Animal Farm: DP Ruto Cries Foul

Using the allegorical novella by George Orwell, Animal Farm, Deputy President William Ruto has accused the government of treating other people more equal than others. He has accused the National Police Service of frustrating him and being selective in the application of the law.

Reacting to the stringent security measures that saw convoys deployed to stop him from holding public gatherings, the DP said it was the responsibility of the police to serve all Kenyans equally irrespective of ethnic, political, and social status in the society.

The measures were issued through a public order act endorsed and ratified by the Cabinet.

“It is unfortunate that police cordoned off the venues of Kakamega church functions last weekend while allowing others to go on uninterrupted, “said Ruto.

The DP was talking about an event that saw ODM leader Raila Odinga has freely host hundreds of elders from the Kikuyu community at his Bondo home in Siaya.

He expressed his displeasure at the conduct of the police officers whom he accused of bias.

Ruto and his Tanga Tanga allies have cried foul over the latest incident where police cordoned off a church in Mumias, where they had been scheduled to preside over an event.

The DP reckons his political counterparts are disregarding the 2010 Constitution by using the police for personal vendetta contrary to the constitution which empowered police to be independent while discharging their duties.

The Deputy President made the remarks Monday, at his Sugoi home in Uasin Gishu County, when he hosted church leaders from 50 different denominations drawn from Luo Nyanza.

“Let’s not turn Kenya into an Animal Farm, where all animals are equal, but some animals are more equal than others. All Kenyans must be served equally irrespective of who is leaning to which direction politically. Law must be applied equally not selectively,” said Dr. Ruto

HELB marketing manager Wavi Muigai in illegal tender practices

Mkubwa Media, one of the Public Relations (PR) firms owned by one Kirimi Achieng is accused of colluding with a marketing person at the Higher Education Loans Board (HELB) Wavi Muigai.

Cnyakundi.com has in its possession WhatsApp conversations to this effect.

It is a conversation regarding how an ad agency owner and the HELB marketing person discuss a tender before the award.

Kirimi from Kijizi, another ad agency she owns, even sends the presentation to Wavi Muigai, HELB and even gets feedback.

This is conflict of interest which culminated with Kijizi eventually winning the tender.

Kirimi is said to have registered the new PR firm Kijizi so as to throw off investigators who might raise questions as to why she wins tenders at HELB everytime.

Mkubwa Media managed HELB account around 2017. She simply registered another company and colluded with HELB to get Kijizi the contract.

We can now authoritatively reveal that Yuehua Bai, the ghost owner of the Quest Civil Engineers Ltd, is the reason as to why the Nairobi Hospital fired the incompetent and full of interests then CEO Allan Pamba.

It was reported that Pamba’s goose started cooking-rather roasting- when he fired the facility’s Finance Director who was the son of the former MD National Bank and a controversial Moi era ‘businessman’ John Simba who’s also listed amongst the ghost owners of the Nairobi Hospital.

Another narrative came that, Nairobi Hospital’s Board Chair Dr Irungu Ndirangu had fired Allan Pamba- who is said to have been trying to control the procurement and finance department at the facility to suit his looteinants in the UN financed Sh1.1 Billion COVID-19 treatment facility at the Old Nursing School in Nairobi Hospital– and, instead of, rewarded the tender to Quest Civil Engineers Ltd- a firm associated with Dr Ndirangu’s brother.

Is it true? Yes, about COVID-19 Center, Allan Pamba and the Project Manager Brian Lishinga were supporting China Wu Yi. Then CEO Pamba and his right-hand man- Lishinga had already received their kickback upfront. China Wu Yi handlers were pushing them very hard after they lost the multi-billion tender they had bribed to bag. Allan kept promising them that there are other tenders coming.

China Wu Yi carries out international projects as the overseas arm of the Fujian Construction Engineering Group Company, a China State-owned conglomerate that was, in September 2006, awarded the Ksh123 trillion modernization of the Jomo Kenyatta International Airport.

NO, well not really- because the said to be Dr Ndiragu’s brother RM Kariuki is only listed as a secretary without a single share in Quest Civil Engineers Ltd- Which is owned by the alleged scam mastermind and Chinese cartel Yuehua Bai.

Here is the proof that Yuehua Bai is the ghost owner of the incompetent Quest Civil Engineers Ltd and Ndiragu’s distant brother has no shares in the Chinese firm.

Bai’s five-year work permit in Kenya expired on June 3rd, 2020. He has therefore been working in Kenya illegally, and this includes, signing of the contract in July 2020 and Building the COVID-19 Center at the Nairobi Hospital, for the last four months, without a Work Permit. How did that happen?

According to the initial plan as approved by the United Nations on behalf of the Financier- World Bank, the 150-bed ultra-modern facility with 25 Intensive Care Unit (ICU) and 50 High Dependency Unit beds, a theatre, laboratory, a radiology diagnostic centre was supposed to be completed in eight weeks time and up to now, close to 100 days, the inexperienced Yuehua Bai owned firm is still asking for time to be extended.

However, Allan Pamba and his tumbocrats were slapped with dismissal letters after the board cut short their plans only to award the little known Quest Civil Ltd a Chinese firm owned 100% by Yuehua Bai who, by the way, is in Kenya illegally! Yes, his work permit expired long before he signed the contract this year.

Was the tender awarded illegally, since the 100% Shareholder to the firm that bagged it, Yuehua Bai is working in Kenya, illegally?

AU Commission and its chairperson Moussa Faki Mahamat appointed former Prime Minister Raila Odinga as  AU’s High Representative for Infrastructure Development in Africa since this is an UN-World Bank-funded project- is he answerable or are his oversight duties part of this? What is Raila Odinga as AU’s special envoy response about this scam?

Note, As of October 7th 2020, Bai had not even applied for a renewal of his work permit. How can one be in Kenya illegally, and get awarded to Construct a Ksh 1 Billion COVID-19 Centre Hospital funded by United Nations/Nairobi Hospital?

How? I mean, Bai being here illegally means, he does not owe anyone, any responsibility, let alone the fact that he should not be in Kenya nor working!

By the way, Dr Ndiragu’s fronted Quest Civil Engineers Ltd is not only illegally working in Kenya but also the embattled director Yuehua Bai has failed to pay contractors their dues since the groundbreaking.

Corruption is a mortal enemy in Kenya and while it remains the duty of the YOUTHS to challenge it, none of the corruption-related issues will be resolved without ACCESS to the information.

Now I pose the question, who are these at the Immigration Department that are protecting this Chinese cartel and keeping him in Kenya illegally?

How Tangatanga and ODM became hardliners in UhuRuto truce

Tangatanga politicians have issued serious conditions to be met  before any efforts to reunite President Uhuru Kenyatta and his deputy William Ruto can be discussed.

The leaders backing Ruto want his functions as a deputy president who chairs Cabinet sub-committees, among other roles, to be fully reinstated before he can commit to any truce.

Two religious leaders who were leading the ceasefire drive convened at the DP’s residence in Karen resolved to repulse all reconciliation efforts until certain conditions are met.

The meeting was also attended by senators Kithure Kindiki (Tharaka-Nithi) and Kipchumba Murkomen (Elgeyo-Marakwet), MPs Alice Wahome(Kandara), Rigathi Gachagua (Mathira) and Kimani Ichung’wah of Kikuyu.

Senator Murkomen said the President should have the basic courtesy to lead Kenya in good faith even without necessarily supporting Ruto’s 2022 presidential bid.

“Forget the truce. What we are asking for is simple: respect the DP and his office. Let him restore Ruto’s duties and ask the juniors to behave with decorum. That is what we are requesting. A political handshake is not our priority now,” Murkomen said.

Another Ruto ally from the president’s Mt. Kenya backyard, Kiharu MP Ndindi Nyoro said team Tangatanga is not interested in a truce because it would not add them any value.

“Why now? We will soldier on as it is. They know their strategies are not working.” Nyoro said.

His sentiments were backed by Nandi Senator Samson Cherargei who said the horse had bolted and they not interested in any political truce.

A handful politicians in the president’s camp have also rejected the reconciliation efforts. Jubilee Vice chair David Murathe dismissed such talks as ‘imaginations of team Tangatanga’.

“Kindly disregard their propaganda. The President is busy serving the nation and those claiming that there is a planned truce are talking to themselves,” Murathe said.

And nominated MP Maina Kamanda who controls no constituency said there was no problem in talking but their side (Kieleweke) can not trust Dp Ruto who harbours ambitions of succeeding President Kenyatta in 2022.

“The Ruto group is trying to use the truce talks to slow down our support for Raila. We are telling them that we cannot be distracted,”  Kamanda said.

Other MPs allied to ODM leader Raila Odinga led by John Mbadi (Suba South), Peter Kaluma (Homa Bay Town), Lilian Gogo (Rangwe)also weighed in on the matter.

Mr Mbadi who is not a member of Jubilee demanded any conversation around the truce to be brutally honest.

“There is no two ways about it. The person leading the reconciliation talks should either tell Uhuru to abandon his peace and unity agenda of the country and help Ruto’s selfish 2022 presidential campaign or tell Ruto to stop early campaigns and help in service delivery.” he said.

ODM politician hide behind the handshake as darlings to the president hoping that he (Uhuru) will endorse Raila for the country’s top job in 2022.

Mbadi who doubles as ODM chairman said Uhuru’s handshake with Raila was aimed at uniting the country and any attempts to scuttle the process would be selfish.

And some politicians allied to the DP Ruto also fear that committing to truce talks will cut them to size as they will have to negotiate from a point of weakness.

They have rejected one of the mediators, a Cabinet secretary from the Rift Valley whom they accused of condoning the whittling away of DP’s powers.

Most of Tangatanga politicians harbour the feeling that nothing meaningful will come out of the truce.

Ruto allies have been kicked from party leadership and house committees, some have been taken to court while others have been sacrificed in what they see as ‘circumvention’ of the law.

Blow to Senator Orengo and His Asian Client

In September, Siaya Senator James Orengo had gone to court on behalf of the Asian owned Crossley Holdings Limited, claiming ownership of the controversial 10,000-acre parcel of land that Miwani Sugar Company sits on.

However, yesterday the Ministry of Agriculture clarified that Senator Orengo’s client Crossley Holdings Limited had acquired the disputed land irregularly and through a fictitious process.

The Asian firm-Crossley Holdings Limited, that had petitioned to be refunded Ksh6 Billion suffered a great blow after the Ministry- on behalf of the State, initiated a process to forcefully repossess the 10,000 acres of land belonging to the collapse sugar miller Miwani Sugar Company Ltd.

In a meeting at the august House, Agriculture PS Hamadi Boga told the National Assembly’s Agriculture Committee that the ministry was liaising their counterparts in Lands and NLC to revert the disputed parcel back to Miwani Sugar before the planned leasing.

According to PS Boga, the ministry’s legal team and the receiver-manager of the miller held a meeting last month at Ardhi House with Lands PS Nicholas Muraguri and discussed rather agreed how to revert the land to the company for cane farming.

The PS (Muraguri) has directed that we immediately lodge the original title together with the supporting documents so that provisional Title issued to Crossley Holdings Limited can be cancelled and to pave way for the transfer to Miwani Sugar (1989) Limited,” Mboga told the committee.

In the petition seen by cnyakundi.com, Senator Orengo’s clients not only wanted the land LR No 7545/3 that is currently occupied by illegal settlers after the miller stopped operations reverted back to them but had also demanded Sh6 Billion from the miller.

Alternatively, the firm wanted Sh4.6 billion being the current market value of the land with interest from the date of filing the petition until payment in full and any other loss of income incurred until the petition is heard and determined.

Raila Odinga’s close- Siaya Senator James Orengo- ally had professionally gone behind his ‘political boss’ back in a case that is creating a twist in the planned leasing of the state-owned sugar factories.

We understand that the former PM Raila Odinga is fronting the privatisation of collapsing Muhoroni, Miwani, Chemelil, Sony and Nzoia Sugar Companies.

But documents tabled before the committee chaired by MP Silas Tiren (Moiben) show the land LR No 7545/3 was fraudulently sold to Crossley Holdings Limited in December 2007 following a court order in 1993. But, the sale was later vacated after it emerged that it did not follow the law.

In a case filed by then, operational-now collapsed- Miwani Sugar, the court ruled in June 2008 that Crossley Holdings Limited acquisition of the land was null and void.

Havi: Senior gov’t officials using Njeru to frustrate CJ Maraga

President of the Law Society of Kenya Nelson Havi has distanced himself from the plots being cooked to unlawfully kick out Chief Justice Maraga.

Havi said that the society will take appropriate legal action against any intentions to proceed with the ‘unlawful’ bid to kick out CJ Maraga who retires in January.

LSK President was responding to Macharia Njeru, LSK representative at the JSC, who accused Maraga of frustrating recruitment of his successor.

Njeru said there are external and internal forces working with the CJ to influence the choice of the next Chief Justice.

Njeru’s drama is coming out when Maraga is due to proceed on terminal leave on December 15 before he retires on January 12, 2021.

He got wild after Maraga cancelled a meeting on Friday pushing him to rope in the Deputy Chief Justice Philomena Mwilu, and Justice Mohamed Warsame whom he accused of opposing the commencement of the recruitment process.

The meeting that the CJ cancelled was planned after a stormy on September 30 when the JSC’s sub-committee steering the recruitment availed its report.

“After lengthy deliberations of over three hours, the Chief Justice asked for an adjournment to October 16 (today) to allow for consensus other than a vote to decide the crucial process,” Njeru complained.

Havi accused Njeru and Mercy Deche of taking unlawful and unconstitutional position.

He added that the two commissioners are pursuing a cause whose results will dent the image and credibility of the commission.

Havi dissociated the society from the plot as he revealed that some senior government officials are not happy with Maraga’s firm defence of the rule of law and constitutionalism in the Kenya.

“The society, therefore, dissociates itself from the position taken by Macharia Njeru and Mercy Deche. The state capture of the Judiciary and the JSC cannot be executed through representatives of the society,” he said.

He added that LSK will have to consider whether to retain the two commissioners as its representatives at the JSC or not but he clarified that the recruitment of the CJ and the deputy CJ is regulated by Section 30 of the Judicial Service Act.

And that the recruitment of the CJ and the deputy can only commence after a vacancy occurs in the two positions.

Senator Gideon Moi behind Kamama job losses

Former Tiaty MP Asman Kamama has accused Baringo Senator/Kanu Chairman Gideon Moi of being the force behind his loss of three state jobs after he was fired from the National Social Security Fund board.

The former lawmaker had previously lost his jobs at the Rift Valley Water Services Board and the North Rift Water Services Board.

Kamama accused Moi, the current Tiaty Mp William Kamket and the entire Kanu top brass of frustrating people from Rift Valley who are ‘not licking Gideon’s boots’.

“The people fighting me are William Kamket (MP Tiaty) and Kanu leadership. They have ensured that I do not serve in any position in this government,” he said.

He unsuccessfully defended his parliamentary seat on a Jubilee Party ticket in 2017 after he lost to Kanu’s Kamket, a die hard sycophant of Gideon Moi.

The former chair of Parliament’s National Security committee was appointed by Labour Cabinet Secretary Simon Chelugui to the NSSF last week but was revoked through a special gazette notice.

Revocation of Kamama’s appointment was done by the Office of the President.

Kamama is raising his complaints months after Cherengany Mp Joshua Kutuny also accused Moi of misleading President Uhuru Kenyatta to sack members of the Kalenjin community allied to the Deputy President William Ruto.

The former Tiaty Mp is perceived to be a Tangatanga sympathiser, an outfit associated with the DP William Ruto who is Moi’s rival.

Kamama said that he is no longer interested in state jobs but he has booked an appointment with President Uhuru Kenyatta to find out what his crime is.

He said he will be accompanied by all the leaders from West Pokot including Governor John Lonyangapuo.

Kamama also accused Kanu of superintending the affairs of Kalenjins in Jubilee government and it is doing so by witch-hunting perceived enemies.

Focus on MPs as debate to control IEBC gets hot

The unconstitutional composition of the IEBC is at the centre of a brewing battle between two factions of Jubilee Party as they position themselves ‘to win’ 2022 polls.

On Thursday, MPs passed the IEBC (Amendment)(No.3) Bill 2019, which gives the Parliamentary Service Commission (PSC) power to fill four slots out of  seven in a panel that will appoint commissioners to the Independent Electoral and Boundaries Commission.

Allies of President Uhuru Kenyatta and his Handshake partner, Raila Odinga, are controlling the Parliament are using their numbers to influence the selection process.

Mps allied to the Deputy President William Ruto have warned against schemes by Kieleweke wing of Jubilee to rig 2022 polls.

But Kieleweke Pressman Wambugu Ngunjiri has dismissed such claims arguing that the Bill was the brainchild of Baringo North MP, William Cheptumo who is a Ruto ally.

Cheptumo was the chair of the Justice and Legal Affairs Committee but was kicked out by President Kenyatta during a purge that stripped DP allies of party leadership and house committees.

Soy MP Caleb Kositany on Saturday said Tangatanga is aware of plans by Kieleweke to control the IEBC with hopes of using it to steal 2022 elections.

“We have confidence in the people and their votes. We will not seek any favours with the commission, we will talk to the voters, they are the ones who will decide the winner,” Kositany said.

The Bill is now awaiting a presidential assent before the selection panel can name four commissioners to replace those who resigned after the contested 2017 elections.

The four new commissioners will work with three others currently in office to oversee the 2022 elections and may be a referendum under the Building Bridges Initiative (BBI).

Tangatanga politicians have said that their interest was on the players and not the referee.

They say that they are not worried at all as they were covering the country slowly and empowering voters with wheelbarrows, motorbikes and sewing machines among others.

“When we are moving around the country, they are planning and scheming. When we win the election, they will start crying foul, their script is known,” MP Gachagua said.

Hon Rigathi Gachagua of Mathira is a Ruto die hard.

The process of appointing electoral commissioners has always been rocked with controversies.

After losing the 2013 polls Raila championed demands to kick out the former commission led by Issak Hassan.

He accused the commission of favouring the incumbent and that it could not be trusted to deliver a free and fair elections.

The commission was overhauled and a new one put in place led by Wafula Chebukati.

Raila again accused the Chebukati led commission of the same after the mishandling of 2017 polls where he lost but since joining government, the ODM leader went mute on IEBC.

On Tuesday 15, President Uhuru Kenyatta gifted the former Independent Electoral and Boundaries Commission (IEBC) commissioners Margaret Mwachanya, Connie Nkatha and Paul Kurgat with ambassadorial jobs.

The three resigned from the IEBC after the controversial 2017 polls.

The  President also gifted Build Bridges Initiative (BBI) Joint Secretary Ambassador Martin Kimani , who was picked to be Kenya’s Permanent Representative in the United Nations, New York.

Loss Making KPLC Fined Sh722 Million

Troubles continue to pile at the already loss-making Kenya Power (KPLC) after it was slapped yet again with a Sh722.31 million penalty for flouting 40-day window of paying for the electricity supplied in the financial year ended June 2019.

According to KPLC, this is a 28.9 per cent drop from the preceding period when KenGen hit the struggling power distributor with a Sh1.02 billion penalty an annual report from Kenya Electricity Generating Company (KenGen) confirms.

“Interest income from Kenya Power relates to interest penalties charged to Kenya Power due to late payments of invoices. Interest on late payments accrues after 40 days,” says KenGen.

KenGen records indicate that as at end of June 2019, Kenya Power was owed it Sh18.86 billion, pointing to accumulated debts that will eat into the profit through high finance costs.

Earlier in May, records at Capital Markets Authority indicated that President Uhuru’s mother- Mama Ngina Kenyatta owns 2.2 million shares or a 0.11 per cent stake in the KPLC, a power monopoly whose ownership is dominated by institutional investors like the Treasury and scandal-filled National Social Security Fund (NSSF).

It’s not clear when she acquired the minority stake, which is small compared to the multi-billion-shilling investments controlled by the Kenyatta family in real estate, insurance, education, banking, manufacturing, farming and hospitality sectors.

Johnson Nderi, an analyst at Suntra Investment Bank stated that if the Sh37.7 million share was not been hived off a larger trust, it was certainly not bought for commercial reasons.

Even before that, KPLC has been struggling to sell the electricity supplied by power generators such as KenGen. Covid-19 disruptions have served to complicate the situation further exposing Kenya Power to an increased burden of paying for idle electricity.

Records indicated that Kenya Power had about 22.9 per cent of the unutilized power supply as the local power production between January and August stood at 7,469 million kilowatt-hours (KWh) against the 5,759 million KWh sold by Kenya Power.

The agreement signed in the contracts between the State and Power producers Kenya Power to buy the agreed amount of electricity regardless of whether or not the utility needs the energy.

By the time KenGen was closing its books for the financial year ended June, Sh3.45 billion due from Kenya Power had been outstanding for more than 60 days while a further Sh1.21 billion had remained unpaid for over a year.

Kenya Power buys a mix of hydro, thermal, wind and geothermal-generated electricity from KenGen and independent producers for onward sale to homes and businesses. KenGen then bills it every month for the power delivered.

KenGen currently sells its generated electric energy to a single off-taker, Kenya Power, and recognises this as a business risk.

The firm has in the past indicated that it would ride on newly enacted Energy Act to sell bulk energy to multiple customers as opposed to just Kenya Power alone.

Pavel Oimeke, the corrupt EPRA Boss that had been suspended

This comes at a time KPLC had, on Thursday last week demanded that Energy and Petroleum Regulatory Authority (EPRA) be removed from power purchase agreement (PPA) negotiations to reduce the oversupply of electricity in the market.

KPLC wants a new body established to preside over the signing of power deals which have overburdened it with an excess supply that must be paid for.

All these are happening at a time the High Court has reinstated the corrupt EPRA boss Pavel Oimeke who’s first term at the helm was set to expire on August 1, before being corruptly reappointed for another three-year term on July 27.

A petitioner,  Emannuel Wanjala, had moved to court to block his re-appointment, accusing him of colluding with illegal LPG dealers, nepotism, tribalism and favouritism.

4G on the Moon as Nokia Bags Sh1.5 Billion NASA Tender

Finnish equipment manufacturer NOKIA has been tabbed by National Aeronautics and Space Administration (NASA) to deploy an “ultra-compact, low-power, space-hardened” wireless 4G network on the Moon.

Nokia’s network equipment will be installed remotely on the moon’s surface using a lunar hopper built by Intuitive Machines in late 2022. The 4G equipment can be updated to a super-fast 5G network in the future, Nokia said.

“The network will self-configure upon deployment,” the firm said in a statement, adding that the wireless technology will allow for “vital command and control functions, remote control of lunar rovers, real-time navigation and streaming of high definition video.”

According to a report published by The Guardian, Nokia was picked to lead the project worth $14.1 million (Sh1.5 billion) that, according to NASA will be key to plans to establish a long-term human presence on the moon by 2030.

The system could support lunar surface communications at greater distances, increased speeds and provide more reliability than current standards,” NASA noted in its contract award announcement.

The Sh1.5 Billion contract, awarded to Nokia’s US subsidiary, is part of Nasa’s Artemis programme which aims to send the first woman, and next man, to the moon by 2024.

This is part of NASA’s “tipping point” selections, worth $370 million (Sh40 billion) in efforts to advance research and development for space exploration.

According to Nokia, which will lead the project with its partner Intuitive Machines, the network will self-configure upon deployment and establish the first LTE communications system on the Moon.

“Leveraging our rich and successful history in space technologies, from pioneering satellite communication to discovering the cosmic microwave background radiation produced by the Big Bang, we are now building the first-ever cellular communications network on the Moon. Reliable, resilient and high-capacity communications networks will be key to supporting sustainable human presence on the lunar surface. By building the first high-performance wireless network solution on the Moon, Nokia Bell Labs is once again planting the flag for pioneering innovation beyond the conventional limits.” Marcus Weldon, CTO at Nokia and Nokia Bell Labs President said.

In a Twitter thread, Nokia’s research arm, Bell Labs, said that the company intends for the network to support the wireless operation of lunar rovers and navigation, as well as streaming video.

This is not Nokia’s first attempt at setting up the Lunar LTE network, In 2018, Nokia was first commissioned to undertake the project with PTScientists, a German space company, and Vodafone UK to launch an LTE network at the site of the Apollo 17 landing but the project never took off.

Last week, NASA announced last week it would distribute $370m to 14 companies to supply “Tipping Point” technologies for its mission, which include robotics and new methods of harvesting the resources required for living on the moon, such as oxygen and energy sources.

The bulk of the funding went to companies researching cryogenic propellants, freezing liquids used to fuel spacecraft. Among them, Elon Musk’s SpaceX received $53.2m for a demonstration of the transferring of ten metric tons of liquid oxygen between tanks on a starship vehicle, Nasa said.

Why are African Leaders Ignoring Nigeria?

There is a genocide currently taking place in West Africa, Nigerian Police have been spraying live bullets at Nigerian youths protesting against the excessive use of force, rapes, and murder by the infamous and anti-robbery police force.

Anger over the rampant abuse by the police’s loathed Special Anti-Robbery Squad (SARS) erupted into widespread protests about two weeks ago, drawing thousands of people on to the streets.

However, African leaders are silent, going about their normal corruption routines and political rallies while the men they occasionally sit and dine with are committing crimes against humanity.

There has been an uproar focused on SARS and the youth, who claim grave treatment for showcasing any kind of flashy lifestyle.

Before mass murders and thousands of injuries, the Nigerians took to social media in a campaign that garnered millions of impressions and attention from the high and mighty from countries from different continents.

The Nigeria government had announced it had disbanded SARS, but as usual, the trend of lying and renaming the force or reshuffling the heads was unacceptable so the youth took to the streets, unknowingly many would not go back home.

Kenya for instance is a member of the UN but has been silent over the matter when people like the US presidential candidate Joe Biden have urged the president and military “to cease the violent crackdown on protesters in Nigeria, which has already resulted in several deaths.”

“The United States must stand with Nigerians who are peacefully demonstrating for police reform and seeking an end to corruption in their democracy,” Biden said in a statement.

“I encourage the government to engage in a good-faith dialogue with civil society to address these long-standing grievances and work together for a more just and inclusive Nigeria.”

Muhammadu Buhari, Nigeria’s president has also been silent while his citizens face injustice, as the president the man should be called out by his fellow comrades, as a matter of fact, the man should be impeached and put on trial for his role in the bloodshed that is being witnessed in his country.

The silence by fellow presidents and people in power in the continent is loud. If they do not see anything wrong with what is going on in Nigeria, best believe WE ARE NEXT!

Damaris Too ditches Gideon Moi for DP Ruto

Kanu women congress leader Damaris Too has ditched Baringo Senator Gideon Moi and his KANU party with word that she is destined to join the Deputy President Dr. William Ruto.

The ‘queen of the independence party’ stated in her resignation letter that she was wants to pursue other personal and professional interests.

“Over my years as a gold member, I have had the opportunity to meet great leaders of the party and learnt many lessons that I will truly cherish in my future pursuits as I move to the next chapter of my life,” the letter reads in part.

Dp William Ruto is Senator Moi’s biggest political rival, not only in Rift Valley but in the entire scope of national politics.

Both leaders are eying the presidency when President Uhuru Kenyatta’s term expires in 2022 with Ruto being the man to beat.

KANU that is just a shell of itself left is struggling to revamp itself as events to shape the 2022 battle takes shape with unveiling of BBI report in Kisii state lodge today.

BBI is going to set a fierce battle ground between DP William Ruto and ODM leader Raila Odinga who is aso scheming to succeed Uhuru in 2022.

Moi is also a BBI drummer with political undertones debating about him being Odinga’s running mate in 2022.

Ruto is a fierce critic of BBI which he terms as a ploy to create positions for a few dynasty sycophants instead of creating employment for the youth.

Moi is not commanding enough political influence to face Ruto, one of the reasons Damaris Too is shifting her political allegiance to where the future seems ‘bright’.

She also requested the registrar of political parties, to delete her name from the list of KANU members immediately.

The move to have the Registrar of Political Parties remove her name from members of Kanu is aimed at laying grounds for her to join Tangatanga or another party as a member and run for a political seat come 2022.

“By a foot of this letter request that the office of the Registrar of Political Parties to immediately delete my name from the members’ list of Kanu Party” she wrote.

Too also appreciated the old party for according her the opportunity to be part of ‘Kenya’s political history.

US Govt files antitrust lawsuit against Google

After investigating Google for more than a year, the Justice Department has finally issued its antitrust lawsuit against the search giant, alleging that the company is “unlawfully maintaining monopolies in the markets for general search services, search advertising, and general search text advertising in the United States.”

The full suit is here. It cites Section 2 of the Sherman Act — which deals specifically with monopolies — and seeks both to “restrain” Google and to seek remedies for the effects of its conduct so far. Remedies can come in the form of fines, or enforcing a divestment, or enforcing a change in business practices, or all of these.

Signing the 64-page suit alongside the DoJ are 11 states, all with Republican attorneys general: Texas, Arkansas; Florida; Georgia; Indiana; Kentucky; Louisiana; Michigan; Missouri; Montana; and South Carolina.

The case is the most aggressive action the U.S. government has taken in decades against any of the technology companies that now buttress a huge portion of the American economy. The last company that received this level of scrutiny was Microsoft, which began as an investigation in 1992, was filed as a suit in 1997 and finally went into effect (as a settlement) in 2001. Some argue that the government action against Bill Gates’ software giant reshaped the technology industry and set the stage for Google and its peers to flourish.

Now, ironically, it’s Google’s turn in the monopoly hot seat:

“Google is the gateway to the internet and a search advertising behemoth,” said Jeffrey A. Rosen, deputy attorney general in his statement. “Google achieved some success in its early years and no one begrudges that. But as the antitrust complaint filed today explains it has maintained its monopoly power through exclusionary practices that are harmful to competition. So the Justice Department has determined that an antitrust response is necessary to benefit consumers. If the government does not enforce the antitrust laws to enable competition, we could lose the next wave of innovation. If that happens, Americans may never get to see the next Google.” He said that the DoJ plans to continue its review of anti-competitive practices by market-leading online platforms.

Google’s dominant positions in search and search-advertising sit at the foundation of the company’s extensive advertising, data mining, video distribution and information services conglomerate.

It would be the first significant legal challenge that Google has faced from U.S. regulators despite years of investigations into the company’s practices.

A 2012 attempt to bring the company to the courts to answer for anti-competitive practices was ultimately scuttled because regulators at the time weren’t sure they could make the case stick. Since that time, Alphabet’s value has skyrocketed to reach over $1 trillion (as of today’s share price).

Alphabet, Google’s parent company, holds a commanding lead in both search and video. The company dominates the search market — with roughly 90% of the world’s internet searches conducted on its platform — and roughly three quarters of American adults turn to YouTube for video, as The Wall Street Journal reported.

Google later issued a brief statement in response to the DoJ suit:

“Today’s lawsuit by the Department of Justice is deeply flawed,” the company said. “People use Google because they choose to — not because they’re forced to or because they can’t find alternatives.”

In the lawsuit, the Department of Justice will say that Alphabet’s Google subsidiary uses a web of exclusionary business agreements to shut out competitors. The billions of dollars that the search giant collects wind up paying mobile phone companies, carriers and browsers to make the Google search engine a preset default. That blocks competitors from being able to access the kinds of queries and traffic they’d need to refine their own search engine.

It will be those relationships — alongside Google’s insistence that its search engine come pre-loaded (and un-deletable) on phones using the Android operating system and that other search engines specifically not be pre-loaded — that form part of the government’s case, according to Justice Department officials cited by the Journal.

Executives at companies brutalized by Google’s business practices (which are either the hard-nosed, bare-knuckle tactics of a ruthless competitor, or blatantly law-breaking strong-arming from a trillion-dollar bully) are already weighing in.

“We’re pleased the DOJ has taken this key step in holding Google accountable for the ways it has blocked competition, locked people into using its products, and achieved a market position so dominant they refuse to even talk about it out loud,” wrote Gabriel Weinberg, the chief executive of rival search company DuckDuckGo, on Twitter.

Yelp!, a company whose aggressive lobbying on Capitol Hill arguably has done more than any other business to call attention to the ways in which Google’s products exist within a walled, self-promotional garden, also weighed in on the DOJ’s suit.

“By systematically reducing the quality of its search results in order to entrench and extend its search and search advertising monopolies, Google is directly harming consumers,” Yelp wrote in a statement. “Yelp applauds the work of the DOJ and encourages swift action by state attorneys general who are conducting parallel investigations into other aspects of Google’s business.”

The antitrust suit comes on the heels of a number of other regulatory actions involving Google, which is not only the dominant online search provider, but also a leader in online advertising and in mobile technology by way of Android, as well as a strong player in a web of other interconnected services like mapping, online productivity software, cloud computing and more.

Bipartisan but still delivered only in parts

A report last Friday in Politico noted that Democratic attorneys general would not be signing the suit, which is how today’s filing played out, with only a group of Republican attorneys general from 11 states signing the suit with the DoJ.

That report said those AGs have instead been working on a bipartisan, state-led approach covering a wider number of issues beyond search — the idea being also that more suits gives the government potentially a stronger bargaining position against the tech giant.

Indeed, later in the day, New York Attorney General Letitia James and the attorneys general of Colorado, Iowa, Nebraska, North Carolina, Tennessee and Utah made their own statement after the DoJ made its news, saying the two parties would cooperate.

“Over the last year, both the U.S. DOJ and state attorneys general have conducted separate but parallel investigations into Google’s anticompetitive market behavior. We appreciate the strong bipartisan cooperation among the states and the good working relationship with the DOJ on these serious issues,” read the statement. “This is a historic time for both federal and state antitrust authorities, as we work to protect competition and innovation in our technology markets. We plan to conclude parts of our investigation of Google in the coming weeks. If we decide to file a complaint, we would file a motion to consolidate our case with the DOJ’s. We would then litigate the consolidated case cooperatively, much as we did in the Microsoft case.”

“We do have a line of communication open with them and we’ve appreciated the collaboration that we’ve had. And the cooperative relationship that we’ve had with all the states working through the investigation,” said Rosen today. “There have been some states that chose to join this complaint and some states that are choosing to proceed on their own path but not out of a lack of support for what the concerns are.”

A third suit is being put together by the state of Texas, although that has faced its own issues.

While a number of tech leviathans are facing increasing scrutiny from Washington, with the U.S. now just two weeks from Election Day, it’s unlikely that we are going to see many developments around this and other cases before then. And in the case of this specific Google suit, in the event that Trump doesn’t get re-elected, there will also be a larger personnel shift at the DoJ that could also change the profile and timescale of the case.

In any event, fighting these regulatory cases is always a long, drawn-out process. In Europe, Google has faced a series of fines over antitrust violations stretching back several years, including a $2.7 billion fine over Google shopping; a $5 billion fine over Android dominance; and a $1.7 billion fine over search ad brokering. While Google slowly works through appeals, there are also more cases ongoing against the company in Europe and elsewhere.

Google is not the only one catching the attention of Washington. Earlier in October, the House Judiciary Committee released a report of more than 400 pages in which it outlined how tech giants Apple, Amazon, Alphabet (Google’s parent company) and Facebook were abusing their power, covering everything from the areas in which they dominate, through to suggestions for how to fix the situation (including curtailing their acquisitions strategy).

That seemed mainly to be an exercise in laying out the state of things, which could in turn be used to inform further actions, although in itself, unlike the DoJ suit, the House report lacks teeth in terms of enforcement or remedies.

Blow to Recently Reinstated Corrupt EPRA Boss Pavel Oimeke

Kenya’s corruption-ridden public service, EPRA–Energy and Petroleum Regulatory Authority’s recently reinstated boss Pavel Oimeke has suffered yet another bolt from the blue.
Emmanuel Wanjala has filed a notice of appeal against a court ruling which paved way for the re-appointment of corrupt Pavel Oimeke as director-general of EPRA.
In his petition, seen by cnyakundi.com, Emmanuel Wanjala states that he was dissatisfied with Justice Hellen Wasilwa’s decision to dismiss his earlier application against the official for lack of merit.
“Take notice that the petitioner herein being dissatisfied with the judgement and order given by Hon Justice Hellen Wasilwa, intends to appeal to the Court of Appeal against the whole of the said judgment and order thereof,” the petitioner said.
In August, Pavel Oimeke, who has been in office since 2017, was eligible for a second term but Emmanuel Wanjala rushed to court, arguing that the renewal should not be automatic but it should be subject to competitive and procedural requirements.
Justice Hellen Wasilwa on August 12 temporarily stopped the EPRA board and the Energy and that of Petroleum and Mining Cabinet secretaries from deliberating the renewal of Mr Oimeke’s tenure, which ended on August 1.
However, in her last months ruling, Justice Wasilwa threw the petitioner under the bus when she said the petition had been overtaken by events since EPRA board had already renewed the director-general’s term for three years. She noted that Mr Oimeke applied to be reappointed as CEO in January. The application was considered in March and accepted in May, three months to the expiry of Mr Oimeke’s term.
In the circumstances, I found that the application did not have merit and therefore I dismissed it and ordered that the status quo of the first respondent be reinstated immediately as the DG. I had stayed that position because I thought that he had not been appointed, but he has been appointed and rightly so. And therefore he is rein,” Justice Wasilwa ruled.
Justice Wasilwa also dismissed a prayer for the court to compel Ethics and Anti-Corruption Commission to investigate alleged claims of loss of funds, saying the anti-graft agency is an independent body, which cannot be compelled to act.

Last week, we managed to nab Pavel Oimeke boasting on Facebook how he has ties with State House and Interior Cabinet Secretary Fred Matiang’i.‘Soon and very soon am returning to office @EPRA Kenya courtesy of #HE President Uhuru Kenyans, Hon. CS @Dr. FRED Matiangl and my CS Hon @Charles Keter what will my distractors say?’, he wrote on Facebook.

Though the post has since been deleted, netizens had already screenshotted it and shared it with our investigative team that is following the case closely.

Oimeke who has been at the helm of the energy regulator for 3 years has been mentioned in countless corruption and mismanagement scandals.

Mr Oimeke’s tenure has been marked by corruption, nepotism, favouritism and lacklustre leadership in executing the mandate of EPRA.

1. Illegal LPG Plants

Pavel Oimeke is alleged to receive bribed to license illegal LPG filling plants. He then engages in PR stunts and side-shows aimed at misleading Kenyans. He was supposed to be arrested during the #SwitchOffKPLC campaign but it is said he managed to bribed detectives to walk a free man, despite being a criminal linked to the rot in the energy sector. The #SwitchOffKPLC campaign has exposed the rot in the energy sector and particularly EPRA.

2. Recruitment scandal

“The rot at ERC is appalling and most employees are staying there to just earn a salary. The man has turned the Commission upside down in less than two years since his appointment”, wrote a staff of EPRA, then Energy Regulatory Commission (ERC). The anonymous source further said, ‘Out of 10 employees, 8 of them are from his village. They have zero skills and tribalism reigns supreme’.

3. Procurement/Corruption

DPP needs to move in to unearth the irregular award of tenders at ERC. He terminates procurement contracts anyhow without valid reasons if you’re not cooperating. Also, substandard goods are accepted upon his coercion of employees to sign for them. It is believed that these companies are either his/his operatives.

In Oimeke’s time, he has engaged in useless regulation of fuel/gas prices which does not make sense or serve the purpose to alleviate the suffering of Kenyans.

He has overseen Energy Injustice which has left the sector more corrupt than when EPRA did not exist. This has led to some quarters calling for the disbandment of the Commission. Oimeke also opened a lot of lawsuits against the commission due to his ‘eating ways’

Ex-PS Lilian Omollo to get one shilling for unfair dismissal

Judge Stephen Radido of the Labour Court has ruled that the dismissal of former Youth and Gender Principal Secretary Lilian Omollo was unlawful.

The judge said that Ms Omollo’s rights were breached as he ordered the state to pay her one shilling.

“The petitioner was not subjected to due process, nor was she given reasons for the removal from office under the hand of the President. She was ingeniously notified that her tenure had ended because a replacement had been appointed,” Justice Radido said.

The judge further outlined that civil servants have a legitimate expectation that being public officers, due process as envisaged under Article 236 of the Constitution would be observed in the process of their removal from office.

But Radido said that because Ms Omollo is currently facing graft charges over unexplained wealth, the amount awarded (one shilling) was a fair compensation for the violation of her rights.

Ms Omollo has challenged the decision of the High Court which found that the more than Sh33 million she held in various accounts. The court established that the they were proceeds of crime.

She was charged over the Sh9 billion NYS corruption scandal in 2018 when it was also found out that she was married two different men.

Lilian had married Omollo, whose name she retained even after dumping him for one Dick Oruko Oneko, son of Shujaa Ramogi Achieng’ Oneko.

She remained a controversial figure around power circles to working as a top government official where she was wrongfully dismissed and given one shilling in compensations.

The kind of trivial compensation the court awarded the Ex-PS is referred to as nominal awards.

They are awarded in cases where judges find that litigants have succeeded but have not suffered any loss. They’re common in places like Britain where where judges can award litigants as little as a penny.

Raila warns ‘hustlers’ to keep off Nyanza

Opposition leader Raila Odinga has called on the people of Nyanza to back the Building Bridges Initiative (BBI) report even before reading it as he warned ‘betrayers’ to keep off the region.

ODM Party leader hosted President Uhuru Kenyatta in a BBI rally in Kisumu where he cautioned the residents from visiting Deputy President William Ruto’s home for goodies and handouts.

He also directed the county assemblies in the larger Nyanza region to pass the BBI Bill once it is presented before them.

Raila and President Kenyatta recieved the BBI report in Kisii. two days ago.

“We want when the Bill comes to our assemblies, we pass it immediately so that Nyanza leads in this,” said Raila.

The former Prime Minister did not miss to hit at growing Ruto allies in the region whom he accused of falling prey to free gifts to support a diversionary political course.

Raila believes Nyanza region is his turf but Ruto has been making inroads in Migori, Nyamira and Kisii regions with through a series of visits and fundraisers.

His visit to his Kisumu backyard is a move aimed at rallying the region to support BBI and avoid any opposition when the anticipated referendum is held.

“We don’t want to see delegations from Nyanza trooping to Sugoi for freebies. We have started a serious movement that we don’t want detractors or betrayers,” Raila said.

DP William Ruto has been hosting delegations in his Sugoi home and Karen residence where he gives token to ‘hustlers’ or emerging businessmen.

Raila tore into Ruto’s politics of tokenism saying it cannot uplift the socio-economic status of ordinary Kenyans.

He is working hard to undo the narrative of hustlers propagated by the DP that is fast sinking in the minds of Kenyans.

Raila claimed that his handshake with President Uhuru Kenyatta has delivered a BBI report that will fix the economy of Kenya and figure ways to empower Kenyan youths and to create employment.

Punwani residents shout down president Uhuru over NMS defense

Residents of Pumwani, Nairobi have shouted down President Uhuru Kenyatta after he attempted to defend Nairobi Metropolitan Services (NMS) boss Major General Mohammed Badi.

President Uhuru who was addressing a roadside rally was met by shouts of Sonko as he denied snatching Sonko functions under the Deed of transfer deal.

“We have not taken away anyone’s work. We just want you to support General (Badi) to work,” Uhuru spoke amid shouts of Sonko Sonko.

The President had early addressed Bodaboda operators at Pumwani Social Hall where he asked them to reject politicians who are bribing them with handouts for selfish gains.

The incident comes even as Sonko and Badi’s rivalry escalates on the performance of functions and allocation of funds.

Last week, Sonko appeared to be winning in the war after Treasury declined to disperse monies to the NMS to pay salaries for seconded staff saying the law only recognises an account held by Nairobi City County government and not NCC.

Treasury CS Ukur Yattan in a letter to Major General Badi said that the there is no legal framework or arrangement for dispersing the cash to NMS.

In other news, Sonko extended a waiver to tenants who occupy city county houses for a further six months while working NMS and KRA to stop harassing those who have not paid rent.

Sonko has extended the waiver on rent payable to the Nairobi City County for another six months to cushion the city residents from the negative economic impact.

The city boss on Friday said Kenya has not been spared from the negative social and economic impact of the Covid-19 pandemic and Nairobi has been the epicenter of the disease in the country.

In a letter to the County Secretary and Head County Public Services Justus Kathenge on Friday, the Governor said

His attention has been drawn to the outcry of the majority of the county tenants.

The residents are complaining of persistent harassment by officers from Kenya Revenue Authority and the Nairobi Metropolitan Services (NMS) over arrears.

“Nairobi City County is not a profit-making organization, but rather established by the Constitution of Kenya to serve the public.

“Therefore, I do hereby extend the waiver granted for a period of a further six months as our residents continue to recover economically from the effects of Covid-19 pandemic,” directed Sonko.

John Momanyi, 60, a resident of Jamhuri Estate said they have been harassed for quite some time and Sonko’s intervention came at the right moment.

“We have been having sleepless nights for being harassed by the officials from KRA and NMS. Our calls for help are not being answered and that is why we have asked the governor to step in,” he said.

Mercy Njoki, a grandmother at High Rise Estate said that they would be happy if the governor waived the rent arrears to give them ample time.

“We have been affected so much by this coronavirus and all we need is support from the governor during these hard times,” she said.

Njoki is a businesswoman in the estate.

She went for the kiss in full glare of the public. Clients were still waiting to use the ATM but that didn’t deter them.

Clients of KCB Bank Group were treated to a rare spectacle after two couples started making out inside the bank’s ATM Lobby at Garden City Mall this evening.

They duo started kissing while other clients were quede outside waiting to use the ATM service.

‘It was rude and shocking’, said a client who sent us these pictures.

They continued raising each other temperature up, rudely interrupting other clients.

‘Imagine people waiting on the queue when some people are having fun in the kcb Atm lobby”, she continued.

Lost generation

This is a lost generation where youths are so empty that they desperately go for public display of affection so as to fill the void inside. That emptiness cannot be filled this way.

The malayas on radio and TV have raised this generation this way. Lying to them about sex and relationships. Lying to them that posting highly edited photos on Instagram is cool.

Nothing great can come from aping the western culture because white people are the emptiest human beings one can ever find in the history of mankind.

Youths must be guided.

An elderly person should’ve whipped these two to proper ways.
