Scandal-Ridden Ola Energy, Formerly Oilibya, To Retrench Staff

The company seeks to retrench several senior employees and non-performing employees.

The Employment and Labor Relations Court recently ruled that Ola Energy terminated a manager unlawfully and unfairly. Justice Onesmus Makau determined that there was no basis for terminating the ex-manager.

The judge also ruled that Ola Energy violated the ex-manager’s constitutional rights. This case highlights the failure of Ola Energy to solve the various legal troubles. The company has nine (9) other cases of a similar nature pending in the courts.

Ola Energy face many other cases. Former GM Duncan Murashiki is challenging a KRA Departure Prohibition Order (DPO). KRA issued the DPO resulting from the unpaid duties and taxes of KES 15 billion that KRA has demanded. KRA issued the DPO in May 2018. The case is set for another mention on 29th October 2019.

Ola Energy is among many appellants at the Tax Appeals Tribunal (TAT). The appellants exploited the absence of Tax Appeal Tribunal Members. Former CS, Henry Rotich’s had failed to gazette members of Tax Appeal Tribunal for more than one year.

The former Kenya GM, Mr. Murashiki attended court in a criminal case against him and 4 other employees. The case resumed in court on 18th September with the complainant taking the stand.

The case will resume on 5th November 2019 when the accused are due to take the stand. The criminal case threatens to draw in new General Manager, Millicent Onyonyi. She is expected to attend court as the executive officer in Kenya.

In July 2019, Kenya GM Duncan Murashiki, a Zimbabwean, left after his contract was not renewed. He is resides with his family in Cape Town, South Africa. Former Ola Energy employee, Ms. Millicent Onyonyi took over as General Manager.

Ms. Onyonyi was most recently Managing Director at BOC Gases. She becomes the first female General Manager in the Ola Energy operations in Africa. She is also the first Kenyan GM to run the Kenyan affiliate.

The business is now in trouble after it has emerged unit costs are now higher than gross selling margins. The Energy & Petroleum Regulatory Authority (EPRA) sets the selling margins and prices.

Insiders now say that Ola Energy is due to carry out several retrenchments before the end of this year. This is in an attempt to rein in operating costs. The company seeks to retrench several senior employees and non-performing employees.

In a sign of tougher times ahead, the company effort to re-brand to Ola Energy has also run into headwinds. Insiders have indicated that consumers have not embraced the Ola brand. Retail petrol stations re-branded to Ola Energy have experienced significant drops in sales. This includes the highest selling Waiyaki Way petrol station.

Ola Energy (Oilibya) sales have dropped with a corresponding loss in market shares. Ola Energy is now threatening to remove dealers that lost sales after the re-branding. The threats are reminiscent of a dealer removal that went awry in 2016.

In May 2018, the Libyan press (Libyan Express) highlighted the Kenya situation. The result was the removal of the then Africa Operations CEO Mr. Ibrahim Bugaighis. He was then accused of mishandling of the situation in Kenya.

Mr. Mazin Bin Ramadhan replaced Mr. Bugaighis in November 2018. Mr. Bin Ramadhan was a former Libyan Finance Minister. He is also a close adviser to Fayez Al-Serraj, the Head of the Presidential Council in Libya. The Presidential Council governs the Government of National Unity (GNU) based in Tripoli.

CEO Mr. Mazen Bin Ramadhan and COO Maurizio Libutti visit Kenya later this month. They are due to hold board meetings to resolve the various cases. Meeting with officials of KRA to discuss ways to resolve the tax demand is also high on the agenda.

Kisumu Governor Prof. Anyang Nyong’o, when he launched his book Presidential or Parliamentary Democracy In Kenya? Choices to be made‘, he meant that the debate on which system is better should begin.

Lawyer Miguna Miguna didn’t shy away from the debate, as with many Kenyans, he shared his thoughts.

Here below:

A presidential system is designed in order that if one loses a presidential election, s/he retires like almost all American presidential losers do. A mixture of a presidential and parliamentary system is the MONGREL system we had before 2010. Kenyans don’t need another mongrel.

Post-election conflicts aren’t caused by the winner takes all system; they are caused by those in power who rig elections, refuse to leave power after serving their full terms and use power to steal, oppress and brutalize citizens. Enforce and respect the current Constitution.

When those who have served their full terms or candidates who have lost elections retire honourably they allow for peaceful successions and enable those with new ideas, visions, ideologies & programs to demonstrate their abilities. It regenerates, renews, stabilizes and develops.

Tyrants cling to and abuse power in both presidential and parliamentary systems. Tyrants loot, torture, maim and kill in all systems. The problem is not the system of government. It is tyrants. Remove them through a revolution and assume power over your lives. #DespotsMustFall

PHOTOS: Anti-Terrorism Police Unit Recovers Deadly Weapons In Likoni

This evening, the Directorate of Criminal Investigations (DCI) on its social media pages reported that Anti-Terrorism Police Unit (ATPU) had recovered over 1,600 Rounds of Ammos, Grenade, G3 Rifle among other Assorted Weapons at Majengo Mapya in Likoni.

THREE Terror Suspects were shot dead during the operation after a Shootout ensued.

Police made 7 arrests.

Also recovered were the following;
68 Air Rifle Pellets, 5KG of Ammonium Nitrate, Nine Balaclava, Military/Police Uniforms, Military Holsters & Porches, Rifle Oil, One GPS, Six Machetes, Three Knives & other assortments.

Police say that the seven who were arrested are currently being interviewed to give more information on the terror network.

Exam Results Delay: Is University of Nairobi Understaffed?

Students of the University of Nairobi (UoN) have been decrying the lack of results many semesters after doing exams.

Prof. Isaac Mbeche (pictured), who is the acting Vice Chancellor at the University took over from Prof. Peter Mbithi, should address the issue’, said one student on condition of anonymity.

The history, Linguistics departments according to the students WhatsApp chats, as seen by the editor of this site, are the most notorious.

Sociology department with its huge number of students per class is said to the best, since despite the big number of students, results always comes in faster.

‘We receive our results a month after sociology exams. As for the other departments especially history and linguistics, the results can delay even up to three subsequent semesters’, a student wrote.

These raises questions as to whether the departments are understaffed.

The new VC should work on making the University more efficient.

The Directorate of Criminal Investigations (DCI) detectives have arrested criminals who stole over Ksh900k from a 67 year old sickly granny.

The lady, Faith Wanjiku had sold her only land at Ksh2 million to cater for her medical expenses. She opened an account at Equity Bank and deposited the money in the account only to learn later through her helper that Ksh970k was missing.

The Thieves

The DCI operation took place in Kiambu County, where the three thieves Antony Babu KAIRA, Kelvin MAINA & Joseph KARIUKI were apprehended and are currently in lawful custody.

DCI says it is looking for more suspects who benefited from the proceeds of crimes.

The Ksh970k was transacted in four series using the Eazzy App in the sequence;
Antony Kaira- 300,030/=
Kelvin Maina- 300,030/=
Vivian Jelagat- 300,030/= and Ksh. 70K to various Equitel Nos.

Police say the suspects will be arraigned in court tomorrow.

Things are not rosy for businesses in Kenya.

SK Macharia owned Royal Media Services (RMS) is struggling in a Kikuyu economy.

The senile bootlickers at Kenya Private Sector Alliance (KEPSA) aided by the colonialiats from United States of America (USA) and United Kingdom (UK) represented by their Ambassadors supported sham elections.

Well Godec and Nic have gone back to their respective first worlds to enjoy the junk foods there while you rot on heaps of garbage from the media that doesn’t keep the government on toes.

Were it not for bloggers, where would Kenya be? 🤔

In Kenya, currently, it is a ‘Jesus Take The Wheel’ moment.

Kenyans are good people who unfortunately hope too much.

They just hope without asking that things will get better.

They ignore such great provisions as provided in Article 37 of the constitution.

That provision, to peaceably assemble, picket, demonstrate and present petitions to authorities, To change their lot or resign, is needed more now that ever.

Save My Job: The Illusion Of Impact Of Social Media

Kenyans on social media thinks that the hashtags are enough.

After so many job losses, Kenyans on Twitter are running the #SaveMyJob hashtag on Twitter instead of petitioning to remove the Jubilee Government.

It is a toll order but social media strategy is dead on arrival.

The thing is, Kenyans chose to live on their knees instead of dying on their feet.

There’s no way a government that has continuously flouted various court orders understands the language of social media. It would’ve been better if social media is used to organize petitions, peaceful assemblies, picketing rallies and demonstrations that are peaceful in order to call out the government for neglect, lack of jobs, mismanagement and idolatry.

Leaders worship money and it is a free for all moment where even a department head is such useless ministry as that of Tourism will steal from the budget allocated in his or her department without much care.

Love has departed the hearts of many in this Kenya, especially the leaders.

In the end then, only the poor suffer more because it is easier to get mugged anywhere no matter your status in this Nairobi, as youths think stealing and gambling is an economic activity.

NOTHING WILL CHANGE!

Things might change if the entire Jubilee government resigns, a caretaker is appointed in its stead, but only if Kenyans show that they are tired, they are suffering and that it is enough. Without showing that you are suffering, ‘they will kill you and if you don’t protest they will say you enjoyed it’.

The port city of Mombasa is turning into a Ghost city as jobs prospects dwindle due to a railway that we shall never be able to repay. Today a woman was forced to strip naked so as to force the SGR colonialists (chinese) to return her packed foods for her kids. The Chinese are forcing Kenyans to buy foods that benefit the Chinese inside the SGR.

In the last article about the saga in the Pattni household. This site highlighted the story of one Harish Ramniklal Mawjee who was hounded by his ‘brother’ on trumped up charges and taken to Parklands Police Station.

Is Victoria Bank Founder Kanji Damji Pattni Planning To Kill This Man?

The family said that they held him (Harish) hostage at Parklands Police Station from 14:00 hours on Saturday 28 September 2019 to Tuesday 1 October 2019 without granting him cash bail.

They took him to Milimani Law Courts on Monday 30 September 2019 in the morning, kept him there until the afternoon and didn’t file anything.

Thereafter, they took him back to Parklands Police Station and refused him cash bail. The next day, on Tuesday 1 October 2019, due to pressure from human rights organisations and other authorities they presented him at Milimani Law Courts in the morning where he was finally given bail.

Persecuted Harish Mawjee

Mr. Harish is not in good health, as is known to Damji. It appears Damji wanted him dead by ‘natural causes’.

Over the four day ordeal, he wasn’t allowed to see his family, he was deprived of sleep and food and medication on the correct intervals and therefore he was rushed to Aga Khan A&E as soon as he left the courts at around 16:00 hours.

Mr. Harish’s Health

Mr Harish Ramniklal Mawjee underwent a neuro surgery on the 31 January 2019 at the Aga Khan Hospital Nairobi after collapsing in the bathroom at home in the early hours of the morning.

He is still recovering from that procedure and is also hypersensitive and extremely diabetic. Anymore days in unlawful custody would have caused him to perish in the cells at Parklands Police Station.

This process has been highly unconstitutional and is a complete abuse of power by the police. It seems that Harish Ramniklal Mawjee, is a victim of powerful mafia like business magnates and corruption. This is unjust.

We know that the Kenya Police is the topmost corrupt govt agency, but they shouldn’t allow to kill an innocent man.

Justice for Harish! Justice for Humanity! Because today it might be Harish, tomorrow it might be you.

Let’s not keep quite and let this atrocity go on unabated.

This is not the time to keep quiet.

Justice for Harish. Speak up Kenya.

Don’t allow this man to crucified by the corrupt!

KEMSA Recalls Sure Condoms Over Quality Concerns

The Kenya Medical Supplies Authority (KEMSA) has recalled the most popular condom brand among Kenyans.

The Sure brand which has the backing of the government, supplied to Kenyans through KEMSA, was recalled today.

In a Letter to Newsrooms, KEMSA said that Lifeline Laboratories, the makers of Sure Condoms have recalled it due to quality issues.

The specific line of Sure Condoms that is being recalled is the dotted one. The batch numbers and the expiry dates were shared on the letter.

Several casualties reported.

Ambulances/paramedics are yet to reach the scene.

This morning

Recent reports show that 14 people lost their lives in this accident. Over 30 injured.

14 People Died In The Kericho – Kisumu Highway Accident

Fourteen people lost their lives in the Kericho Kisumu Highway

Yesternight, this blog broke the news of the grisly Accident at Awasi along the Kericho Kisumu Highway.

“The bus was travelling from Kisumu towards Kericho on the Kisumu-Nairobi Highway when the driver tried to overtake a cane tractor and was involved in a head-on-collision with the trailer,” said Mr Maweu, Kisumu County Police Commander.

The bodies of the deceased were taken to Jaramogi Oginga Odinga Teaching and Referral Hospital while survivors are also undergoing treatment at the facility, the regional police boss confirmed.

NTSA

Interior CS Fred Matiang’i last week ordered that National Transport & Safety Authority (NTSA) back on the roads, due to the increase in road accidents.

This comes nine months after President Kenyatta ordered all NTSA officers withdrawn from Kenyans roads and their duties taken over by traffic cops.

The only problem in this country is not laws, but implementation of those laws. NTSA officials were facing accusations of corruption and impunity in the enforcement of their duties; it doesn’t seem they have changed.

Defiant Bobi Wine To Continue Wearing Banned Beret

A few days after Ugandan Dictator Yoweri K. Museveni banned Ugandans from wearing the red beret which has become a symbol of resistance; popularized by Kyandondo East Member of Parliament Robert Kyagulanyi aka Bobi Wine, the musician turned politician denounced the ban.

Bobi Wine tweeted a video showing him denouncing the government’s ban of his trademark red beret for people who are not in the armed forces.

A spokesman for Bobi Wine’s People’s Power Movement, said the beret had been banned due to “fear” and “panic” from the government and that they will not stop wearing it.

In the video, which has an emotive marching beat as a soundtrack, the politician says the beret is a symbol of the “desire for change”.

The party insisted that the badge for the Uganda People’s Defence Forces beret was different to their beret, which they call “a symbol of resistance”.

By wearing the beret, Ugandans are “not committing any crime,” Bobi Wine insisted.

A woman wearing the beret in the video said the headpiece is “a symbol of hope for so many Ugandan women, young and old, who cannot effectively participate in the democratic process of our country”.

Bobi Wine announced in July that he will be running for president in Uganda’s 2021 General elections.

STATE OF OUR SCHOOLS: PARENTS BE KIND TO THE LITTLE ONES

The tragedy of the notorious Precious Talents primary school has opened a huge can of worms regarding our primary and secondary schools.

Some schools have the state of the art facilities including buildings. But other schools fail to the basic of what makes us call a place a school.

It is time to wake up and be kind to the Kenyan child studying in deplorable conditions. I think parents should show the way for others to follow here. I say Serikali saidia is not a song any parent should sing when their child studies in conditions that some farmers cannot house their cows!

 

Where has the love for the little ones gone? Kazi zi kuzaa tu bali kumlea mwana.

 

There are kids studying under trees and I wonder how the TSC posts teachers to schools without classrooms and toilets. How are they expected to work in such conditions?

I went to school shortly after independence. Our parents paid 65 shillings annually to the District Education Board. It was not easy to afford the fee and the kids from very humble homes paid 15 shillings and it was said they were given remission of fees. We got free textbooks and beautiful exercise books which had the map of Kenya showing major towns. Most of our classrooms had mud walls and tin roofs. We swept and watered the dusty earthen floors daily. Corrugated iron sheets and cemented floors were things we only imagined of.

Our parents built the classrooms for us. They provided poles, posts and communal labour to make the mud walls. They also plastered the mud walls with a mixture of cow-dung and wood ash.

We had decent toilets, adequate for both boys and girls. It bothered nobody stepping on the earthen floor of the toilets barefoot. Only teachers had shoes in those days.

Any reason why any kid in this republic should study under trees? Those trees should provide building materials. Mud, cow-dung and wood ash are readily available.

If no MCA provides roofing iron-sheets then there is thatching grass.

Serikali provides funds for simple desks and the teacher’s table. Or what is done with the National Government Constituencies Development Fund Board (NGCDF)?

Toilets! This is an area where even the assumed civilized central Kenya counties fail the test. How can anyone say there is only one toilet for both boys and girls? And they wait for Serikali to build toilets for the kids they love so. It does not add up.

Parents can sacrifice a little luxury and build modern toilets for their kids.

Elsewhere there are schools without a single toilet. Teachers visit toilets in the neighbourhood as the pupils go to nearby bushes. This was acceptable before the coming of the Christian missionaries. Not today.

I think we should all be kind to the little ones and provide them with decent schools. This is the only way to show we want them to be there to take up places as men and women of this republic.

Mombasa Leaders & CSs Matiang’i (Interior), Macharia (Transport) give a press conference after talks on the way forward concerning cargo transportation. The talks yielded a suspension of the directive to have cargo hauled from Mombasa Port using SGR only.

There were protests in Mombasa concerning the shipping of jobs inland to Nairobi then Naivasha.

The PEOPLE resisted the autocracy and bad policies of the Kenyatta regime.

The talks

The Standard Gauge Railways (SGR) which is white elephant and doesn’t add any value to the Kenyan economy, continues to mistreat Kenyans working there.

Complaints to the government has been met with, ‘vumilieni, mmepata kazi’.

Mombasa residents who work in the most hit sector due to the directive to have all cargo hauled through SGR would hear none of it. They said enough is enough in the most lodu way.
The demonstrations they held at least bore fruits.

The demonstrations, picketing, petitioning forced Mombasa leaders to reach out to the central government’s ministry of transport and also that of interior.

The results was the suspension of the directive to force Container Freight Stations (CFSs) to use SGR to bring cargo to Nairobi.

Though the win is temporary, Mombasa residents showed that is is possible. They used the provisions of Article 37 of the constitution to demand that their rights be respected.

For Kenya to change, Kenyans need to change.

4.A CAMEROONIAN NAMELY ESOME JEAN BABTIST. A RECOVERY OF 35,200 USD(3,500200 KSHS) AND A POCKET PHONE WITHOUT A BATTERY WERE MADE.

Rogue NYS to Pocket Millions In New Contract With A Mall

The corruption-ridden state agency has plundered its funds until it is looking for private entities to man in order to boosts its finances.

One such, The Two Rivers Mall has now caused over 220 staff from a local security company to lose jobs.

Securex security has written to all staff, declaring redundancy

Below is part of the Securex Agencies Limited letter:

Notice of termination by reason of redundancy

We refer to a number of lost assignments through the year a situation that has worsened as we approach the end of 2019.

The losses can only be attributed to the prevailing difficult economic times prevalent in the country that have recently culminated in the loss of our Two Rivers Assignment which released 222 of our Security officers.

The management has tirelessly endeavoured to find alternative assignments but without much success.

In view of the above, the services of some employees have been rendered superfluous thereby necessitating the termination of their employment on account of redundancy in accordance with the provisions of section 40 of the employment act.

The Company hereby gives one (1) months’ notification of the intended redundancies which will be effective on 5th November, 2019.

In line with the company policies, the company shall give the employees declares redundant one (1) months’ pay in lieu of notice, days worked and not paid and all accrued benefits, including any leave days earned but not taken.

All affected employees will be expected to continue with your normal shifts and timings as scheduled up to 5th November. 2019.

The company HR used the recruitment process at MTV to recruit her people. For example, she got a sign language interpreter and paid her 90K while Anchors like Simba and Stephanie and Ingrid earn 50K.

Imagine this is the salary that is going to be halved.

Some other technical people who put in 15bhr shifts are paid 30K

The Ukrainians you talked about are just a tip of the iceberg. There are Indians who have been contracted for software and hardware supplies who are owed 20M.

The biggest mistake that Omukoko made was to start a TV without a plan. Now people who had good positions in other media houses will be paid half or declared redundant.

There is a big big problem at Metropol.

The TV will surely not be sustainable as it depends on the CRB and they are not doing well.

They are packed with many managers who are all relatives of Omukoko and earn fat salaries but do nothing.

All the suppliers are now asking to be paid after a story carried by this blog revealing that Metropol CRB is struggling and unable to pay debts or its staff.

We had exclusively revealed that the company had asked the staff to take a 50% pay cut.

HRM, Finance Manager and COO went round the organisation’s 4 offices alerting staff of the changes. They, however, fell short of giving the way forward and left it to the MD, who was out of the country when we did the story.

Hey Cyprian

The worst is that KBC have not been for Signet distribution.

They can take the TV off air anytime. They are asking people to have faith in the company but there’s no hope.

Careers have been destroyed for this reckless decision of the MD. He refused to hire local developers then hired Indians and Ukrainians and now can’t pay them.

The company developers are paid 50k a month. The foreigners are paid 100k per day. Yet they have not delivered anything but there’s a contract signed without due diligence and so they must be paid. Big mess.

The MD ignored professional advice and procured all broadcast equipment on whim. Those suppliers have never been paid.

Basically, they are asking people to take a pay cut without a plan of how to rescue the company. They insist on all these vanity projects that are sucking the company dry yet expect people to work for 50%.

The clueless Terryanne who the MD smiles as he calls TC dear has also managed to fix her people in TV.

She has clueless social media socialites who are airheads and who post errors all day but are paid more than anchors and studio technicians working all day.
