parties.

The report will not only expand the executive but the parliament too in a naive move to cure gender imbalance.

The devil that Kiraitu sees in the details of the document includes the proposal to have a 360-member House. The usual 290 will be elected by the people in the constituencies and another 70 will be filled by political parties.

The additional 70 seats will be allocated on the strength of actual votes cast per county and will be distributed among youths, people with disabilities and women. The women have a chance of up to 35 out of the 70 additional seats.

Kiraitu further criticised the reports fantasy to separate and politics. He said the two are inseparable.

“Luos will always be there… Merus… so whether BBI says they are there or not, they will always be there,” he said.

Cnyakundi.com has received information about a 51 year old rapist known as Abdul Karim at the Sierra Leone Embassy.

Abdul is said to lure young girls with a promise of job yet rapes them then blocks their number.

Though we did not receive his picture so as to warn other Nairobi Women about this rapist, we wish to publish such in subsequent articles. We need a safe Nairobi.

Here is *Shukri’s Story: (Name changed to protect identity)

This is a formal complaint about one ABDUL KARIM who works at the Sierra Leone embassy here in Kenya. Abdul has been involved in criminal activities here in Nairobi and gets away with it.

He has been reported severally and no actions has ever been taken against him.

Some time last month, Mr Abdul lured a young girl by the name Shukri in the name of securing her a job at the United Nations Environmental Programme (UNEP) or embassy, he requested for the CV and it was sent to him.

Instead he lured the young girl to his house along statehouse road at CBK apartments and drugged her, as he is used to doing to other girls, and raped her.

Shukri did not give the job as promised.

Why is Abdul running illegal businesses in the name of calling himself a diplomat when he is a CRIMINAL?

If no action will be taken against this criminal, we are afraid we are going to protest in the Ministry of Foreign Affairs and Directorate of Criminal Invenstigations (DCI).

We are sick and tired of his evil Deeds.

Why promise young gilrs job only to lure them, drug them and rape them?

Kenyans Burn Sh386 Million in Policy Claims

The Insurance Regulatory Authority (IRA) has released a report trailing how Kenyan motorists burnt a total of Sh200 Million through false fire policy claims.

How you ever wondered why so many cars are reported to have all over sudden burst into flame on-most of the reported occasions- Thika Super Highway? Does it have anything to do with the road?

According to experts, the high-speed limits on the superhighway makes all car components to heat up much faster hence increasing the fire risk in case of any pre-existing faults.

“There are so many electric items in a car, but drivers can at least check if the battery terminal is fixed on the battery properly if there is a caution lamp on the dashboard as well as avoiding entrusting your car to an untrained technician,”  Toyotsu Managing Director Daisuke Toyooka San said.

In recent statistics, IRA states that the value of fraud in Kenya’s insurance sector rose 24.4 percent to Sh386.3 million in the year ended June 2019.

The Insurance Regulatory Authority records show that fire insurance accounted for Sh200 million or 51.8 percent of the value of fictitious claims. Well, Kenyan motorist, not all but some deliberately torched their homes or business premises to fetch some money from insurers.

On top of the fake fire policy claims, IRA also listed fraud on motor insurance which consumed Sh52.87 million), life insurance sunk Sh44 million and medical insurance gobbled Sh42.5 million.

Fraud in vehicle policies was in the form of fictitious accidents, forged insurance certificates and forged theft of motor vehicles as IRA disclosed, in the latest annual report that the blocked fraud came in the year its investigative arm—Insurance Fraud Investigation Unit (IFIU)— received and detected 83 fraud cases, down from 91 the previous year.

A separate report by the Association of Kenya Insurers (AKI) showed that 14 of the 37 companies that had covers for domestic and industrial fires made underwriting losses.

The Insurance Fraud Investigation Unit (IFIU) was set up in 2011 to deal with cases of fraud in the insurance industry and has seen the number of cases drop for the third year from a peak of 168 in 2017.

Of the 83 cases reported last year, a majority (21) came from agents, mainly through theft and commission fraud. Motor vehicle insurance fraud followed with 20 cases, ranging from fraudulent accident claims to fake car theft claims.

Last year, general insurers had their worst record over two decades when they sank into Sh3.27 billion underwriting loss mostly contributed by motor vehicle insurance.

In the IRA report, the underwriting losses from insuring motor vehicles jumped to Sh7.35 billion a 92.4 percent increase, with private vehicle insurance returning losses for the eighth running year.

Insurance company employees also posed risk to the business with nine cases valued at Sh19.28 million being reported as theft of premiums by staff.

Insurance Fraud Investigation Unit spent Sh28.7 million, down from Sh29.6 million the previous year, to investigate the cases as the IRA had reported in their previous year report that it had spent Sh27.3 million.

Expense ratio—the percentage of premium that insurance companies use for paying all the costs of acquiring, writing and servicing insurance— was highest for aviation (98.21 percent) followed by personal accident (66.7 percent).

Blockchain is being touted by AKI to help cut paperwork and also lockout fraudulent claims by validating documents from customers and provide permanent audit trails that can be used to identify claims. Will the use of technology help?

Last year, insurance industry premiums grew 6.1 percent to Sh229.5 billion while net profit rose 108 percent to Sh15.12 billion. Kenya was ranked third in Africa in terms of gross premium income after South Africa and Morocco.

The long-term insurance business grew 11.4 percent to Sh97.4 billion while general insurance business grew 2.5 percent to Sh132.1 billion.

But in case of a fire accident, immediately stop the car safely and turn off the engine then get every person out of the car and move a distance from the burning vehicle.

How BBI was designed to pass through a referendum

After the launch the BBI document at the Bomas of Kenya on Monday, the next step is to redraft it into a BBI Bill, and that will come easy for its proponents.

The product of the handshake between President Uhuru Kenyatta and ODM’s Raila Odinga was not designed to fail like OKOA Kenya that the system crashed because it had signatures of cows and rats.

Or like the Pungumiza Mzigo that was grabbed by it’s ankles and thrown out of the window.

BBI is crafted in a way that the proponents will not struggle to collect one million signatures to move to the next process.

The document is proposing the creation of Ward Funds for MCAs, which is literally ‘a bribe’ for the grassroots leaders to back it.

But BBI is actually unpopular for expanding the executive, parliaments and again watering down the senate and giving the government minister control over police.

The report is proposing the creation of a prime minister’s office and two deputies. Positions that in the current political environment would be considered ‘dynasties’.

But it gets the backing of the hungry politicians who will use it to spread propaganda and confuse the people.

The proponents are already burning to move and sell it though it is still being touted as a discussion draft.

BBI is intending make amendments to 58 Articles of the 2010 Constitution by applying Article 257.

Crafters would opt for Article 256 but it would face many hurdles given its unpopularity.

Tangatanga would make it impossible to achieve the 2/3 majority win.

The report wants to amend 58 Articles of the 2010 Constitution when only 10 require a referendum including the Bill of Rights (Article 31); Functions of Parliament (Articles to 113 and 123), Independence of Judiciary (Article 172) and Devolution (Articles 177, 179, 180, 202, 203 and 207).

Article 256 would have been options to pass the amendments but the proponents fear that The option then is to use Article 257 – and amend the law through a popular initiative (referendum) where state machinery can be employed to crash any little resistance.

The only would be ‘hurdle’ that the handshake would face would be in passing the BBI Bill in at least 24 County Assemblies before it heads to Parliament but that is already sorted by the proposal to create Ward Funds.

MCAs will pass it for that and parliament will pass it because weak Women Representatives will pair up with popular senatorial or gubernatorial candidates to ride to the senate where they will go in pairs.

Members of parliament will also pass the Bill because almost 70 sycophants will be ‘nominated’ and some can be appointed as ministers.

Governors have already been instructed to lobby MCAs. Sycophants like Kakamega’s Wycliffe Oparanya will not sleep on that job, he wants to be a deputy prime minister.

Thirdway Alliance’s Punguza Mzigo Bill flopped after it was rejected in 24 counties.

After the entire process from IEBC, to counties and the parliament, the owners of the draft will have it ‘passed’ by the people.

It shall be approved by a referendum if at least 20% of the registered voters in each of at least 24 counties vote in the referendum.  It should also get the support of  a simple majority of the citizens voting in the referendum.

Kenya to blow Sh14 billion in expanding the executive

The Acting C.E.O of the Independent Electoral and Boundaries Commission Hussein Marjan has said that Kenya will need Sh14 billion to conduct the BBI referendum.

Hussein who spoke on Wednesday when he appeared before the Public Accounts Committee at the National Assembly also revealed that IEBC has already listed the requirements for the plebiscite and is ready for the referendum.

“It will cost Sh14 billion though we are still fine tuning.” Hussein said.

The electoral body considered the 19.6 million voters which has increased given the continuous voter listing exercise.

This comes after IEBC unveiled its own reforms, days after the Building Bridges Initiative report recommended its overhaul before the country gets to 2022 polls.

The same report will also see the country’s executive expanded and wage bill ballooned. BBI is proposing the creation of a Prime Minister’s office and two deputies.

If the BBI report is adopted through the Sh14 billion shilling referendum, the senate will be expanded to 94 members and National parliament to 360 members playing duplicated roles.

IEBC in its report to parliament wants the number of commissioners reduced from the current seven to five, including the chairperson.

“Political parties’ interests are sufficiently catered for in the vetting process since the selected commissioners are approved by the National Assembly,” the report reads in part.

The report that aims to amend the 2010 constitution was launched by President Uhuru Kenyatta at Bomas of Kenya on Monday.

The BBI report also enjoys sycophantic backing of the president’s handshake partner Mzee Raila Odinga who believes that creation of more seats at the top will solve the question inclusivity.

News reaching cnyakundi.com says Mwangi Wa Iria, the corrupt and sly Governor of Muranga county was summoned by the Ethics and Anti-Corruption Commission (EACC) to answer to irregularilly awarding tenders for media advertising for the financial year 2014/2015.

“We are investigating allegations touching on your County Government, specifically on the provision of media advertising services in the financial years 2014/2015 and 2015/2016”, the letter dated 22nd October 2020, said in part.

Wa Iria’s Co-Director at the Mwangi Wa Iria Foundation was also summoned for the same charge.

To facilitate this investigation, we kindly invite you for an interview and statement recording on the above issue at our Integrity Centre Offices located along Valley Rd/Jakaya Kikwete Rd junction in Nairobi on 28th October, 2020 at 10:00 am. In addition, and in your capacity as the Managing Director of Mwangi Wa Iria Foundation, kindly inform and facilitate your Co-director Jane Waigwa Konani for a similar exercise on the same day.

In January 2016, EACC detectives raided the Governor’s home in the morning in search of evidence regarding graft allegations facing him. The early morning search on the home situated along Katanga road in Thika town was said to be also targeting Wa Iria’s relatives and friends’ residences in Nairobi and Kiambu.

Wa Iria was later arrested in March the same year for what detectives said was obstruction of justice that happened at him home in January 2016 where his supporters jammed the gates to prevents detectives from taking the Governor away.

In 2018, Muranga under Wa Iria was ranked the most corrupt by the anti-graft body.

The EACC report named Trans  Nzoia as the second most corrupt with a bribe perception of 84 percent followed by Mandera (79.4 percent), Kirinyaga (78.9 percent), Marsabit (78.2 percent) and Tharaka Nithi (75.7 percent).

Ex-PS Lilian Omollo to get one shilling for unfair dismissal

Judge Stephen Radido of the Labour Court has ruled that the dismissal of former Youth and Gender Principal Secretary Lilian Omollo was unlawful.

The judge said that Ms Omollo’s rights were breached as he ordered the state to pay her one shilling.

“The petitioner was not subjected to due process, nor was she given reasons for the removal from office under the hand of the President. She was ingeniously notified that her tenure had ended because a replacement had been appointed,” Justice Radido said.

The judge further outlined that civil servants have a legitimate expectation that being public officers, due process as envisaged under Article 236 of the Constitution would be observed in the process of their removal from office.

But Radido said that because Ms Omollo is currently facing graft charges over unexplained wealth, the amount awarded (one shilling) was a fair compensation for the violation of her rights.

Ms Omollo has challenged the decision of the High Court which found that the more than Sh33 million she held in various accounts. The court established that the they were proceeds of crime.

She was charged over the Sh9 billion NYS corruption scandal in 2018 when it was also found out that she was married two different men.

Lilian had married Omollo, whose name she retained even after dumping him for one Dick Oruko Oneko, son of Shujaa Ramogi Achieng’ Oneko.

She remained a controversial figure around power circles to working as a top government official where she was wrongfully dismissed and given one shilling in compensations.

The kind of trivial compensation the court awarded the Ex-PS is referred to as nominal awards.

They are awarded in cases where judges find that litigants have succeeded but have not suffered any loss. They’re common in places like Britain where where judges can award litigants as little as a penny.

Inside Al Shabaab’s Sh20bn tax collection ring

The Somali based terror group Al Shabaab is collecting as much tax as the government through a complicated system of levies imposed on activities from importation of goods to irrigation of crops.

Findings by Mogadishu-based Hiraal Institute show that the insurgents are collecting upto $15 million every month.

The findings are backed by more than 70 interviews with officials from the federal government, businessmen, government officials, active and defectors from Al Shabaab’s tax collection ring.

The scrutinized receipts and income reports from religious taxes and levies collected from activities such as crossing checkpoints, running businesses, irrigating or selling land and exporting or importing items.

A senior military commander from war torn country revealed to Hiraal Institute that he was forced to pay Al shabaab $3,600 in taxes to finish building his house.

The first and the second contractors had quit the job after a series of threats from the insurgents.

A former security national advisor and founder of Hiraal, Hussein Sheikh Ali told Reuters that the terrorists tax collection as been more efficient since they published their first report in 2018.

“These people are really into the business of money-making. They are strategic, they are serious, and they will look for ways to weaken their adversaries – the Somali authorities.” he said.

The Al Qaeda linked militants are raking a lot from the ports where they tax shipping the same way the government does.

Ali also added that Al shabaab makes money from zakat, an annual religious tax of 2.5% of an individual’s wealth.

The terror organization is said to be very adaptive, following and collecting taxes wherever the government does including education and healthcare.

The insurgents also call and question entities as the Chamber of Commerce and other government agencies tasked with particular brackets of taxation.

The militants have increased their earnings at the expense of Somalia government raising pertinent issues on their ability to launch attacks on the country.

Nearly 50% of their ‘earnings’ are in the capital Mogadishu where they have stepped up their collections in a worrying trend.

ODM’s mission to impeach Obado aborts

The Orange Democratic Movement party (ODM) has dropped its push to impeach Migori Governor Okoth Obado over graft charges.

Raila Odinga’s party made the U-turn after Migori MCAs proved reluctant and divided to impeach the embattled county boss.

Even threats and intimidation did not work in favor of ODM that had marked Obado as Deputy President William Ruto’s man who was to be kicked out before 2022.

While eating the humble pie, Odinga’s party claimed that the idea to throw in the town was arrived at after a ceasefire between the governor and the Orange party.

Obado has in the past successfully gone against the grain in elections and so he could not fail with this one as he outwitted ODM leadership including John Mbadi (National Chairman) and the outspoken Secretary Edwin Sifuna.

The push to impeach Obado nearly brought operations at the Migori County Assembly to a halt forcing the party’s Central Management Committee to abort the plot.

Obado was however instructed to toe the party line and stand with the party in all matters it supports including the BBI.

Members of the County Assembly will be called for a meeting before the decision drop the motion is made public.

ODM secretary general Edwin Sifuna said the meeting was about the need to ensure that service delivery in the  county is not interrupted by the doublespeak politics.

The loudmouth Sifuna who was accused of leading a gang of goons to assault the Migori County Assembly Speaker Boaz Okoth over the matter is now claiming that they pursuing unity and harmony in the assembly.

“A sub-committee of the ODM Central Management Committee has today met with the governor of Migori Okoth Obado, to discuss, among others, the need for continued service delivery by the county government under the prevailing circumstances, party unity and harmony in the assembly,” the statement read in part.

The meeting was also attended by John Mbadi, national treasurer Timothy Bosire, organising secretary Abdikadir Aden, and secretary for political affairs Opiyo Wandayi.

The abortion of the impeachment move is because of  Obado had become problematic for ODM amid reports of a divided assembly and delay to table the motion.

The ODM team downplayed the fact the the assembly was too divided to impeach Obado with Ruto links turning it into a do or die contest.

Raila Odinga who recently attended a funeral in Migori avoided the impeachment subject for fear of being jeered. He claimed that the unity of the country was more important as he drummed support for the unpopolar BBI.

” Do you want us to unite people? That is what Building Bridges Initiative (BBI) is rooting for,” Raila said.

Did President Uhuru Recommission the Dreaded Kwekwe Squad?

In May 2016, the former PM of Kenya Raila Odinga exposed the government’s cover-up plans after it emerged that a State Secret Paramilitary trained police unit dubbed Kwekwe Squad had been deployed to execute State critics.

Raila, then CORD flagbearer was speaking at the funeral of then deep state operative turned whistleblower the late Jacob Juma who, according to RAO was eliminated by Kwekwe Squad.

“Up to today, they are saying they are investigating . . . Kwekwe Squad assassinated Juma and that is why they are not interested in carrying on with any investigation,” said Raila who dismissed the then the ongoing probe by police and called for an inquest to be conducted by credible private investigators.

The State, through the then National Police Service spokesman George Kinoti reacted swiftly and denied the existence of the dreaded Kwekwe Squad.

“There is no unit or squad in the National Police Service known as the Kwekwe Squad. It doesn’t exist,” the then National Police Service spokesman George Kinoti said and directed the CORD fraternity to produce their evidence to then, now retired Inspector General of Police Joseph Boinett.

Yesterday, President Uhuru was in Kajiado County where he presided over the graduation ceremony of paramilitary officers who attended a three-month Kenya Police Tactical Operation Course at the National Police Service, Magadi Field Training Campus where he instructed the police to be firm when dealing with threats to national security.

As a Government, we will ensure you are well equipped and able to stand firm without asking help from the GSU or military but are able to undertake your duties effectively protecting your nation as general duty officers posted in various stations. I have no doubt you will be able to perform those duties. Our call as a Government is that you work in collaboration with others because it is by performing those duties that you will be able to defeat the enemy undermining the security of our nation.”

President Uhuru, while addressing the graduating officers who will be incorporated in the Quick Response Unit and deployed as General Duty Officers in crime-infested areas of the country reminded the policemen to remain true to their calling and spearhead the fight against organised crime including terrorism.

“Continue to maintain discipline and bravery as you ensure you utilize the skills you have learnt to protect our citizens and the interests of the country. Don’t be involved in criminal activities. Don’t violate the rights of your fellow citizens whom you are supposed to protect. Protect our country and deal firmly with the enemy but live at peace with fellow citizens because if they have confidence that you are there to protect them that in itself will give them the confidence to also share the intelligence you require to root out the enemy,” he told the officers.

The President reinforced the government’s commitment to the modernization of the National Police Service (NPS) while stating that internal peace and security are the foundation for the nation’s prosperity.

The fundamental reason for the establishment and existence of the State is the provision of security. I cannot over-emphasize that none of the fundamental rights that underpin our vibrant democracy could be enjoyed by Kenyans without security. While our fiscal situation has been tight, we, as a Government, have prioritized the modernization of the Security Sector in terms of equipment and infrastructure. Equally important, we have taken steps to improve the terms of service, through the provision of benefits such as comprehensive medical insurance cover and group life insurance,” he stated.

Interior Cabinet Secretary Fred Matiang’i and Inspector General of the National Police Service Hilary Mutyambai also spoke at the ceremony attended by Environment CS Keriako Tobiko and Chief of the Defence Forces General Robert Kariuki Kibochi.

CS Matiang’i thanked the President for his steadfastness in ensuring the security of all Kenyans noting that the increased Government investment in the security sector was bearing fruits.

“You have taken your foremost constitutional responsibility as President of our country and as our Head of State in securing our country very seriously,” Dr Matiang’i said.

The story of Kwekwe Squad, the highly feared and most notorious crack unit often linked to some of the unexplained assassinations sanctioned by the State in Kenya, was brought again on the spotlight in May this year after Kenyan Canada-exiled Lawyer Miguna Miguna said they eliminated sergeant Kenei–a security guard who was attached to DP Ruto’s Harambee Annex.

In June this year, Wikileaks leaked a letter by the then police who was also the part of the Kwekwe squad who claimed that they were paid Ksh 25000 weekly in the mission to flush out the Mungiki. He, the officer himself killed 37 people in that mission and he estimates that they killed 1869 Mungiki or suspected Mungiki as well as 631 robbers.

NGOs sabotage Turkana development so as to remain relevant

Nyanza Province (not disrespecting the new administrative units) is the number one place on the face of Kenya with many Non-Governmental Organizations (NGOs).

The other place is Turkana & other ASAL regions.

The common denominator for Nyanza and Turkana (not undermining the other ASAL areas) is poverty

In the recently released Infotrak Polls, Turkana is put among the top 10 counties in terms of best performance.

Order of best performing counties

The rating which took into account performance in agriculture, health and education sectors ranked Wycliffe Oparanya’s Kakamega county tops, followed by Salim Mvurya’s Kwale County and thirdly Kivutha Kibwana’s Makueni County.

Kisumu’s Anyang’ Nyong’o was fourth followed by Alfred Mutua (Machakos), John Longangapuo (West Pokot), Jackson Mandago (Uasin Gishu), Muthomi Njuki (Tharaka Nithi) and Josphat Nanok (Turkana). Bomet’s Hillary Barchok closed the top 10 list.

Donor fraud

Cnyakundi.com has often called out the frauds committed by donor organizations.

Turkana County is awash with them, from UNICEF, OXFAM, Elizabeth Glaser Pediatric AIDS Foundation (EGPAF), among others have held the county and the country hostage.

Though they’ve helped in some ways, some problems which can be solved for good keep persisting.

Why?

The NGOs perpetuate them so as to remain relevant.

Though these NGOs play that role, Governor Josphat Nanok is equally guilty of corruption.

A Turkana resident weighs in

In the recently released Infotrak Governor’s ranking. From the ground here I dispute the county rating. There is no one complete Early Childhood Development Education (ECD) Centre since the end of 2017, no complete and operationalized health Centre, no complete n operationalized borehole and tapped water since end of 2017, no complete and operationalized irrigation scheme since end of 2017, no complete and operationalized county tarmac road since end of 2017 to date. The last tarmac was that of Tobongloree (come back home festivities) for FY 2015/2016/2017.

All these have been appearing in county budget every financial year but not done or incomplete.

All offices built by the county are incomplete (county headquarters, ministry of health headquarters, ministry of roads headquarters, staff quarters at the Lodwar Referral Hospital next to Lodwar youth polytechnic, governor’s residence at Nawoitorong has stalled for 7 years now.

Incomplete community and office projects across the sub counties are about 58 giving a total of Sh1.3 billions as a loss.

Then how did it happen our development rating is such high. This is a real joke and scam.

Trump Refuses to Back Ngozi Okonjo-Iweala as Next Head of WTO

The United States of America has refused to back Ngozi Okonjo-Iweala as the next head of the World Trade Organization despite the former finance minister of Nigeria winning the overwhelming backing of the WTO’s 164 members.

The US has instead rejected the recommendation by a WTO nominations committee to back Ngozi Okonjo-Iweala who would be the first woman and first African to lead the WTO.

The US, wants another woman, South Korea’s Yoo Myung-hee, saying she could reform the body. In a statement, the Office of the US Trade Representative, which advises President Donald Trump on trade policy, said the organization “must be led by someone with real, hands-on experience in the field”.

“This is a very difficult time for the WTO and international trade. There have been no multilateral tariff negotiations in 25 years, the dispute settlement system has gotten out of control, and too few members fulfill basic transparency obligations. The WTO is badly in need of major reform.”

The statement, however, did not mention Ms Okonjo-Iweala.

This new development delays the decision on the process until after the US presidential election next week. The process requires all WTO members to reach a consensus, rather than involving a formal vote.

Trump  has in the past described the WTO as “horrible” and biased towards China,

The UoN to Pay Student Sh500K Over Graduation Foul-Up

Kenya’s biggest collegiate research center- the University of Nairobi (UoN) has been ordered to pay one of its graduates Sh500,000 for postponing his graduation for more than four years.

Paul peter Makanda Makokha, a class 2016 graduate had complained that his supervisor had delayed his Masters’ degree graduation.

According to Paul Peter’s petition, he joined the UoN 2009 after he got admitted to pursue a course that would ordinarily last for two years.

In 2011, he was through with his coursework and was assigned a supervisor, Robinson Ocharo, who cleared him to graduate in 2016.

Makanda successfully argued in court that Mr Ocharo was rarely unavailable for supervision which led to the postponement of his graduation.

In his ruling, Justice Weldon Korir noted that the delay in Makanda’s studies was not his fault and ordered the university to compensate him.

“The petitioner has also established that the unwarranted delay in the completion of his master’s studies violated his right to Education. He had a legitimate expectation that he would complete his degree course within two years, as indicated in the letter of admission,” ruled the judge.

In court, Makanda stated that his supervisor took him round in circles when he was working on his thesis which messed up the set preparation period resulting in unnecessary delays.

Makanda told the court that he, after filing hundreds of complaints, was assigned another supervisor and graduated in 2016 although he complained that UoN foul-ups had ruined his chances of securing employment.

According to Makanda, he argued that the delay did not paint his resume in a positive light showing that he spent five years on a 2-year course.

In their defence, UoN lawyers had argued that Makanda was not guaranteed he would take two years to complete a course because thesis writing was an academic process and not an event.

In June this year, 80 law school students filed a petition against the University of Nairobi and asked the court to stop the institution from going on with the online classes.

In their argument, they said that the UoN through its senate arbitrarily and without consultations and public participation made the decision to commence online learning.

The online program has no access to face to face consultation with the lecturers, has limited access to the library and access to physical-based program facilities that it is only fair that the fees is reduced,” the students argued.

In 2019, a master’s degree holder in actuarial science took the University of Nairobi (UoN) to court for employing him as a messenger since 2005.

Stephen Otieno Ogutu argued through his lawyer Titus Koceyo that the High Court should compel the university to offer him a job matching his qualifications.

And besides, his lawyer Titus Koceyo told the Employment and Labour Relations Court that Mr Ogutu had not been paid for the last nine months. The unpaid salary, he says, amounts to Sh310,806. He also sought compensation for wrongful and unlawful withholding of his pay.

Lawyer Paul Gicheru Accused of Witness Tampering in ICC Case Against DP Ruto Surrenders

Kenyan lawyer Paul Gicheru has today turned himself in to Dutch authorities to face charges at the International Criminal Court (ICC).

He is accused of bribing witnesses in a trial of Kenyan Deputy President William Ruto which collapsed four years ago.

The lawyer has been wanted on an ICC arrest warrant from 2015  where he was accused of trying to bribe six prosecution witnesses to recant testimony in the case.

Dp Ruto and his co-accused, broadcaster Joshua Sang, had both charged with orchestrating the 2007 post-election violence which left 1,200 people died.

In 2016, judges ruled that the two had no case to answer, although they left the door open for possible fresh charges in the future, noting that the case had been hampered by political interference and threats against witnesses.

The Hague in a statement said it had asked the Dutch to hand over Gicheru to the court as soon as arrest procedures have been completed.

“Today, 2 November 2020, Mr Paul Gicheru surrendered to the authorities of The Netherlands pursuant to an arrest warrant issued by Pre-Trial Chamber II of the International Criminal Court,” reads the statement from ICC.

“The Court, through the Registry services, submitted a cooperation request to the Dutch authorities for the arrest and surrender of Mr Gicheru to the Court upon completion of the necessary national arrest proceedings,” it adds.

Gicheru is facing six counts related to interfering with the witnesses. In the first count, he is accused of trying to bribe witness P397 with Sh1 million and Sh5 million to have him withdraw testimony against DP Ruto.

In the second count, he is accused of trying to bribe witness P-516 with Sh500,000 to recant his testimony. He is accused of trying to persuade witness P-613 to withdraw as a prosecution witness. He is also accused of trying to persuade witness P-800 by offering a bribe of Sh2.5 million to Sh1.5 million to influence the prosecution witness to withdraw.

In the fifth count, he is accused of trying to induce witness P-495 with Sh2.5 million to withdraw as a prosecution witness. Lastly, he is accused of trying to bribe witness P-536 with Sh1 million to Sh1.4 million to withdraw as a prosecution witness. The court documents that all crimes were committed between 2013 and 2014.

RE: CORRUPTION BY LAPFUND CEO – DAVID KOROSS & COHOOTS

 

Local Authorities Provident Fund (LAPFUND) is a state corporation located on 9th Floor, JKUAT Towers, Kenyatta Avenue Nairobi. The corporation manages pension funds for employees of County Governments and other bodies like water companies etc. 

 

The Chief Executive Officer (MR. David Koross) in cahoots with Head of Finance (Mr. Mbogo) and Head of Procurement (Mr. Kibet) are involved in massive plunder of the corporation resources. Below see list of areas to be investigated among others:

 

a) Development and Construction of Mavoko Gardens Estate in Syokimau. The construction was estimated to cost 700 million but to date we have sunk 1.2 Billion shillings. The CEO pocketed 60 million in kickbacks.

b) The Development, Construction and renovation of Golf View Apartments has cost the fund over 1.5 billion. Currently the Building is closed for renovation at an estimated cost of 133 million shillings. The same contractor was involved in both Mavoko Gardens and Golf View Apartments.

c) The CEO and his cahoots have engaged in purchase of properties at exaggerated prices and others with fake titles. The 30 acres in Kitengela was bought at exorbitant price of 10 million per acre from a broker, while the market price at the time was 5 million per acre. The land is disputed by the owners and they have taken LAPFUND to court. The land in Bellevue South C was purchased at 500 million per acre. A suspicious payment of an extra over 300 million was paid in early 2019 one year after the transfer was done.

d) The CEO has been sending select members of staff for suspicious international training, seminars and trips that are not beneficial to the organization. Some of these have love relationship with CEO. Next week the CEO and more than nine members of staff are going on a tour of America which is against the treasury recommendation of a maximum of four staff at a time.

e) Procurement of Architectural/property development consultants amounting to over Ksh 150 million was done through restricted tender against the PPAD Act regulations in June/July 2019. LAPFUND is not a security body thus should float tenders publicly. Many other tenders amounting to millions of shillings are procured through quotation i.e. Valuation of properties at Ksh 32 million was done in July/August 2019

f) Illegal recruitment of staff without approval by the National Treasury or the board.

g) The property portfolio is over 10% threshold recommended by Retirements Benefits Authority.

h) Funds amounting to over Ksh 11 million stolen from Golf View apartments has been written off in as Bad Debts

i) A property agent selling Mavoko Gardens was allowed to retain 8 million money received on behalf of LAPFUND for over two years

j) Contributors funds are not properly reconciled and statements not issued due to plunder of the resources.

k)  

We request for a forensic audit of the fund by RBA to establish the lot and misuse of pensioners funds.

The CEO survives by bribing and compromising anybody who tries to raise a finger and if the trend continues the fund will be depleted of pensioners’ benefits. Politicians and other cartels collect money at will from the fund. He has protection from political players and other business cartels.

 

We request EACC and DCI to move with speed to investigate, arrest the culprits and secure the files before they tamper with the records.

How BBI was designed to pass through a referendum

After the launch the BBI document at the Bomas of Kenya on Monday, the next step is to redraft it into a BBI Bill, and that will come easy for its proponents.

The product of the handshake between President Uhuru Kenyatta and ODM’s Raila Odinga was not designed to fail like OKOA Kenya that the system crashed because it had signatures of cows and rats.

Or like the Pungumiza Mzigo that was grabbed by it’s ankles and thrown out of the window.

BBI is crafted in a way that the proponents will not struggle to collect one million signatures to move to the next process.

The document is proposing the creation of Ward Funds for MCAs, which is literally ‘a bribe’ for the grassroots leaders to back it.

But BBI is actually unpopular for expanding the executive, parliaments and again watering down the senate and giving the government minister control over police.

The report is proposing the creation of a prime minister’s office and two deputies. Positions that in the current political environment would be considered ‘dynasties’.

But it gets the backing of the hungry politicians who will use it to spread propaganda and confuse the people.

The proponents are already burning to move and sell it though it is still being touted as a discussion draft.

BBI is intending make amendments to 58 Articles of the 2010 Constitution by applying Article 257.

Crafters would opt for Article 256 but it would face many hurdles given its unpopularity.

Tangatanga would make it impossible to achieve the 2/3 majority win.

The report wants to amend 58 Articles of the 2010 Constitution when only 10 require a referendum including the Bill of Rights (Article 31); Functions of Parliament (Articles to 113 and 123), Independence of Judiciary (Article 172) and Devolution (Articles 177, 179, 180, 202, 203 and 207).

Article 256 would have been options to pass the amendments but the proponents fear that The option then is to use Article 257 – and amend the law through a popular initiative (referendum) where state machinery can be employed to crash any little resistance.

The only would be ‘hurdle’ that the handshake would face would be in passing the BBI Bill in at least 24 County Assemblies before it heads to Parliament but that is already sorted by the proposal to create Ward Funds.

MCAs will pass it for that and parliament will pass it because weak Women Representatives will pair up with popular senatorial or gubernatorial candidates to ride to the senate where they will go in pairs.

Members of parliament will also pass the Bill because almost 70 sycophants will be ‘nominated’ and some can be appointed as ministers.

Governors have already been instructed to lobby MCAs. Sycophants like Kakamega’s Wycliffe Oparanya will not sleep on that job, he wants to be a deputy prime minister.

Thirdway Alliance’s Punguza Mzigo Bill flopped after it was rejected in 24 counties.

After the entire process from IEBC, to counties and the parliament, the owners of the draft will have it ‘passed’ by the people.

It shall be approved by a referendum if at least 20% of the registered voters in each of at least 24 counties vote in the referendum.  It should also get the support of  a simple majority of the citizens voting in the referendum.

BBI: Why dynasty member forced pm position in

A member of the Building Bridges Initiative (BBI) taskforce has revealed that the version of the report handed over to President Uhuru Kenyatta and ODM leader Raila Odinga at the Kisii State Lodge on october 21 is a doctored one.

Retired Major John Seii said their report did not include a proposal to introduce the position of the prime minister and two deputies.

The report that was officially launched at the Bomas of Kenya on October 24 wants to expand the executive by introducing the PM office with two deputies.

“PM must be confirmed by the National Assembly. He may be fired by either the president through a decree or by the National Assembly through a vote of no confidence,” the report reads.

Major Seii was categorical that PM position was not part of the initial report that the task force agreed on.

The member of the taskforce also revealed that Kenyans did not ask for that position so they could not propose its introduction.

The report took too long to be brought out since it was taken back to be revised after being launched in November last year.

The proponents of BBI document, President Kenyatta and Odinga must have read from different scripts on this.

Kenyatta’s politics has never been about creation of more positions, in fact it’s one of the reasons he crashed OKOA Kenya in 2016.

But Odinga has been all about the premiere position anytime he thinks about amending or overhauling the law.

From 2002 when he backed ex President Mwai Kibaki to be the then KANU candidate Uhuru Kenyatta.

The Retired Major further disclosed that they only agreed office of the official opposition.

The office aims to address the issue of winner takes its all since there would be a proper ground for the runner up to keep an eye on government.

Major Seii who doubles as Chairman of Nandi Council of Elders spoke at Emoo Fm added that the taskforce never discussed adding more seats in parliament.

Former researcher Adams Oloo who sits at the taskforce is one of the long time Raila sycophants who must heed to Baba’s demands.

The president claimed that the BBI report is not about creating positions for individuals as opponents argue that creation of new position will only benefit a few on top. The dynasty.

“The BBI report is not about creating a prime minister’s position or president for anyone, this report is not against anyone or targeting anyone, it is about 50 million Kenyans,” Uhuru said.

Tangatanga argues that Odinga who likes crafting coalitions wants to use it to gift allies who will support his 2022 presidential bid.

He can also use it to tame the appetite of possible competitors like retiring governors.

Kakamega Governor Wycliffe Oparanya is always behaving like he has been promised a Deputy Prime Minister position to ‘finish’ Raila opponents in Western.

KABU boss Gideon Moi has been rumoured as Odinga’s possible running mate while Peter Kenneth is jostling for the PM position.

Another DPM position would be gifted to people like Kivutha Kibwana if he doesn’t join DP William Ruto.

ODM loudmouths like Embakasi Mp Babu Owino let it out that ODM wants the president to make a come back as the PM.

President has repeatedly said that he is not interested to serve beyond 2022. He will be retiring when Odinga who is also pushing the creation of PM position will be making a fifth stab at presidency.

If adopted in its current form, PM will be appointed by the president from the party with the majority members in Parliament.

“The office holder shall be appointed by the president from the party or coalition of parties that are a majority in the National Assembly, and if no party has a majority, the person who appears to have the support of majority of the members of the National Assembly,” the report reads.

DPP Haji on Kidero’s neck over attempts to wipe out evidence

Director of Public Prosecutions Noordin Haji is exploring every legal mechanism  and power to have former Nairobi Governor Evans Kidero  under his radar.

The DPP is opposed to application by Kidero seeking to wipe out bank statements from his trial claiming that they were not obtained legally.

Haji told High Court judge James Wakiaga that the bank statements were obtained through a court order.

But the prosecution argued that Ethics and Anti-Corruption Commission (ECCA) obtained the order allowing it to get the documents from Kibera Law Court.

Assistant DPP Joseph Riungu told the court that there is  no basis for deleting documents from the court records. He added that Kidero did not make any case for issuance of the orders he is seeking.

But the controversial figure insisted that the bank statements were illegally obtained adding that his co-accused were  also supplied with a different bank statements prior to the trial.

Kidero further claimed that he learnt of the bank statements when a Co-operative Bank official testified during his trial.

DPP suffered a set back when Chief Magistrate Douglas Ogoti ruled that he ought to have obtained his permission before tabling Kidero’s documents.

But Ogoti refused to wipe out the testimony of Charity Williams, a Co-op bank official, from the record, twisting the case for both the prosecution and the defence teams who filed appeals.

“This is not a matter to be taken lightly because the fairness of the process and administration of justice to all the parties depends on the integrity of the parties and of the trial court,” Dr Kidero stated in documents filed in court.

The statement contains the County operations account held at Co-operative Bank, City Hall branch from January 1, 2014 to April 19, 2016 when Kidero was the Nairobi Governor.

Dr Kidero if facing criminal charges together with former chief officers who served during his time at the City Hall.

Scandal-Ridden Ex-Family Bank CEO Joins Politics To Clean Image And Avoid Jail

Former family Bank CEO Peter Munyiri has joined the 2022 race to clean his image and avoid jail. Peter Maina Munyiri was the family bank CEO before he was fired for masterminding and laundering the NYS proceeds of crime.

Before he was suspended by the Family Bank, Peter Munyiri had earned the title of Mr. 10% and were it not for pressure from the editor of this site, the man would have walked free with his crimes, that he is yet to pay for.

No money laundering racket in Kenya operates without some Bank CEO betraying both public and consumer trust to use their vaults to sanitise the dirty money which almost certainly is proceeds of public plunder like in the case of ‘NYS scam’ or terrorism like is said of the riches of a prominent Nairobi lawyer of Cushitic extraction.

A brief history of Peter Munyiri.

When the skinny man with a weird face and fake smile left his dusty village in Mathira and met Ben Gethi, the boy of high-level government tenderpreneurs; also from a dusty village in Karatina; the two may have quickly saw in themselves the perfect embodiment of everything that could have gone wrong with Kenya’s Ponzi scheme that is the financial sector. With time, they would make a mockery of it, and reap the country off in a scam whose scale no forensic analysis has unearthed yet.

“Peter Munyiri is a greedy small man with an unbridled ambition for illicit wealth and raw, irresponsible power that accompanies it,” a Family Bank insider introduced him to us.

We learn from this insider that the source of Peter’s ambition to launder money started with a rejection by the old boys of Kenyan money; the men who raped the country when it was still in puberty. The scions of the economy butchers of the 60s, 70s and 80s.

They rejected him at Karen Golf Club but after he laundered NYS, in billions, a few accepted him at Muthaiga. He still reels from Karen rejection.

“Without money, getting noticed, let alone respected as an equal, was a tall order at Karen Golf,” we are informed.

Like Anais Nin, the dream (of recognition) was always running ahead of him, to catch up; to live for a moment, in unison with it, that required him to pull a scandal in such a grand scale that even if the Karen golfers were still not going to let him in; they would at least discuss him in low tones.

His first break came when he met Ben Gethi. He had earlier allegedly attempted to launder money at Kenya Commercial Bank under the strict and moral Banker Martin Otieno but this did not materialize. He was fired.
Using ethnic connections, he was placed at Family Bank; a bank which seemed to have been formed with the main aim of plundering public coffers.

Now heading a bank; Family Bank; he and Gethi would move with speed to rob Kenyans as Uhuru concentrated on Waiguru and ICC.

Peter Munyiri almost collapsed Family Bank

Gethi had connections in the highest places of the porous Uhuru regime.

Gethi would loot state coffers, in billions, assisted by the Josephine Kaburas of this world, and Peter Munyiri would be the man to clean the money of the blood of dying Kenyans for lack of medicine or food; and give the money some veneer of respectability in the guise of ‘real estate’ investments.

When DPP Keriako Tobiko ordered probe into the activities of Family Bank, it was as a result of a multi-billion shilling heist, planned and executed by a small clique of government functionaries whom John Githongo had in mind when he (together with Michela Wrong) authored ‘It’s Our Turn to Eat”.

Munyiri, as CEO, sat atop this pyramid scheme.

“As they worked on the NYS looting spree, Peter was promised the job of CEO of National Bank of Kenya. National Bank attracted him because of the weak systems. He also knew the big boys used National Bank to launder money. He didn’t care much about Family Bank sinking. However, the explosion of NYS scam left him exposed and his political friends scampered for a safe distance. Some started roasting him immediately,” observes our source.

In time, his only trusted friend remained Erastus Mureithi, former Ol Kalou MP.

Earlier, he had been safe in the hands of old thugs like Wilfred Kiboro; an avowed Kikuyu supremacist who also managed to turn Daily Nation from a respectable national newspaper to a Mt. Kenya spreadsheet where anti-Raila hogwash often find safe abode.

Kiboro lavished Munyiri with praise when in 2015 the proceeds of money laundering for Family Bank reached Ksh3 billion. Later in the same year; the Bank attracted authorities for money laundering.

In the NYS scam, money would be wired into an account at the bank then redistributed to other banks. While the bank distanced itself from the scam, it, later on, sent home nine of its managers who were linked to the transactions as a form of sacrifice something that didn’t please Kenyans.

Peter Munyiri later faced criminal charges for money laundering after his efforts to block prosecution failed (In our next article, we will focus more and remind Kenyans about the fraud and Munyiri’s efforts to kill the case)

We will also focus on efforts by Peter Munyiri to launder the NYS proceeds of crime in some ventures and review his past scandals including a land grabbing-case so that Nyeri residents can make a wise choice come 2022.

Lastly, we will focus on his shenanigans in the banking industry.
