We would like to shed some light on a petition against a defective law that’s close to everyone’s heart, and has been intentionally blacked out by bribed mainstream media journalists, many of whom have been or are likely victims of its partial enforcement.
Geoffrey Andare has filed a constitutional case at Nairobi Constitutional & Human Rights Division Petition 149 of 2015. In a nutshell, the petitioners case is that Section 29 of the Kenya Information and Communication Act Cap 411A is unconstitutional for being vague, overbroad and infringing on freedoms of expression as enshrined in the Constitution of Kenya.
The petition lodged on 20th April 2015 calls for declaration that section 29 of the Kenya Information and Communication Act, Cap 411A is unconstitutional and invalid for unjustifiably violating Article 33 and 50(2)(n) of the Constitution;
The petitioner is also pushing for a declaration that the continued enforcement of Section 29 by the rogue police officers, sometimes working at the behest of the ruling class in a bid to silence the voice of the people, violates the Bill of Rights and therefore militates against the public interest, the interest of the administration of justice and constitutes an abuse of the legal process. In clear and simple terms, the law is defective and draconian.
The petitioner who is subject of a criminal court-case after he posted on Facebook. The case emanated after he accused Titus Kuria Ndoka aka Papito Tito of using his position and influence at CME-Trust based in Mathare to coerce young girls into sex, with the promise of scholarships that the organisation was “helping” the local community with.
The petitioner has sought for an injunction barring the Second Respondent from carrying on with the prosecution of the Petitioner in the proceedings in Milimani Criminal Case Number 610 of 2015.
Many individuals have been victims of this repulsive law including celebrity blogger Robert Alai who has had run-ins with former Head of the Civil Service Francis Kimemia and Ethics Anti-Corruption Commission boss Halakhe Waqo. We recently revealed how he was bribed by Cooperative Bank so as to ignore concerns raised about insider-trading, a matter that would bring down the bank were it pursued to its logical conclusion.
This petition is an important component to the evolving space for Kenyans, as we have of late realised that parliament has become an impotent arm of the Government, that simply acts as a rubber-stamp for the Executive. Gone are the days when firebrand opposition MP’s would challenge the Government and hold it accountable, with the current lot of opposition MPigs being at StateHouse’s payroll.
We have also realised that Mainstream Media is a threat to Kenya’s development, and ever since they were hosted at Statehouse upon President Uhuru Kenyatta’s ascension to power, they became the 4th arm of the Government and no longer the 4th estate.
Civil Society in Kenya has been subdued with bribes or intimidation and despite huge financial inflows from international donors and agencies, they do not support or fund transparency websites like this one or even Robert Alai’s Kahawa Tungu, leaving him susceptible to corporate control and manipulation.
Our last bastion of hope and freedom remains social media, whereby crowd-sourced actions have led to the collapse of Chase Bank and now Gertrudes Garden which has had an overwhelming reaction towards gross negligence and misdiagnosis by its doctors. Financial gain seems to be the main motive of Gertrudes Hospital and not an advancement in the medical field.
This petition requires your undivided attention and support, even if mainstream media gives it a wide-berth. Download a copy and enlighten yourself on attempts by Kenyans of goodwill at fighting impunity and injustice without any help.

As I said earlier, we are not after a celebrity status or international awards, but in pursuit of a fair and just society for all. If you need bribes, I’m sorry but the new Kenya has no space for this Daystar ilk.
It is such draconian law that have sparked angry mass protests and even in some cases revolutions, when seemingly overbearing Government’s seek to infringe on even the most basic of constitutional rights. It’s brainchild is ofcourse Ezekiel Mutua, the character that was recently taking selfies in Business Class, like the hormonal teenager excited by aviation travel. The mere fact that mainstream media keep justifying his childish outbursts with coverage goes to show that they are in on this conspiracy, as they see social-media as a threat to their existence.
Mainstream Media largely pilfered and dominated by Daystar University graduates has witnessed a systematic depreciation of confidence by the general intellectual public, with their CEO’s largely insisting on televising mediocre content like Nigerian movies and Mexican soap-operas. They are run by the bunch of hopelessly incompetent individuals, working mainly for salaries. Many have consistently posted losses over the last 3 years indicating how Kenyans have altered their media consumption patterns.
Support this petition fellow Kenyans, and leave Mainstream Media to struggle with their Government narratives.
