Residents Want Chinese Contractor In Charge of Sh3Bn Project Jailed For Defying Court Order

Justice Lucy Mbugua of the Environment and Lands Court

A rogue Chinese contractor is facing a jail sentence for defying a court order on the Sh3 billion construction project of the Centre for Parliamentary Studies and Training in Karen, Nairobi.

Executives of the China Jiangxi Corporation for International Economic and Technical Cooperation are accused of acting in contempt of court orders issued by Justice Lucy Mbugua of the Environment and Lands Court on August 2.

In her ruling, Justice Mbugua instructed the Chinese firm to stop further construction of the site pending the hearing of the case lodged by members of the Karen and Lang’ata District Association.

The residents say that despite the order, China Jiangxi Corporation continued with the project, which has prompted them to commence contempt of court proceedings against the contractor.

They have also written to the Chinese Ambassador in Nairobi, asking him to instruct the contractor to adhere to the court order.

“This is a violation of the justice system in Kenya and a blatant disrespect of the court orders issued,” the letter by the association reads in part.

They claim the development is a threat to the character of the residential area of Karen, adding that its magnitude and scale is affecting those adjacent to the project.

The institute is being set up as a department at the University of Nairobi (UoN).

UoN has since renewed its collaboration with the Centre for Parliamentary Studies and Training for another five years to offer its fit-for-purpose and relevant programmes to Parliamentarians and Staff of Parliament.

Trouble looms for Raila allies Mohammed Jaffer, Joho over SGR deal

Trouble is looming for Raila key financier Mohammed Jaffer and former governor Ali Hassan Joho as the William Ruto government now seeks to cancel their contracts with SGR.

Roads and Transport Cabinet Secretary Kipchumba Murkomen yesterday lifted the lid on the contract that Kenya Railways Corporation (KRC) entered with private companies for the transportation of cargo through SGR in 2018.

While responding to questions tabled by Gichugu MP Gichimu Githinji, Murkomen (pictured) listed Grain Bulk Handlers Limited and Auto Freight Terminal as the two companies that KRC entered long-term contracts of 30 and 45 years respectively.

This is as the Auditor-General flagged missing documents in a contract that saw a logistics firm Autorports Limited linked to the family of former Mombasa Governor Ali Hassan Joho offer the deal to operate at a taxpayer-funded terminal for standard gauge railway (SGR) cargo.

The public auditor’s office said it was unable to trace a notice from Autoports Freight Terminal Limited expressing its intention to handle SGR cargo from the Mombasa port to the inland cargo terminal.

The auditor general also noted that the letters were forged.

The government seems to be going after Jaffer on his Bulk grain business as president Ruto seeks to ensure there is cheap food within the country.

The troubled billionaire may also lose his grip on the LPG sector. This is after it emerged that the Energy and Petroleum Regulatory Authority (EPRA) will be giving a licence to Tanzanian firm Taifa Gas Investment to construct a liquefied petroleum gas (LPG) import and storage terminal in Mombasa before the end of the year.

EPRA said it would review afresh an application by Taifa Gas after an earlier undisclosed “shortcoming” saw the firm denied a licence after influence from the Mombasa-based businessman Mohammed Jaffer.

Jaffer controversially built his business empire by leveraging on political patronage and has been the main benefactor of ODM Party Leader Raila Odinga by funding him to a tune of millions in the 2022 election and previous elections.

Jaffer

Raila’s Odinga with  Jaffer Mohammed

To date, there have been tens of investigations on the unfair monopoly of Mohammed Jaffer’s companies including Grain Bulk Handling Limited (GBHL) but no action has been taken.

Maize and other grains are expensive because of the monopoly that GrainBulk Handlers has been enjoying for many years and now he has been trying to block all other players in the industry.

Through alleged bribery, Jaffer has also been accused of completely taking over the imports, distribution and retail business in the LPG sector undercutting other companies and driving them out of business altogether the latest tactic is buying off competitors who feel helpless and have to allow Jaffer to buy them off.

At one time in Uhuru’s regime, the National Intelligence Service joined the crackdown on the illegal exchange of liquefied petroleum gas (LPG) cylinders as part of measures aimed at controlling illicit refilling rackets in the country but was told to go slow after the handshake.

Jaffer is said to be close to high-ranking judges in the Judiciary including distinguished magistrates like Court of Appeal Judge Alnasir Visram.

With the deep connections within the corridors of power, the tycoon wins a majority of cases filed against him or any of his firms and evades scrutiny.

DPP Says Maribe, Jowie Have A Case To Answer in Monica Kimani’s Murder

Media personality Jacque Maribe and Joseph Irungu alias Jowie on the dock.

Media personality Jacque Maribe and Joseph Irungu alias Jowie on the dock.

Former TV anchor Jacque Maribe and her ex-fiancé Joseph Irungu alias “Jowie” have been dealt a fresh blow after the Office of the Director of Public Prosecutions (ODPP) told the court they both have a case to answer in the murder of the late businesswoman, Monica Kimani.

In her submissions on behalf of the prosecution, Assistant DPP Gikui Gichuhi noted that all events leading to the murder and subsequent lies made by Maribe to the police show that she planned with Jowie to kill Monica.

According to Ms Gichuhi, Maribe and Jowie were principal offenders, had a common intention and acted in concert to eliminate the deceased person.

The state has also told the court to consider the fact that Maribe made no attempt to disassociate herself from the actions of Jowie and instead helped get rid of the evidence.

“The demeanour of Jowie and Maribe should also be taken into account at the time of investigations which entailed giving false information to the police during the trial where the accused in some cases missed court proceedings or did not comply with bail conditions granted,” Gichuhi said.

She also told the court that the two accused worked in conjunction to ensure that Jowie had the transport, a menacing weapon and the opportunity to cause the death of the deceased.

The prosecution also asked the court to note that Maribe assisted Jowie to burn evidence outside her house, which suggests that she knew Jowie had gone to Monica’s house that night.

“Maribe knew that Jowie had gone to the home of the deceased on the night of September 18 and went as far as announcing the sad news on Citizen TV on August 20 2019 knowing full well what had happened,” Gichuhi added.

Gichuhi further said that at no time did she provide that information to the police in any of her statements or give the true nature of how Jowie sustained injuries in her house.

So far, the court has heard testimonies from 35 witnesses.

After considering submissions from the state, Jowie and Maribe, the court will then make a ruling on whether they will be put on their defence or acquitted.

La Palanka African Restaurant

Frustrated staff members at the Le Palanka African Restaurant along 909 James Gichuru Road, Nairobi, are up in arms against the establishment’s management for withholding their dues.

Writing to this blog on Friday, December 9, 2022, one employee disclosed that they have gone over three months without payment.

Anyone that dares to stand up and speak out against this grave injustice is quickly demonized and issued termination letters.

As if that is not rude enough, the managers call the cops on any complainants that return to rightfully ask for salary arrears upon facing the sack.

They are wheeled away and thrown into the cells on trumped-up charges of “causing a disturbance”.

The source also revealed that its directors, who act as the middlemen, have been stealing from the Senegalese owner Mamadou Kolade and pocketing funds meant for sorting out wages.

One culprit recently set up his own entertainment joint in Karen using the looted proceeds.

“Good afternoon Nyakundi, please hide my identity.

I’ve been working in 909 Le palanka restaurant since its resumption in June, but what I can say is the staff don’t get paid.

When one of the staff tries to stand out to ask for the salary, that’s termed incitement, and you get immediate termination na hivo tu mshahara yako inakunywa maji.

When you come back to ask for your salary unaitiwa maaskari that you causing disturbance.

Several have been arrested to a point of being falsely accused.

The so called directors kazi yao ni kusign tu bills after which they pocket the cash, wananyang’anya waiters any cash wako nayo halafu wanaenda kupiga sherehe kwingine.

One of them has even made sure that the restaurant has gone bankrupt na akaenda kufungua ingine Karen.

It’s been three months now without pay and they seem not to care.

Mark you the owner is Senegalese and whenever the guy sends money for the staff to be paid, hiyo pesa inakanyagiwa.

John Bett, Catherine and Oscar Binyenya are the man’s middlemen.

I would really appreciate it if they are mentioned by their names,” the source says.

The angry girlfriend who stormed into her boyfriend's house late in the night and found exactly what she was looking for.

COCO: The angry girlfriend who stormed into her Nairobi boyfriend’s house and found exactly what she was looking for.

Kenyan social media is currently awash with reactions to a trending video clip in which an angry girlfriend stormed into her cheating boyfriend’s house late in the night and unleashed physical violence on his alleged mistress.

In the footage which has since gone viral, the lady only referred to as “Coco”, discourteously invades the dingy apartment with emotions running high and demands that the side chic should leave the bedroom, which she boldly declines to do.

In a split second, she lands a heavy slap across her face, while hurling all sorts of unprintable words and threatening to beat her up.

As all this happens, both the boyfriend and the alleged mistress simply kept their cool and quietly watched the fracas play out under the warm sheets of the bed.

By this time, curious onlookers start gathering inside the poorly lit room and try to calm the angry girlfriend down, but to no success.

Others took the opportunity to take out their phones to record the dramatic scenes.

Eventually, the boyfriend in question somehow manages to cool down the temperatures, and with the help of his friends, they attempt to see the lady out politely to avoid triggering the attention of neighbours.

At first, she shows some mild resistance and asks that they allow her to pick up her belongings from the house, after which she finally agreed to leave.

Check out the video below.

Jails beckons for Safaricom CEO Peter Ndegwa and eight directors for disobeying court order

$

Notorious Telco Safaricom’s CEO and its directors risk facing jail time after a Magistrate’s court issued a warrant of arrest against the telecommunications top officials for disobeying a court order.

Those to be arrested include the CEO Peter Ndegwa and directors Dilip Pal, Christopher Kirugia, Winifred Ouko, Raisibe Morathi, Sitholizwe Mdalalose, Rose Ogega, Francesco Bianco and former CEO Michael Joseph for failing to pay a litigant kshs 7million as ordered by a Court.

In the ruling, Senior Principal Magistrate Henry Nyakweba stated that the corporate veil should be lifted so that the directors can be punished for declining to comply with the court order requiring them to pay Emphantus Njuki.

Nyakweba directed that the directors of Safaricom should be arrested and presented before the court for sentencing soonest but not later than January 10.

“In the upshot, I allow the application dated 3rd November 2022 as prayed. As a result, I issue a warrant of arrest against all directors of Safaricom PLC. Upon arrest, directors are arraigned before me for sentencing as soon as will be reasonably practical and in the event not later than 10th January 2023,” He ruled.

Safaricom PLC operated the Invesco Assurance account through Paybill 980100 as per the court order. The company is the Garnishee holding the money on behalf of Invesco and, the complaint in the case has been trying to get his compensation by compelling Safaricom to release the money.

They said the telcos have refused to comply with a court order and they should therefore be punished.

Through lawyer Morris Mugendi Njuki urged the court to punish the directors by jailing them for a term not exceeding six months or as the court may deem fit attaching their assets to compensate him for the loss suffered.

Njuki told the court that Safaricom PLC was duly served with a Garnishee order absolute on 4th October this year for the release of Sh 7.7 million.

The order, he said, was served to the company through email but the organisation has failed and ignored to adhere to the order.

“For this reason, the directors of Safaricom are therefore in contempt of court,” Njuki told the court.

“A Garnishee order obsolete do issue against Safaricom limited directing that all monies belonging to INVESCO Assurance company the judgement debtor herein held. The admitted amount to the extent of Sh.5,778,887.24 as well as accrued interests and costs of these Garnishee proceedings,” stated the said order.

Sales Executives, Correspondents at Struggling Radio Africa Group Cry Out Over Unpaid Dues

Radio Africa CEO Patrick Quarcoo

Days after Radio Africa Group announced a looming mass layoffs in the media house, employees in the Business Executive and Editorial departments are crying out over the nonpayment of their dues.

Writing to this blog on Saturday, December 10, 2022, a frustrated staffer revealed that some correspondents have gone unpaid for over 7 months, while those in Sales and Marketing have not received a dime since May 2022.

This is despite the company’s Chief Operating Officer Agnes Kalekye Nguna having pledged to clear out all their dues by October 2022.

The delays have caused some employees to sink into depression as they struggle to progress through life amidst the harsh economic times.

“Hey, Nyakundi.

On this Radio Africa Group redundancy.

These people have stressed us sales people, we have 4 months without pay.

Editorial is 7 months.

How does one survive with a harsh economy?

Don’t mention my name. I may not get my commission.

The affected departments are Sales and Marketing (Business Executive) and Editorial (Correspondents).

The COO did an email and promised to clear all the dues by 31st October, but up to date, no payment has been made.

They don’t care about how we are surviving and expect us to perform.

How on earth?

Some of us have been kicked out of our houses, and are hosted by friends and relatives.

We are really depressed,” the source wrote to us.

Just last week, Radio Africa Group’s Chief Executive Officer (CEO) Paul Qaurcoo, stated that the company’s management was compelled to restructure its operations due to financial constraints endured in their endeavour to remain competitive in the industry.

He cited the prevailing circumstances in the media industry occasioned by changes in consumption trends and business models as the cause of the struggles.

As a result, he noted that some employees would be declared redundant in a subsequent communication.

“As Management, we have been faced with a situation requiring critical business decisions to ensure business continuity.

We will therefore be reorganizing our internal operations, and in the process, we may declare numerous positions redundant based on the new structure,” the letter read in part.

The restructuring is expected to be effected in January 2023.

Radio Africa is the mother company of several media brands in the country, including The Star newspaper, Kiss 100Classic 105, and Radio Jambo.

Radio Africa joins the bracket of other media powerhouses that have declared scores of employees redundant in the recent past.

Susan Kihika Gets Into Bed With Asian Textile Manufacturer Oppressing Workers In Nakuru

Frustrated workers at Bedi Investments Limited are still seeking redemption from oppression by the factory’s rogue Asian owner, Mr. Jaswinder Singh Bedi.

Bedi Investments Group is involved in the manufacturing of a variety of textile intermediary and finished products; from fiber to fashion, in both synthetics and cotton.

In several of our previous publications, this blog has tirelessly highlighted a dark culture of toxicity at the textile manufacturer where delayed salaries, harassment and unfair dismissals are the order of the day.

Mistreatment of Workers at Asian Owned Bedi Investments Ltd

Ten months since we first received a complaint against the Nakuru-based business enterprise, frustrated labourers are still crying out for justice.

They say that the factory is yet to fully effect the 12 per cent minimum wage increase despite the harsh economic times.

To make matters worse, the meagre salaries are still irregularly paid, despite them following all the necessary procedures to raise their grievances.

As reported before, those who dare to speak out against this blatant prejudice are immediately reprimanded by facing the sack.

No End In Sight: The Plight of Workers At Indian-Owned Bedi Investments Ltd

Mr Jaswinder Singh Bedi always boasts of deep connections and never misses a chance to remind them that there is nowhere they can take him.

Despite numerous complaints against his company, he still enjoys proceeds of huge government tenders which he secured during Uhuru Kenyatta’s disastrous regime.

Last month, hundreds of disgruntled workers attempted to seek an audience with newly elected Nakuru Governor Susan Kihika in the hope that she would intervene and rescue them from this modern-day slavery.

But just like her predecessor Lee Kinyanjui, Ms Kihika seems to be in bed with the Asian tycoon.

She ignored all their visits to the county headquarters for three consecutive weeks.

“Hi Cyprian,

About Bedi Investments Limited, the company has so much slavery sijui what country we belong.

Huyu mtu increament ya 5% ya 2019 alikataa kuongeza hii ya hii mwaka 12% pia amekataa.

Sahii after watu kuitisha hizo, staff anafuta kufuta.

Hata arrears amekatalia.

After following all those procedures still amekaata kubadilika.

He has gone ahead kufuta watu without their payments.

Anasema ako well connected hakuna pahali tungempeleka na ni ukweli juu tulienda kwa governor Kihika 3 weeks consecutive wafanyikazi over 200 but no single day tulipatana na yeye na hadi wa leo hajawai sema kitu,” a source wrote to us on Saturday, December 10, 2022.

Guardmart Supermarket

This blog has received a disturbing video clip which allegedly shows a store manager unleashing violence on a male worker under unclear circumstances.

The footage which was forwarded to us on Saturday, December 10, 2022, was reportedly captured at the Guardmart Supermarket in Kisii town.

The eyewitness who requested anonymity claimed that the man incurred serious injuries from the beating which took place at the underground storage.

“He had blood stains all over his shirt,” the witness said.

Adding: “Kindly circulate the clip and help this man find justice.”

During the incident, another man, dressed in a “Guardmart” t-shirt, is seen entering the room and quickly moving towards the eyewitness, ostensibly to stop him from recording.

Our attempts to reach out to the supermarket’s management for a comment did not bear any fruit.

By the time of going to press, all our phone calls went unanswered.

Check out the video below.

Piga Sauti Part 6: How I was assaulted by a Lawyer and MCA protected by Police Officers

$

On this episode, we continue exposing the corrupt Police officers who are serving their own personal ambitions.

We have been informed that Police in Nambale are covering an incident where Nominated MCA Mercy Wanyonyi and Lawyer Danstun Riziki assaulted a man in Mungatsi before bundling him in their car.

Read More: Piga Sauti 5: Exposing pedophilic and Corrupt Police Officers

The Nambale OCS Sammy Kamau told our source that the case was being investigated. He however refused to divulge more information. The excuse was the normal Police bullshit.

Here is how the story happened.

“Mercy Wanyonyi and Danstun Riziki, attacked Christopher Butsunzu on 16th November at his place of work in Nakhoma village in Mungatsi Sub-location and later bundled him in their car and drove him to Nambale Police Station.

Butsunzu claims that he received a phone call from his wife on the 16th of November at around 3 pm telling him that Hon. Wanyonyi had called her telling her that they were coming for him.

A few minutes later my mother also called me reporting the same to me. I then started receiving texts from Hon. Wanyonyi something that proved to me that indeed she was hunting me.

Thereafter I received phone calls from Hon. Wanyonyi and another new number to my phone book and the caller was a man who introduced himself as Riziki and they all told me that they were coming to teach me a lesson.”

Read More: Piga Sauti Part3: Exposing The Corrupt Police Stations

Then on the same day. A friend of the suspect send the victim the following death threats on whatsapp.

Butsunzu says the crooks arrived at around 4 pm at his workplace driving in a Grey Subaru Registration. No. KDH 377M.

Hon. Wanyonyi and one tall guy came out of the car and entered the house. The guy shouted my name ‘Christopher Butsunzu’! and I answered, ‘Yes Sir!’. The guy said “I’m the Riziki Now” he kicked me and I fell down.

He claims that after the beating by both of them they took him out of the house and forcefully bundled him in the car and then they drove him to Nambale Police Station.

“while in the car the beatings never stopped until we reached Nambale police station. They took me to the counter and told the officers who were on duty to write me a statement, process the P3 for me, and we meet in court”, Butsunzu said.

In a WhatsApp screenshot shared by Butsunzu but which we cannot verify at the moment said, “This is the game changer. Now let go ‘siku nyingine utakuwa na heshima’ (you will have respect some day). I have the whole conversation but relax and see what happens. I have been to your home and you are my business till when I settle this”.

This is the guy who is sending people death threats look at what he is doing on WhatsApp groups. This is to say that he has money and that we can do nothing…

Riziki who is also the Vice Chairman of the National Reconstruction Alliance Party (NRM) said through a WhatsApp message, “the matter is already with the Police at Mungatsi Police Post so please talk to them.”

NRA

so, Lawyer Riziki is also corrupt

Busia Deputy OCPD George Opere said, “I have not been at the station for two months now because I am acting for Butula OCPD who is away on Leave and my Nambale OCPD is also not present as she is hospitalized so I can’t comment on the matter for now,”

County Commander Maxwell Nyaema requested that we hold the story and give him time to contact Nambale Police Station before he can comment on the story.

Funny enough, a police officer is attached to Mungatsi Police Post says that Riziki and Hon. Wanyonyi went to Mungatsi Police Post the same day and reported that they had rescued one Christopher Butsunzu from an irate mob and that they had taken him to Nambale Police Station to make a report.

“They claimed that they had gone to Mungatsi area to look for the cane to lease but in the process, they found that there was no road so they decided to enter in one of the homes to look for help and be shown a convenient road and it is there they found youths who were drunk and wanted to beat them up.

When making her report, Hon. Wanyonyi claimed that Butsunzu was among the group and he is the one who had ordered the youths to attack them but because the youths knew her they turned their anger on Butsunzu and that’s when the two rescued Butsunzu and rushed him to Nambale Police station to report. Personally, I find this very interesting why they decided to take Butsunzu to Nambale instead of all of them coming here. After the incident the two have now resorted to intimidating me through a flurry of letters sent to me by their Lawyers but I will not relent and they must face the law,”.

Butsunzu is now calling on LSK and the Inspector General of Police to step in and help him find Justice saying that it’s now a month since the incident happened.

The other day, Kenyans on Twitter were trending a hashtag in support of Chris who the police have turned a deaf year on.

No action has been taken despite having filled out the P3 form and made sure that all witnesses including his Landlord recorded statements.

Neon Lounge in Makutano, Meru Town

A nightclub in Meru has been exposed for promoting homosexuality, to the great discomfort of other revellers that do not subscribe to such appalling behaviour.

Writing to this blog on Sunday, December 11, 2022, one of our esteemed readers narrated how he travelled to the region alongside his friends for a weekend family event and later went out for some merrymaking in anticipation of the big day ahead – his uncle’s traditional wedding.

Once in Meru town, they decided to relax.

It was a slow Friday evening and their mission was simple: watch the day’s World Cup match, and later have some fun for the night.

After having their dinner, they looked around and settled on one spot that caught their eye compared to the rest.

Neon Lounge was the name, regarded as one most popular entertainment joints in the busy town.

They arrived at peak hours and found the fully packed and lively.

“Little did we know what awaited us,” he said in a message to this site’s Chief Editor.

Adding, “The club was full of gay men.”

The source attached the video below, which shows unbothered men dancing and grinding on each other in the full glare of the public.

“We felt very uncomfortable and had to leave our drinks on the table,” he lamented.

Surprisingly, nobody seemed to raise an issue with the rather peculiar activity.

They all treated it as a regular incident.

“This is so wrong. Why not inform revellers in advance that such behaviour is promoted at the club?” he asked.

Check out the video below and judge for yourself.

Nelly Cheboi: The 2022 CNN Hero of The Year

Nelly Cheboi, who warmed the hearts of many people with her grass-to-grace story, has been named the 2022 CNN Hero of The Year.

Online voters selected her from among this year’s Top 10 CNN Heroes.

The list included notable global figures like Adam Scott, Naomi Campbell, Aubrey Plaza, among others.

In 2019, Ms Cheboi quit a lucrative software engineering job in Chicago to create computer labs for Kenyan schoolchildren.

Cheboi’s nonprofit, TechLit Africa, has provided thousands of students with access to donated, upcycled computers and the chance at a brighter future.

TechLit is short for Technologically Literate Africa.

Cheboi accepted the award with her mother, who she said worked hard to educate them.

At the beginning of her acceptance speech, Cheboi and her mother sang a song onstage that she explained had a special meaning when she was growing up.

As CNN Hero of the Year, Cheboi will receive $100,000 (roughly Sh12m) to expand her work.

Nelly will also be named an Elevate Prize winner, which comes with a $300,000 (roughly Sh37m) grant and additional support worth $200,000 (Sh24m) for her nonprofit.

Fresh Trouble on Governor Kihika’s Doorstep Over Lack of Ethnic Diversity in CEC Nominees

Susan Kihika

Nakuru Governor Susan Kihika

A Nakuru-based surgeon has expressed an intention to sue Governor Susan Kihika, a few days after she forwarded names of county ministers to the County Assembly for vetting.

In a letter dated December 8, Dr Magare Gikenyi, accuses the governor of forwarding a list similar to the one contested.

He argues that only a single person was changed from the previous list, claiming the governor did not follow the due process of advertising, interviewing, nominating, vetting and appointment.

“To my dismay, you have released a new list dated December 8, 2022, essentially the same as that of the last impugned (except one person) without following due process. One wonders how you arrived at the new list, yet the early processes led to the impugned list being questioned by the court. You have started from the nomination stage despite the fact that the court took issue with your processes leading to the nomination of CEC members,” Dr Gikenyi stated in the letter.

Dr Gikenyi and Mr Daniel Bett had previously sued the governor, disputing an earlier list that they said did not reflect the ethnic diversity of the cosmopolitan county.

On December 5, the Employment and Labour Relations Court in Nakuru issued orders quashing the appointment of the CECs.

The court directed Ms Kihika to initiate a proper legal process of filling the CEC positions as contemplated in the Constitution, the County Government Act, and all the enabling provisions of the law.

The order also prohibited the governor from processing the listed CECs or any other persons nominated in contravention of the law.

According to Dr Gikenyi, the issue of ethnic marginalization is not cured by essentially reproducing the initial list.

He says the court was clear that the process ought to be started again to address the shortcomings of the first recruitment.

“I formally protest the new list since it has failed to follow court directions of starting afresh and as such the same is taken as a failure on your part to respect court orders. Take this as notice of intention to sue to protect the authority of courts,” the letter adds.

In the second list, Ms Kihika replaced only one of the 10 nominees who has since been appointed to another position in the county.

In her previous nominations, Kihika had listed Dr Samwel Mwaura as the CECM in charge of Health, a position he had held at the county between 2013 and 2017 under Kinuthia Mbugua.

In her new list, Kihika dropped Dr Mwaura and retained Jacqueline Mong’ina Osoro at the department.

Legal experts have termed the changes as cosmetic and political, as they do not meet the constitutional threshold that had led the courts to quash the first list.

In the earlier appointments, Kihika had picked her 10 nominees from three communities; Kikuyus, Kalenjin and the Luo in a ratio of 7:2:1 respectively.

The new list is a weak attempt to tilt the scales through the nomination of Osoro who hails from the Kisii community, a minority group in the county, by taking one slot from the Kikuyu community who are the majority.

As a result, Dr Gikenyi has given Governor Kihika until today, Monday, December 12, 2022, to rescind her new list and initiate a new process as directed, or risk facing a fresh lawsuit.

“Where will you take us?”– Chest thumping Musalia Mudavadi has started off eating big

Musalia Mudavadi, Prime Cabinet Secretary of Kenya

In a scandal akin to the Mike Sonko tenure, the new Nairobi Governor Sakaja Johnson is already captured by powers that be.

Here below, we present to you the dealings of the Prime Cabinet Secretary Musalia Mudavadi, the cemetery land scammer and the one serving Nairobi County with conflict of interest tenders.

First Assurance, a company belonging to Musalia Mudavadi has been awarded a tender to provide medical cover for the Nairobi County staff at a cost of Sh1 billion.

Mudavadi revealed that he owns the insurance company during his vetting by the Committee on Appointments in October 2022.

First Assurance, which started in Kenya as Prudential Assurance Company in 1930, offered group life, medical and general insurance.

The company’s shareholding structure had remained a well-guarded secret, the only information available being that it is owned by two investment vehicles – First Assurance Investment and Syndicate Nominees.

One of Mike Sonko’s cash cow was the insurance health cover where AAR was paid Sh668 more than what was required to cover Nairobi County Government Staff . It is the Sh357 million garbage collection scandal that utlimately sent him home – Editor

Yesterday, Mr Mudavadi disclosed that he has investments worth Sh255 million in First Assurance through First Assurance Investment.

He also owns another Sh185 million shares in the insurance firm through Syndicate Nominees.

Mr Mudavadi, who first became a Cabinet minister in 1989 at 29 years, owns the Absa investment through First Assurance Investment and Syndicate Nominees. First Assurance Investment has other investments worth Sh650 million.

Where will you take us?

Mudavadi is the new cartel leader in town.

It is reported that he also negotiated the Nairobi parking system tender.

The dishing of tenders, close proximity to power and the sudden stop by the Kenya Revenue Authority (KRA) to ask Mudavadi to pay Sh100 million tax that he owes the country, have made the guy grow horns.

A chest-thumping Mudavadi recently said, “I am not a person who brags, but the truth is William Ruto defeated the system and the deep state in the last election. Now he has the system and the deep state. Why would you hang out there speaking ill of us? Where will you take us?”

In the Daniel Moi govt, Musalia Mudavadi was the finance minister when the country lost over Sh100 billion in fictitious payments to companies that lied they are exporting gold. The scandal is famously known as Goldenberg.

Dollarization of Kenya: A Case of Blatant Discrimination By Durham International School

Durham International School

Durham International School

A disturbed stakeholder has raised alarm over a unique type of veiled discrimination that is increasingly common in various Kenyan international schools.

Writing to this blog on Monday, December 12, 2022, the aggrieved parent spoke out against the Durham International School administration, strongly criticizing them for forcefully dollarizing the payment of tuition fees.

The school which offers the British curriculum has reportedly imposed this costly mode of payment on all guardians and deprived them of an avenue to air out any opposing views.

This leaves them prone to major inconveniences each time the dollar rate shoots up, which has become the norm recently.

Whenever they reach out to the management in protest, they are given the same old lame excuse that the school is currently financing a dollar loan, hence all payments strictly have to be made in that specific currency.

Concerns have also been raised regarding a widespread race-based prejudice targeting children of native parents.

The source notes that in schools like Durham and Light Academy, cases of students being taunted and teased by their foreign teachers have been on the rise.

Subsequent reports of this blatant racism are swept under the carpet by the administration.

Read the worrying submission in full below.

“Dear Cyprian Nyakundi.

Thanks for assisting Kenyans in the quest for justice by speaking the truth, always.

Kindly assist us to highlight a social issue of veiled discrimination and injustice that is occurring in some institutions of learning in Nairobi.

Increasingly, Kenyans are sacrificing their hard-earned income to educate their children in the vast international schools based in Kenya.

Sometimes parents want blended learning, starting in Kenya’s official system of CBC and sending children to International schools later.

Or vice versa.

Essentially, it is their right as Kenyans to enjoy whatever form of education they desire.

This inalienable right is under assault.

As scholars and pundits have often suggested, Kenya as a country sometimes seems more hospitable to foreigners and foreign investment as opposed to being concerned about the Kenyan residents and their well-being in the nation.

The comforts and interests of foreigners are placed at the expense of the average black Kenyan.

In direct confirmation of the statement above, there is a school offering the British curriculum (Durham International) that does not even bother to offer Kenyans a KSH rate to pay their fees.

They charge the fees in dollars, leaving helpless parents to suffer when the dollar rate shoots up, as is the norm.

Any attempts to ask the school to consider everyday Kenyans rather than foreign and expatriate communities, who are largely okay with dollars, are met with flimsy excuses about the financing of the school in a dollar loan.

Have we turned into Americans overnight? Or are we a foreign colony once more?

The reality is that our government has largely left Kenyans to be at the mercy of market forces and refused to streamline the booming industry of International education in Kenya.

Aside from obvious financial discrimination, young Kenyans are subjected to veiled racist discrimination.

In schools like Light Academy and German School, there are so many cases of children being taunted and teased by foreign teachers.

Some have even left the school without bothering to complain or highlight the discrimination to the public.

Any report on racism to the school administration is met with denial and ignored.

Most Kenyans adopt a polite social persona that is increasingly under attack, abuse and misuse by “investors” who want to cash in at their expense.

Can you imagine attending university in America and UK and insisting on paying in our Kenya Shillings?

Can a Kenyan survive in a foreign nation where they abuse others racially?

Experiences with other Africans are constant proof that East Africans (especially Kenyans) take on a very delicate persona that foreigners prey on aggressively.

Kenyans are perceived as the most unthreatening nation so there is an influx of foreigners with superiority complexes’ and outright disregard for them.

Please highlight this social issue and compel these institutions to treat the country they are based in with some respect.

Let them also realize Education is a basic need that needs to be dispensed with some regard above profit.

PeopleLink

PeopleLink Consultants Limited

PeopleLink Consultants Limited, an employment agency with operations across Kenya, is faced with allegations of mistreating its labour force, specifically those consigned to Portland Cement in Mombasa.

The workers complain that they often go unpaid for months and suspect that a crooked accounting officer at the agency is deliberately withholding their dues in a bid to frustrate them.

Those that try to speak out against the injustices are arrested and locked up in a police department situated within the Portland Cement property.

Recently, Cabinet Secretary for Trade, Hon. Moses Kuria visited the company, but officials prevented him from speaking to the people in the production department over fears they would disclose details of their endless suffering.

“Hi Cyprian Nyakundi, kindly hide my identity.

I work at Portland Cement for an outsourcing company called PeopleLink.

A company with no agreement whatsoever between them and their employees.

They don’t even have a secretary in their offices within the institution.

They haven’t paid us since October.

We’re equally aware that the money has been paid but there is an accounting officer called Wambua who is deliberately holding our money to frustrate us.

Kuna watu ata hawajalipwa for more than 6 months.

Portland Cement is the currently mostly selling company amongst all but wafanyikazi wanateseka vibaya sana.

There’s a police department within the institution and when you try to air anything unatolewa nje or arrested coz, the company doesn’t even know us.

Moses Kuria came to the company, but he was prevented from speaking to the people in the production department.

Finally, the people who only matter in the company are the management and sales department.

The rest only work without pay for over 4 months,” the source wrote to us on Saturday, December 10, 2022.

The plight of unemployed ECDE Teachers in Mandera

Mandera Governor Mohamed Adan Khalif

The administration of Mohamed Khalif, the Mandera County Governor does not recognize nor value Early Childhood and Development Education(ECDE).

Presently, under the constitution, Early Childhood Development Education (ECDE) is a devolved function under County Governments.

ECDE Teachers are being looked down in Mandera county, Governor Khalif’s administration seems to be following in the footsteps of Ali Roba.

“Hello Nyakundi,

Asalam Aleikum bro? How are you doing? Hope this finds you well.

We are UNEMPLOYED ECDE teachers from Mandera. I want to send you our plight to share worldwide.

It’s barely 9 months since we were interviewed in Mandera town in the severity of the heat during Ramadhan and yet to receive an appointment message.

What’s wrong with this county?

Mandera county doesn’t recognize the ECDE department compare to other counties that are deploying people every year.

We are unemployed qualified ECDE Teachers in Mandera county who are facing a lot of challenges since the inception of devolution, we were interviewed on 6th April during Ramadhan Time, and since then we didn’t receive any message and have had no idea of what going on in the county, just patiently waiting.

It’s barely 9 months now since we did an interview and we are suffering. Please tell them to release this ECDE appointment message to those who were successfully selected.

ECDE unemployed teachers in Mandera are suffering, some of us have families, wives, and bills to pay.

Besides that, it’s ECDE teachers who are teaching upper primary levels due to the shortage of teachers in Mandera since non-local teachers fled.

We as unemployed ECDE teachers have been left out to enjoy the fruit of devolution. We have no hope of getting employment from the National government since ECD is under the county government.

The last time ECDE teachers have been recruited was in 2014.

Currently, close to 300 qualified ECD teachers with certificates, diplomas and Degrees have no employment and we are all victims of the canceled recruitment of 2019 and April 2022.

People in other dockets have been reappointed and only ECD teachers are left out.

Many of the said teachers have families to feed including wives and children.

We request the government of the day for immediate intervention in this matter.

According to our sources, there are 312 ECDE centers in Mandera with a total of 23,497 learners.

Stakeholders think that Governor Khalif is less concerned about the ECDE status because he wants to empower the existing Islamic schools (Duksis) in Mandera county.

Malindi Locals Capture and Eat Blue Marlin Fish Worth Sh3m

A popular Kenyan on Twitter has left netizens in disbelief after narrating a witty story of how he, alongside a group of Malindi locals, recently caught and ate an exotic fish, without knowing it could fetch them millions in the international market.

“Sometime last month, we caught a blue marlin and ate it together with my fellow villagers.

Little did we know that we have eaten meat worth Sh3M,” Yussuf Mwinyi, alias ‘Swahili Pundit’ wrote on Twitter.

He however says he does not regret their decision, as it would have been extremely hard for them to ferry the product to America, where such fish sell for a good amount.

“Anyway, there was no way we would have transported it to America or wherever to sell that fish for $30,000,” he added.

His followers also took turns in soothing him for the missed opportunity, some arguing that enjoying the delicacy with fellow villagers was worth far more than money.

“That’s Ubuntu! ‘Ate it with the villagers’ will generate goodwill to last you and your generations compared to stashing that $30k in your bank account,” one replied.

According to a 2021 CNBC report, the blue marlin fish is worth about $31,325.30 per pound.

Furthermore, the females, which are significantly larger than males, can reach 14 feet in length and weigh more than 1,985 pounds, while average sizes tend to be in the range of 11 feet and 200 to 400 pounds.

The fish is not primarily intended for human consumption because it contains unhealthy amounts of mercury and other contaminants; however, their meat is considered a delicacy, particularly in Japan, where it is served raw as “Sashimi.”

The blue marlin of the Atlantic and Pacific oceans is more widely pursued by sport fishermen than any other marlin species.

Their wide distribution in tropical oceanic waters and seasonally into temperate zones makes them available to many anglers, and their potential to reach great sizes and spectacular fighting ability makes them a highly desired catch to some anglers.

” Hello Nyakundi,

Good Morning senior. Hope you are well.

Yesterday I commented on a situation in one of your posts, which probably bypassed you.

I got a job at Brafel Engineering Systems in September 21. I am on a one-year contract.

The CEO has decided not to pay us, greatly inconveniencing us.

Some of us are still begging to be paid our October Salaries.

Personally am sick, have no food in my house, and no medication.

Each time we talk, he threatens us and dares us to do or go where we want because he knows everyone.

Recently, to drive a point home, he updated his Facebook with a photo they are with President DR William Ruto. We are frustrated.

His Facebook and official name is Kevin Vitah.

Most of us, 7 of us. Some haven’t been paid since October. He is now threatening us to do what we want.

Personally, I will be locked out of my house on the 14 if not paid.

He threatens to terminate our contracts if we don’t go back to work, despite not being paid.

Currently, we don’t even have a workstation, but he threatens anyone who won’t report to the office with termination.

Please help us.
