Stanbic Bank looses Sh1.4 billion to a Chinese Development Company

There is mischief in the manner in which Stanbic bank suffered a Sh1.4 billion loss in a contract involving Geothermal Development Company (GDC) and a Chinese company known as Hong Kong Offshore Oil Services Limited.

The Chinese firm was contracted in November 2014 to drill 15-20 geothermal wells in Bogorua-Silali in Baringo. However, not a single well had been drilled by the time the tender was cancelled this year.

According to the reports, the tender was advertised in 2014 and the Chinese firm handed the award notification on 10 November the same year.

According to a report by GDC General Manager George Muya, the Chinese company wrote to GDC requesting an advance payment for the project just two months after signing the contract. As if that was not enough, the firm further requested to be allowed a guarantee not from a bank but from an insurance company which they were denied and GDC was forced to write to the Chinese firm in October 2016 asking them to submit the payment guarantee within 30 days.

“HOOSL responded to this letter on October 8, 2016, by informing GDC that they are working on the issuance of the guarantee with a local bank,” reads the report.

“On October 20, 2016, HOOSL sought an extension of the timeline for submission of the guarantee by an additional 60 days, the report says.

“The geothermal company accepted the extension which was to lapse in December 2016. However, a few days to the deadline, the Chinese firm asked for another extension by two months, which was accepted.”

Still, when the two months were up in February, the firm had not issued a guarantee. The firm would later submit an advance payment guarantee of Sh1.4 billion from Stanbic bank. The guarantee was to expire in December 2018.

“When Stanbic confirmed the guarantee, the payment process through the Energy and National Treasury began and the Chinese firm confirmed receipt of the money in September 2017. However, by December 2018, their payment guarantees had expired and drilling machines in Baringo had remained unused”, reads the report.

In the report issued on Wednesday last week by GDC CEO Johnson Nchoe, the geothermal company will proceed with its own drilling operations even after the Chinese company had received sh1.5 billion that makes 25% advance of the contract sum.

“We will proceed with our own drilling operations. Already there is one rig at the site and we have completed drilling of the two wells. The recovery of the funds will boost our operations in the region,” the statement by GDC CEO Johnson Nchoe read in part.

He further confirmed that the Geothermal Development Company has recovered Sh1.4 billion awarded to a Chinese contractor for drilling at the Baringo-Silali project. He clarified that Stanbic Bank, the guarantor, was compelled to refund the cash after Hong Kong Offshore Oil Services Limited failed to do the job.

“Stanbic bank had provided the Advance Payment Guarantee for Hong Kong Offshore Oil Services Limited in favour of GDC,” read a statement from GDC.

Insiders say, former national oil acting CEO Mary Mwangi together with her GDC counterpart Johnson Nchoe are fully aware of what transpired with the said Chinese company. That this might have led to the replacement of Mary Mwangi from acting capacity as George Kubai took over.

“In most cases the offshore Chinese company is locally owned by Kenyans fronted as Chinese.” Said a source.

If you look at how this company operated between 2014 to date, you don’t need a rocket science to tell that it’s a typical Kenyan owned company. It’s these Kenyan owned companies that ask for advanced payment. This is what transpired in the Ksh4.9 billion tender awarded to Seven Seas Technologies to connect all medical facilities above Level 4 hospital across the country with The Kenyatta National Hospital (KNH) “to help track patients seeking specialised treatment.” And not a single medical facility was connected by the time the tender was cancelled by the ministry three years later.

The management at Stanbic Bank, the GDC board and CEO Johnson Nchoe, and former national oil acting CEO Mary Mwangi should come clear on this and tell Kenyans where the sh100 millon and the interest gained from the sh1.5billion went to since the company had not done any drilling two years later. And why did they not recover all the sh1.5bilion and interest?

Hey Cyprian Nyakundi,

I wish that you may highlight this toxic work environment.

Imagine a world of 2 sets of human beings.

This is the story of Kulan Cuisine a Somali restaurant in Nairobi.

I have been a customer of Kulan Cuisine for a short while now. This started when a friend got a position and prompted me to dine there.

The Somali owner restaurant employs Kenyans who are subtly discriminated. Small things in the work place are key for a good working environment.

My friend narrated of how this silent discrimination happens.

My friend who left employment there recently stated the below in 21 points:

  1. Somali employees are treated differently from the other Kenyans.
  2. Somali employees are bosses in their own right, they are in charge of every dept and a Somali must be present for anything to take place.
  3. This is not so wrong if merit and experience were the criteria but not so.
  4. A certified chef in the kitchen has to take instructions from Somali employees most who have no qualifications in culinary and some very little post-primary education. In short, a certified cook takes instructions from any Somali be it the cashier, store keeper or the kitchen supervisor all who are not chefs by any standard.
  5. This is very unprofessional and a huge demotivator to serious professional.
  6. Imagine having to follow an order from some whose rank is granted by ethnicity.
  7. The waiters are in the same dilemma and so are the rest of Kenyan staff.
  8. There is no disciplinary action against Somali misconduct.
  9. They are frequently late and maybe abusive and aggressive towards other staff.
  10. They have been cases of Kenyans facing abusive language and no action is taken.
  11. Kenyans often resign due to frustration and abusive language.
  12. The staff are employed on contract and thus dismissal is in the spot. The fight is your wits against the word of a Somali. As such the Kenyans fear the Somalis as they want to keep there Job.
  13. There has been a case of a Somali staff hurling a knife as he didn’t like how he was served by fellow staff. This is how abbrasive things can be at Kulan.
  14. The employer has no concern for staff welfare and consistently delays salary causing fights with landlords and caretakers. Pleas are not heeded
  15. The owners also have a white friend by the name Nick who is known to be abusive to staff and smokes in the premises, causing discomfort to the staff
  16. The Kenyan staff are provided for a meal of ugali, sukuma for lunch and tea and bread.
  17. The Somali can, however, enjoy any meal from the menu at any time for free, this is another case of subtle discrimination. The staff can’t even have water from a glass, just tap water is allowed using plastic cups.
  18. There NHIF and NSSF often go unpaid despite it being deducted and essential for healthcare. Lea is most likely not remitted (not sure).
  19. This is just a snippet of what my friend who recently left narrated to me. More could be happening and I hope authorities investigate.
  20. If you visit you will clearly see what I talk about, demotivated people in a toxic environment.

Caution: KeRRA Issues Warning On Murang’a County Roads

This afternoon, the Kenya Rural Roads Authority (KeRRA) issued a warning that some section of roads in Murang’a County that have been destroyed by landslides.

‘KeRRA would like to issue an alert to motorists; that in addition to having closed a section between Gatakaini to Karangi earlier due to several land slides, the same effect has continued along Wanyaga to Kimotho road towards makomboki in Gatanga and Kigumo constituencies’, a statement on their Twitter account said

The roads body said their officers are currently on site monitoring the situation and urge motorists to be cautious.

‘Our officers in Muranga County are currently on site monitoring the situation with a view to remedy the affected section, motorists are requested to be extra cautious as they approach this section’

Governor Patrick Khaemba of Trans Nzoia County has presided the looting of the county. Nepotism, tribalism, and conflict of interest are rife.

A few months ago, a couple of bodaboda riders and some activists reached out to cnyakundi.com to protest the harassment of transporters and motorists in the county.

The name of the first lady Lydia Khaemba (one of the many wives of Gov. Khaemba) featured prominently. She was mentioned as the head of a criminal extortionist who are out to arrest motorists and riders at the slightest of chance and charge them exorbitantly for release.

The riders say that whenever they’re arrested the rogue gang led by someone by name Ombima charges them between Ksh20k and 30k fine, and that there is no limit to or on how much one should pay.

The Kitale Bus Park which was undergoing construction, set to be opened, in January 2020, is said to have been allocated to a few individuals who will control it the way Mungiki have controlled Nairobi (read it in the statement below)

To avoid future harassment, Boda boda riders need a space in the ongoing building of bus terminus since they were asked to pay a sum of Ksh3k per stage in the whole of Trans Nzoia county. It remains to be seen if the county will honor their pledge. There are more than 6000 motorbike stages.

The riders protested last month over these mistreatment and more.

Why Uhuru Is Guilty Of Corruption – Miguna

While the media and Kenyans online paint one man Deputy President William Ruto as the most corrupt, they always escape to give his boss President Uhuru Kenyatta and maybe by extension opposition chief Raila Odinga the same condemnation.

While Raila and maybe the Odinga family hasn’t stolen the same way the other two have, it is quite sinister to expect Ruto to be more corrupt than Uhuru and the whole Kenyatta clan.

If course the whole Kenyan political elites are guilty of economic sabotage, however, above them at the top stands a few families namely Kenyattas, Mois, Odingas and the latest entrant Rutos.

It is against this backdrop that the exiled lawyer and Kenya Revolutionary Front founder Miguna Miguna stated that for the billion that have been stolen in tenders to be released, the President who is currently Uhuru Kenyatta must approve.

All Government contracts and payments of Sh 1 billion or more are DIRECTLY APPROVED by Despot Uhuru Kenyatta. He approved all the trillions of shillings looted so far. He directly AUTHORIZED the 2017 election frauds and the mass murders that followed. – Miguna wrote.

The hold on money and power is sweet, however, what the elites and owners of capital don’t seem to be aware of is, as Kenya sinks deeper into a society that is anything else other than economic and political inclusive, the masses are watching and they’ll be soon letrer than later be eaten.

Because, “When the people shall have nothing more to eat, they’ll eat the rich”.

The Kenyan body politics stinks, you have people on one hand with high aspirations, working hard and on the other hand we have people who want to compete on who has the fattest bank account stashed with stolen money.

Our leaders (Legislature), our bosses (Ruto), our masters (Odinga), our Landlords (Kenyatta) are very stingy, grumpy, and inhumane to us, so we shall eat them.

It is the government that is supposed to ensure that your children are in affordable and well-teaching schools.

It is the government that is supposed to ensure that there’s security wherever you live.

Why We Named Leadership Institute After Kenya’s Deputy President, Makerere University Explains

Makerere University responded to critics saying Ruto just like any African leader should be commended for such act instead of being condemned.

Uganda’s Makerere University has come out defending it’s decision to name a leadership institute after Deputy President William Ruto.

The university had on Saturday, December 21, named the yet-to-be constructed institute after Ruto, a move that was questioned by scholars and observers alike.

Top in the list of those who took issue with the naming of the institute included US-based Kenyan lawayer Makau Mutua and former presidential aspirant Abduba Dida.

The duo opined that naming the institution after Ruto was an abominable act that could potentially water down achievements of the East Africa’s oldest university.

“A William Ruto Leadership Institute Makerere University is the most absurd and utterly inconceivable blunder in the history of higher education in Africa. Today Makerere University is the laughing stock of the world. I expect students, faculty and staff to quickly erase this abomination. Now,” noted Mutua in a Twitter post.

According to Mutua, the fact that no other Kenyan university had named its institutes after Ruto was enough reason to cast doubt on the credibility of the DP.

In a rejoinder, the university clarified the institute was not an academic award as Mutua seemed to insinuate, but a rare initiative by a political leader to support African indigenous scholarship.

“William Ruto’s initiative should be commended by all patriotic African elites and not condemned out of apparent misconception. Makerere awaits the implementation of yet another initiative by another great Kenyan leader, Mwai Kibaki, which he launched four years ago,” said Makerere University in a Twitter post.

Ruto presided over the groundbreaking ceremony during which he thanked the institution for its kind gesture despite having never visited the university before.

The university’s vice chancellor Barnabas Nawangwe explained the core business of the new centre will be to research into political and social-economic challenges and also train visionary leaders for Africa.

It is also hoped the new institute will draw on the core strengths of diversity of disciplines and experience to develop and refine methodologies for the study of Africa.

50K Fine For Selling Receiptless Cooking Gas: Understanding The New Tough LPG Rules That Take Effect Tomorrow

Penalties for illegal gas refilling have been increased more than tenfold to a minimum of Sh10 million in the fresh drive for safety and to protect oil dealers.

Selling cooking gas without a receipt will from tomorrow attract a fine of Ksh. 50, 000 as the grace period for implementation of tough regulations aimed at curbing illegal trading in Liquefied Petroleum Gas (LPG) lapses.

The receipt will have to include the name and telephone number of the seller, contacts of the consumer, cylinder brand, date of sale as well as serial numbers of the seal and gas container.

The new rules are aimed at tracking the cylinder from the retailer to homes, with the records expected to be stored for at least one year.

The fresh regulations, which received parliamentary approval mid this year, will also demand that oil marketers provide an insurance cover for each cylinder for compensation in case of accidents.

Penalties for illegal gas refilling have been increased more than tenfold to a minimum of Ksh. 10 million in the fresh drive for safety and to protect oil dealers.

This is an upgrade of the 2009 rules that provided a penalty of not more than Sh1 million or jail term of less than one year.

The rules also provide for a Ksh. 10 million fine for those discharging bulk gas in a location that lacks regulatory approval.

The tough regulations were published in the Kenya Gazette in June and offered dealers a six-month transition period during which authorities were restricted from making arrests on the basis of the new rules.

The regulator — Energy and Petroleum Regulatory Authority (EPRA) — says a new enforcement unit has been established to crack down on offenders.

“EPRA has an established Directorate of Enforcement and Consumer Protection that is represented in five regional offices in Nairobi, Mombasa, Kisumu, Nyeri and Eldoret to enforce the regulations,” EPRA Director-General Pavel Oimeke told the Business Daily in an interview.

“The directorate will work with the National Police Service as well as the Anti-Counterfeit Agency (ACA) to ensure that only legitimately filled LPG cylinders are being sold at retail level,” he added.

Besides the penalties, Mr Oimeke stated that traders who fail to issue receipts will also face suspension of their operating licences.

The proposed regulations have attached different fines for the breaches including a fine of more than Ksh. 1 million for selling gas without permits or transporting the commodity in a vehicle not approved by the energy regulator.

The new rules also cap the number of cylinders that can be transported in a car to three unless regulatory exemptions are issued in a fresh attempt to curb those dealing in illegal refills and selling the commodity at a discount of up to 25 percent.

Marketers will be expected to be in a position to track cylinders by use of Radio Frequency Identification or quick response code or any other appropriate technology under the tightened regulations.

The dealers will also be required to maintain a list of its authorised filling agents, wholesalers, retailers and cylinder requalification agents, serial numbers or quick response codes and date of requalification for each cylinder.

Wholesalers who fail to keep gas cylinder records for more than year will face a fine of Ksh 50,000 for each offence.

The records must include the serial number of each cylinder, date of purchase, weight of each cylinder and name of retailer buying the cylinders.

EPRA says it has hired a private compliance inspector to monitor retailers who will breach the regulations.

Illegal possession of LPG seals without the cylinder brand owner’s authority will see those caught fork out Ksh. 20,000 for each seal.

Independent gas dealers lobby–Energy Dealers Association (EDA)—has sought for another six months extension for implementation of the regulations, arguing that only 10 percent of their members are ready to operate under the new tough rules.

“We are asking for an extension of six months because even some multinational petrol stations are not licensed. We do not know if we will be allowed to operate and how they will enforce the regulations if they claim we are operating illegally,” said Peter Macharia, EDA chairman.

The stepping up of the fight against illegal LPG dealers comes in a period when gas prices are trading at levels last seen in 2016 before the government removed value-added tax (VAT) on the clean fuel.

The cost of refilling a 13-kg gas cylinder at petrol stations has increased to about Ksh. 2,200.

Prices stood at an average Ksh. 2,231 in June 2016 and dropped to below Sh2,000 in October, four months after the scrapping of the 16 percent VAT.

The Treasury scrapped the tax on gas to cut costs and boost uptake among poor households that rely on dirty kerosene and charcoal for cooking.

Rising prices have egged on illegal dealers who offer a discount.

Angolan Court Freezes Bank Accounts of Former Dictator’s Daughter Over Billion Dollar Corruption Scandal

An Angolan court, acting in a graft investigation, has frozen bank accounts held by Isabel dos Santos, the daughter of former president Jose Eduardo dos Santos, the public prosecutor said.

Dos Santos, who has been nicknamed Africa’s wealthiest woman, is being investigated with her husband Sindika Dokolo in a corruption affair involving more than a billion dollars (euros), it said in a statement issued late Monday.

The probe is looking at alleged irregularities involving state companies, including the oil giant Sonangol which Isabel dos Santos used to run, and a diamond-marketing firm, Sodiam.

A tribunal in the capital Luanda, in a decision issued on December 23, ordered bank accounts held by the couple to be frozen.

Their holdings in several Angolan companies, including the telecoms firm Unitel and cement company Cimangola, have also been frozen, the statement said.

The court’s decision also applies to a Portuguese businessman, Mario da Silva.

In a tweet, Isabel dos Santos, 46, said she sent “a message of tranquility and confidence to my teams.”

“We will continue, every day, in every business, doing our best and fighting for what I believe in for Angola. The road is long, the truth will prevail. United we stand strong,” she said.

She was appointed head of Sonangol in 2016 but was forced out the following year, in one of the first major acts undertaken by her father’s successor, Joao Lourenco.

She has since left Angola – like most members of the Dos Santos family – because she claims she has faced death threats.

Jose Eduardo dos Santos ruled Angola for 38 years – a time widely associated with corruption and nepotism.

His family accuses Lourenco’s government of persecution.

The former president’s son, Jose Filomeno dos Santos, 41, who is Isabel dos Santos’s half-brother, went on trial in early December for alleged corruption.

He is accused of embezzling as much as $1.5 billion from Angola’s sovereign wealth fund during his 2013-2018 stewardship.

Despite extensive oil, gas and mineral reserves, the majority of Angolans live in poverty and continue to rely on subsistence agriculture

Lamu Attack Latest: Several Civilians Killed As Al-Shabaab Militants Hijack Commuter Bus

On Thursday Afternoon, suspected Al-Shabaab militants attacked a Lamu bound bus at Nyongoro area within Lamu County.

Immediately the reports went live, Lamu County Commissioner Irungu Macharia confirmed the bus came from Mombasa and was headed to Lamu.

There were no details on casualties or injuries by press time.

“I have heard of such an incident but I am headed to the scene… I am also liaising with officers on the ground. Details on injuries, casualties or the bus company are yet to be established but I’ll give details soonest,” Mr Macharia told journalists.

It is now common knowledge for those who care to read that Nairobi County Government Public Health Department has not been supervising hotels for over a year now as required by law.

This has led to many people falling ill especially through H-Pylori, amoeba and other stomach diseases.

One such person who has falling ill due to this careless omission is the daughter to Nyali MP Mohamed Ali. The MP today took to Social media to call out America-headquartered KFC restaurant Hurlingham Branch.

Option of suing

One can sue a restaurant that has sold them food that has caused them to become ill.

What is food poisoning?

Food poisoning is an illness caused by food contaminated with bacteria, viruses, parasites or toxins.

It usually manifests itself with painful stomach, weak joints, tingling and pain, feeling hot and sweaty.

It is not the best feeling and at worst it can lead to death.

Ideally, restaurants are supposed to be certified by health officials to be clean and workers able to properly handle foodstuffs.

However, in the case of Nairobi, it was revealed that City Hall hasn’t evaluated food handlers for over a year.

Question is, how can one go about suing a restaurant for food poisoning?

Realistically, it can be difficult to prove that food from a particular restaurant caused food poisoning. It becomes harder if a lot of time has passed from the time you had the meal to the time you are taken ill because of causation

Junk food is mostly not good

However, digestion takes three hours and if one is observant enough they can note when the symptoms start would be a good place to begin.

Another way to get ahead of the situation is by being diligent enough to have kept leftovers of the food, which will be the evidence presented in court after testing that the food was indeed contaminated.

However, there’s still a problem in the above.

The restaurant can claim in court that it is you who contaminated their food after it left the premises.

However, you have a better shot at a successful suit if you’re not the only one who was affected or if you’re lucky in some cases, a product recall or a health agency warning may be issued greatly favouring your claim.

In this case, a class action suit – which is a suit instituted by many people affected by the same issue and arising from a similar set of facts or a similar series of events.

A lawyer advises that one can sue under the tort, specifically the tort of negligence.

You would need to prove three key ingredients: that you were owed a duty of care; that the duty of care was breached, and that as a result, you suffered harm or injury.

There was a case in United Kingdom (UK) in 1932 of Donoghue Versus Stevenson. In this case, the plaintiff, Mrs Donoghue, found a snail in an opaque bottle of ginger ale beer after she had drunk half the content.

Judge Atkin, who ruled in her favour, set a precedent in law-making the moral rule “love your neighbour…” into law.

Further, he settled the question of who a neighbour is in law, a person closely and directly affected by your actions enough to be affected by your acts or omissions.

Apart from the existence of a duty of care owed to you, the burden lies with you after claiming to be poisoned to further prove that the food eaten was contaminated and that that contamination caused your illness.

Has anyone ever succeeded in a food poisoning case in Kenya though?

“In Kenya, the hallmark case on poisoning is Kenya Breweries Limited versus Godfrey Odoyo (2005). In this case, Mr Odoyo fell sick after consuming two of the three Tusker Malt Lager beer he had bought at a local bar in Mathare. He was successful and awarded Sh70,000 in general damages and Sh21,990 for pain and suffering”.

Liability

“In a food poisoning claim, all parties involved in the chain of distribution can be held liable,”

This includes manufacturers, retailers, the local authorities and all other stakeholders involved.

According to the lawyer, a restaurant owes you a duty to deliver well-cooked food handled under hygienic conditions.

Your local supermarket owes you a duty to reasonably ensure consumable products they sell are safe for consumption.

You then write email to yourself and cheat your spouse that you have a meeting in Mombasa, Nairobi, Eldoret, anywhere. Meanwhile, the woman updates her husband and his gang as to your whereabouts. They arrive and book near you or same hotel. She keeps the husband updated via text when you are removing your trousers. She removes hers too. You then embark on reclaiming your money, eaten over several months. Just when you get cozy, the husband and his gang pounces.

You are busted. Photos and videos are taken of you stark naked with somebody’s wife. They threaten to kill you or expose you in these streets. You negotiate a ransom. And it is heavy. To protect your reputation, your family, your status.

Prostitution has become so expensive and cartels have become so bold. Only the poor will eat or survive. Because cartels know they have no ransom to pay.

Stay alert, control your sexual desires or think without the box. To scatter the cartels.

The year 2020 will be tough as Kenyans seek to see pending corruption cases prosecuted by the office of the Director Of Public Prosecutions Noordin Haji.

The report was later shot down in the House after senators failed to garner the requisite numbers to adopt it.

The acquisition of the 13.7-acre parcel for two public schools, Ruaraka High and Drive Inn primary, was executed during Matiang’i’s tenure as Education CS and Belio as his Principal Secretary.

According to sources that are close to Ken Mijungu, the Somali boyfriend threatened to kill the journalist after he came out to defend Dennis Okari after Betty portrayed him as a deadbeat father.

Ken Mijungu has reported the threats on his life to the Central Police Station who have termed the incident very serious and worrying.

A detective that spoke to CNYAKUNDI.COM confirmed to us that the journalist had indeed reported the threats and they had sought to summon the fella and hoped that he would honour the summons.

Dennis Okari divorced Betty Kyalo after discovering that she was very promiscuous.

Using her soft voice and good looks, Kyalo was able to mesmerise Kenyans into falling for her script of Miss Goody Two-Shoes, yet she has been a psychopath with hoe-riffic tendencies from the onset.

The police will seek to connect the dots and confirm whether it is a coordinated effort by Betty and the boyfriend to kill the journalists. According to the police source, Betty may also be invited to record a statement.

Detectives Confiscate Betty Kyalo’s Phone In Death Threats Probe

Detectives investigating circumstances under which death threats were issued to Journalists Dennis Okari and Ken Mijungu have confiscated a phone belonging to Betty Kyalo, a police source has confirmed to the editor of this website. 

The police source further revealed to us that they have keenly listened to an audio recording of the Somali fella, only going by the name Nassir, threatening Journalist Ken Mijungu. 

Nassir had allegedly used Betty Kyalo’s phone to threaten Ken Mijungu, a genius move that exposes Betty Kyalo’s dumbness and ill motive by allowing her phone to be used in a wrong way. 

Today, Betty and Nassir appeared before DCI detectives after they were summoned on 31st December but requested to appear today. 

They recorded statements, we can confirm. 

Detectives are also trying to piece up information on why the Nassir sent a threatening message to Dennis Okari with his UK line, even though he doesnt converse with him. According to a police source, it looks like Betty pushed Nassir to threaten Okari too. 

Efforts to reach Okari have been fruitless as we learnt he is not interested in the matter as Betty is trying to bait him to talk about the child yet he was gagged by court. 

Betty  sued Okari for child support at Milimani Children’s Court in 2018.

How Qasem Soleimani Killing Could Affect Kenya

Kenya and other US allies could face further security threats from terrorist groups following the killing of a top Iranian military commander on Friday, experts warned in the aftermath.

On Friday, the US military headquarters, Pentagon, confirmed Iran’s Lt-Gen Qasem Soleimani had been killed at an Iraqi airport on orders of President Donald Trump.

And Mike Pompeo, the US Secretary of State embarked on a series of calls to his counterparts in ally nations across the world, arguing the action was part of Washington’s efforts to curtail Iran’s “aggressive threats” done through the Iranian Quds Force that Gen Soleimani commanded.

“[The US is] thankful that our allies recognise the continuing aggressive threats posed by the Iranian Quds Force. The US remains committed to de-escalation,” Pompeo said.

DEATHS

But what would allies face in the aftermath? Some observers said Soleimani’s killing could avenge for his murders in Iraq and Syria, but it left open the debate on who else should be punished.

“You live by the gun, you die by the gun. Soleimani, with the help of Bashar Assad, Hezbollah, Houthis and Iraqi Shia militias, killed at least one million Iraqi, Syrian and Yemeni Sunnis,” argued Farah Maalim, a former Deputy Speaker of Parliament, referring to the Middle East wars in which Iran assigned proxies.

But Maalim argued that other leaders in Saudi Arabia, a US ally, had equally killed civilians and ought to pay for it.

OIL PRICES

A report by the International Crisis Group on Wednesday warned of bigger consequences for the world as Iran and the US bickered inside Iraq.

One immediate consequence on of the attack was the slight increase in oil prices, even though economists said it was unclear if they would continue to rise.

Kenya, being an oil importer, could be prepared to pay more for fuel in the coming weeks.

“For Kenya, my view is that global oil prices will likely rise and this will affect our oil imports bill and economic growth,” Dr Kemoli Sagala, a research scholar on governance and strategy at the University of Nairobi told the Nation.

“There is always the prospect of proxy retaliations on US interests in the region and the conflation of Israel and America. Kenya has been a soft target in the past … but it is too early to tell,” he added.

TERROR ATTACKS

Experts said the actual threat on US allies could be the rising possibility of terror attacks, either in revenge against US interests or from groups benefiting from US’ distraction.

Dr Richard Haass, President of the Council on Foreign Relations, a US think-tank on foreign policy, said the world should be prepared for an Iranian response, especially on the US or anywhere it has interests.

“We’d better be prepared for all sorts of Iranian retaliation against US diplomatic and military personnel around the region or world, given his symbolic and actual role. Make no mistake: any war with Iran will not look like the 1990 Gulf war or the 2003 Iraq wars. It will be fought throughout the region with a wide range of tools against a wide range of civilian, economic, and military targets. The region (and possibly the world) will be the battlefield.”

GENERAL’S PROFILE

Soleimani was top commander in Iran’s Islamic Revolutionary Guards, formed after the revolution in 1979 to ‘protect Iran’s Islamic political system.’

As the leader of the Quds Force for the last 22 years, the celebrated soldier served as the head of Iran’s equivalent of the CIA, leading Iran’s military strategy in the region and across the world.

His main duty, a CIA report indicated, was to counter Iran’s enemies abroad, which included targeting US interests or those of their allies.

Kenya, Lebanon, Syria, Germany Israel and Bahrain were some of the countries he focused on.

NAIROBI’S ROLE

Nairobi, one of Washington’s allies in The War on Terror, hosts the biggest diplomatic mission on African soil and routinely collaborates with the US on counter-terrorism measures.

Since 1998, Kenya was targeted by terror groups opposed to the US or Israel.

At the moment, Iranians do not have an ambassador in Nairobi. Former envoy, Dr Hadi Farajvand, left the country in 2019 under a cloud of controversy for trying to free Iranian terror convicts in Kenya.

Though Iran later appointed a replacement, he is yet to present his credentials.

TERROR SUSPECTS

Meanwhile, terror convicts Ahmad Abolfathi Mohammad and Sayed Mansour Mousavi, are currently serving a 15-year jail term, following their arrest with bomb-making material back in 2012.

A police report filed in court showed they confessed that they planned to attack US, Israeli or Saudi interests in Kenya and had hidden the explosive material at a golf club in Mombasa.

But there is more. While Soleimani had been implicated by the US for directing a network of militant groups that killed hundreds of Americans in Iraq, he, at some point, collaborated with the US against ISIS in Iraq.

That relationship later ended but observers say his death could help in reviving ISIS.

ISIS POSSIBILITIES

Sam Heller, a Senior Analyst on non-state armed groups at the International Crisis Group, warned the US could lose out key local collaborations against the terror group, endangering the world once more.

“The US’s killing of Qassem Soleimani and Abu Mahdi al-Muhandis will have many grave consequences region-wide. One likely-seeming result: the end of the US- led Coalition role in Iraq, which enabled Iraqi forces to pursue ISIS remnants. ISIS is poised to benefit.”

ISIS, which sprouted out of the Syria conflict, before its leader Abu-Bakr al-Baghdadi was killed in 2019, had grown networks with a faction of Al-Shabaab in East Africa, which have numerously attacked Kenya.

REVENGE WARNING

On Friday, Iran’s Supreme Leader Ayatollah Khamenei, who appoints the commander of the Revolutionary guards, warned of “revenge” against the US, a call echoed by Iran’s allied groups, the Hezbollah in Lebanon and the Hezbollah Brigades in Iraq.

The Iranian regime and its key leaders Khamenei and Iranian Foreign Minister Javad Zarif have been sanctioned by the US, blocking companies from doing business with them, except on essential humanitarian goods.

When a previous round of sanctions, imposed in 2012, was lifted in 2016, Kenya’s tea exports to Iran surged, and according to the East African Tea Trade Association, Iran bought about Ksh. 28 billion worth of Kenyan tea in 2017.

When Trump restored sanctions in 2018, Kenya’s exports fell, affecting a total of 17 per cent drop in exports, according to the Kenya Tea Development Authority.

Though Iran has a tea market of about 80 million people, and had been the fifth buyer of Kenyan tea, sanctions meant traders in Tehran could not find banks to complete their payments through the dollar.

The continued escalation of hostilities, experts argue, could further ruin tea sales abroad, which had reached a high of Ksh. 140 billion in 2018.

Turkana County: Journalist Assaulted By Stegra Hotel Bouncers

Lodwar-based Star Journalist Hesborn Etyang was beaten by security officers of Stegra Hotel after he took pictures of a child who was drowning in the hotel’s swimming pool.

The child, who is currently fighting for his life at the Lodwar County Referral Hospital left the children swimming pool area and jumped into the deep end of the adult swimming pool and started drowning when the journalist who was within the vicinity of the hotel decided to take pictures of the event to report.

The 12-year boy sunk to the bottom of the adult swimming pool before he was rescued and rushed Hospital.

The Star Journalist Hesborn Etyang present during the incident was harassed by the management of the Hotel for taking pictures of the drowning boy on claims that it could taint the image of the hotel and lead to closure.

“Immediately I took the photos of people doing first aid to the drowning 12-year-old boy who was about 20 metres away from me. One of the restaurant staffs noticed and raised alarm to her colleagues that a journalist was filming the incident,” journalist said.

He said just after taking the pictures, immediately two people identified as bouncers of the hotel, together with one of their senior staffs working in the human resource department pounced on him demanding for the Camera and threatening him to delete the pictures.

Etyang who reported the assault at the Lodwar Police Station under OB No. 40/02/01/2020 said he complied with the hotel’s security to delete the pictures he had taken but was beaten when he refused stating he was doing his work.

‘I took pictures as it pertains my work to report news and in this case to highlight the dangers of swimming pools without life-savers’, said Etyang

The incident took place on new year at around 1:15 p.m.

Governor Waiguru In Trouble As NYS Scandal Revisited

Kirinyaga County Governor Anne Waiguru Mumbo-Waiganjo should be a worried lady after parliament gave the Director of Public Prosecutions (DPP) Noordin Haji three months to initiate prosecution of individuals involved in irregular award of Sh54.8 million contract for food supply to scandal-hit National Youth Service in 2014.

Ms. Waiguru-Waiganjo who is gearing up to become Mount Kenya leader was adversely mentioned in the scandal. She was then Cabinet Secretary for Devolution. The NYS scandal where over Ksh790 million was lost hounded her out of office.

The National Assembly wants Mr Noordin Haji to charge officials at the State department of Youth, Public Service and Gender who awarded tenders to firms that were not listed as suppliers.

Some of the suppliers were registered more than six months after the contracts were issued.

“The procurement contracts included a firm that was registered on June 16, 2015,” a report by the Public Accounts Committee (PAC), that was adopted by Parliament last month states.

PAC chairman and Ugunja MP Opiyo Wandayi said the State department of Youth used invalid contract documents to procure goods and services contrary to the law.

“The committee recommends that within three months upon adoption of this report, the office of the Director of Public Prosecutions should prosecute those found culpable,” Mr Wandayi said.

Parliament last month adopted PAC’s report on the examination of audited financial statements for national government for the year 2016/17.

The report contains a recommendation requiring the DPP to prosecute those found culpable in the award of the contracts for supply of food and rations to NYS.

Francis Owino, the Principal Secretary for Youth department defended the procurement arguing the State department did not have contractors at the time.

NYS Scandal

In June 2018, four MPs, Mohammed Ali (Nyali), Caleb Amisi (Saboti), Tindi Mwale (Butere) and Kuria Kimani (Molo), named former Director of Criminal Investigations Ndegwa Muhoro, current Health Cabinet Secretary Sicily Kariuki, former Devolution Cabinet Secretary Mwangi Kiunjuri, and Kirinyaga governor Anne Waiguru as key suspects who should be investigated.

The MPs, also tabled the list of 40 companies which they claimed benefited from the proceeds of the stolen NYS money through irregular or illegal payment.

Some of the companies include Rayman Company Limited, Rigi and Nana Company Limited, Puma Holdings Limited, Zintech International, Eagle Ciew Merchants Limited, Caldan Enterprises and Kiche Ventures. Others are Out-of-the-Box Company, Reinforce Concrete Technologies, Horizon Limited, Kevman Investsments, Mastery Enterprises, Telenodech Agencies, Chama Holding Limited, and Equip Agencies Limited.

When the news broke, MS Waiguru threatened to sue the MPs.

The Director of Criminal Investigations (DCI) George Kinoti did nothing after this.
