Win For Sonko, Blow To Cecil Miller As Tribunal Recommends Removal of High Court Judge Said Chitembwe

City lawyer Cecil Miller has suffered a huge blow after a tribunal recommended the removal of High Court Judge Justice Said Juma Chitembwe, who was under investigation following petitions filed against him by persons including former Nairobi governor Mike Sonko.

The tribunal investigated Justice Chitembwe over allegations of discussing active cases with third parties.

One of the petitions was filed by one Francis Wambua who accused the judge of gross judicial misconduct, including discussing the merits of a matter pending in court, with third parties.

Lawyers Cecil Miller and George Kithi, previously Sonko’s lawyers in his corruption cases before they fell out, were adversely mentioned alongside Judge Chitembwe.

Sonko alleged that the two city lawyers received over Sh315 million to compromise his impeachment process.

In amateur videos released by Sonko, a man purported to be Judge Chitembwe was seen receiving a bag full of money from a lawyer for the purpose of defeating justice.

Dubbed “The Rot in the Kenyan Judiciary” the first episode of a five-part series shows the events leading to Sonko’s impeachment and Chitembwe’s alleged involvement in fraudulent dealings in his chambers.

The petitioner claimed Chitembwe had been approached by lawyer Miller and Nairobi County Assembly, majority leader Abdi Guyo asking him to rule against Sonko.

The judge allegedly requested lawyer Miller to make arrangements for him to meet President Uhuru Kenyatta to give his nod to impeaching Sonko.

Miller allegedly confirmed that State House wanted the governor out of office.

Wambua claimed that Miller was acting at the behest of Nairobi City County MCAs and a county executive committee member in a desperate bid to have his legal fees paid.

Guyo and Miller reportedly visited judge Chitembwe at his residence in Mountain View Estate.

The consequences of Justice Chitembwe’s case are far-reaching, and institutions like the Law Society of Kenya (LSK) have a responsibility to take action against the lawyers involved in these illegal activities.

The actions of these lawyers have demonstrated a lack of integrity, violating the constitutional provisions on integrity and the code of conduct for lawyers.

It is imperative that the LSK take swift action to ensure that those who have breached these ethical guidelines are held accountable and prevented from continuing to practice.

This case serves as a reminder of the critical importance of upholding the principles of integrity and ethical behaviour in the legal profession.
