A court case is brewing pitting businessman Udbi Yaheye Haji against Tayo Property Management Company Limited.

The businessman is accusing the construction firm of locking him out of his land and property.

The case is about parties to a joint venture project. One provided the land and the other is undertaking construction.

The building is almost complete and one party decided to lock out the other.

The court has granted access to the premises to all parties more specifically for the construction workers and management team as the matter is resolved through arbitration

The OCS is in total disregard of the court order which was to be enforced by the OCS pangani. She has asked police at the station not to help in enforcement.

The interest of the party with the court order is for construction to continue since they suffer heavy losses and penalties on all days construction has stalled

It is believed the OCPD has been pocketed by one party

Reputation is a very important thing in this information age.

One company, Safaricom Plc, must really struggle with it. Yesterday was International Women’s Day and Safaricom has today launched a video sharing drive to celebrate women in various endeavours.

It is a good initiative until you understand that those pushing for these have tainted anti-women, anti-youth sentiments running sturdily in their veins.

As Aeon, reminds us, whenever we are at the point of accepting or rejecting new information, we should ask ourselves: Where does it come from? Does the source have a good reputation? Who are the authorities who believe it? What are my reasons for deferring to these authorities?

Yes, reputation is important in the information age.

We are experiencing a fundamental paradigm shift in our relationship to knowledge. From the ‘information age’, we are moving towards the ‘reputation age’, in which information will have value only if it is already filtered, evaluated and commented upon by others.

What reputation does Safaricom Plc have in helping youths in Kenya succeed?

None if you pass it through this prism. Whatever you see around being hawked as good things happening to Kenyans is pure PR bombardment which i’d like to destroy here in a bit.

First, you might argue that Be Your Own Boss (BYOB Blaze) which targets youths has really had a positive impact on that constituency. Wrong.

Safaricom’s Blaze BYOB has targetted the wrong population of Youths; those who come from some well-to-do families, those whose life in campus is not as hard as such instead of focussing on the real youths from the ground.

The Blaze BYOB PR is run on social media platforms such as Instagram, Twitter, and Facebook and to the average thinker, it appears like Safaricom PLc is helping those youths, while it is not.

To all the downtrodden and oppressed youths of Kenya, there’s nothing tangible BYOB Blaze is doing for them.

It is taking youths in circles, make them ignorant of what truly ails them, and when they wake up, they are already old, nothing has changed to better their lives or those of others. It is a scheme that the Kenyan government loves too much, they are this oppression together.

To disenfranchise the lot of young people who make the bulk of the population of this country, so that they cannot interrogate their predicament in the lack of jobs, lack of money, and extra-judicial killings, but instead waste time chasing the wind; a proper chasing of the wind.

Secondly, it is Safaricom Plc among other big Kenyan corporates that have been mentioned in the theft of several intellectual property rights and would be intellectual property rights. First, Safaricom had a portal known as Zindua, where innovators would share their creative innovations with the Telco, most of them were told their innovations wouldn’t go anywhere, they were dismissed only to see the Giant Telco launch a similar product months later. It has happened.

I used the words, ‘would be intellectual property rights’ not by accident. It is because most of these oppressed youths saw a savior in Safaricom, trusted their patents, utility models, and copyrights with it not knowing the processes of registering with Kenya Industrial Property Institute (KIPI) or Kenya Copyright Board (KECOBO). This made it easy for the predatory capitalists at Safaricom to steal them and make them their own.

The oppressed youths then suffer double tragedy, lost intellectual property, and they also don’t have money to challenge the giant Telco in the corrupt Kenyan courts.

The boys lub, one died, two have been ‘kicked out’ due to scandals. Watch as all of them get embroiled in something as the years pass by.

However, for any big power, there has always been a resistance and a toppling. That time has arrived after nearly 10 years of being unchallenged in the stolen intellectual property rights. Cnyakundi.com knows that Safaricom will fall as has been documented by tweets elsewhere. The new challenger to Safaricom’s thieving ways is a formidable conglomerate of independent-minded Kenyans, fiercely just. The telco will learn a lesson this time around.

Thirdly, the predatory lending that is currently witnessed in Kenya was started in part and made famous by Safaricom through Mshwari. Then Fuliza followed. It is very obscene to see the amounts of interest rates charged by these two.

Fourthly, in the matter of reputation in the age of information, the story of Safaricom cannot be told without remembering one Mary Kusa Etale who was killed by a drunk -driver, Safaricom’s Chief Customer officer Sylvia Muthoni Mulinge. It is a miscarriage of justice, one which despite a challenge by a human rights group, the story has stalled. Why would anyone do an out-of-court settlement without going through with charging someone who committed the crime?

Safaricom’s PR in their advertising of Till Numbers, the celebrations of women the whole of this International Women’s day falls flat, the PR has been exposed and it should not be lost on anyone that a family is hurting over the death of a minor, a child who would have grown to become a woman, Mary Kusa Etale should be celebrating her 19th Birthday celebrating International women’s day like Sylvia Mulige, but she is not.

It is for the above reasons and the fact that Safaricom has been using a PR firm, WPP ScanGroup whose founder, Bharat Thakrar was found to have forcefully taken advantage of female staff in his organization during purported business trips, that the PR that Safaricom is churning out this week in support of women, coached women business owners, is null and void. An attempt to hoodwink Kenyans into forgetting their wrongs. Don’t buy it.

Safaricom senior managers, Peter Ndegwa and Sylvia Mulinge  and board Chair Michael Joseph, the Mr 10 percent, should resign.

The PR has been deconstructed. Periodt.

A few days ago we highlighted how staff members at the Finance Department of the Technical University of Kenya (TUK) have been stealing from students who are clearing from the University.

“I had been cleared in 2017 before my graduation and was sure that I didn’t have any issues with the institution. So, I took my degree collection form to the finance department to have it signed. So, I took my degree collection form to the finance department to have it signed. Here, am told that my fee had issues and that I have to pay a whole Sh17500 in order to get cleared. In fact, I had paid my fee in excess and asked for a Sh18000 refund, money that I never got up to date. Since then, a week is over and I have made endless visits to the university. Am only told that the fee hasn’t reflected yet and I have to wait longer”, Kelvin had narrated.

Sukuma Wiki (kales) is so cheap in Mlolongo which is just a few minute’s drive from Nairobi.

However, the reason it is so cheap will make you wanna stop eating it for life.

In 2016, the Consumer Federation of Kenya (COFEK) sounded the alarm on the toxic levels of foods consumed in Nairobi.

Scientists at the University of Nairobi found high levels of toxins such as calcium carbide, hydrogen peroxide, polychlorinated biphenyl-laden transformer oil, formalin, and lead in foods sold in supermarkets and around eateries.

The foods tested were bananas, apples, poultry, sukuma wiki, and milk.

If foods sold in such high-end places were that toxic, how about that one sold by your local mama mboga?

This brings me to another study that specifically targeted one of Kenya’s staple foods; Sukuma Wiki.

In 2019, lab tests showed that vegetables obtained from Supermarkets revealed high level of mercury, higher than the recommended levels by World Health Organisation (WHO).

According to a WHO report, mercury is a major threat to public health because even exposure to smaller amounts poses a threat to human development, especially of children in early stages of life.

Is this the reason why cancer is on the rise in Kenya?

In Nairobi, kales or sukuma wiki is grown along the heavily polluted river with the same water that contains industrial waste.

No one is safe as all the agricultural land is being taken over by real estate companies who put worthless concrete on lands that could otherwise be used for large-scale cultivation of foods.

If Kenya was serious about the health of its people, then lands such as Kisii, Bomet, Kiambu, and Trans Nzoia would be real-estate-free to be used solely for cultivation. This is a controversial suggestion, but we would rather live in desert cities constructed in North Eastern and Turkana and feed on proper foods. The problem is greed through importation and hospitals wanting to make a quick buck. If you eat healthily, the pharmaceutical industry will collapse. Classic capitalism loves when you feed on junk.

This below is how they do it in Mlolongo, these end up in supermarkets, eateries, and homes in Nairobi.

UN cuts funds after audit revealed ghost KDF Soldiers

The United Nation’s Security Council has slashed funds allocated to Kenya Defence Forces(KDF) soldiers.

UN has cut the funds to KDF soldiers after an audit revealed that the payslips have ghost troops fighting the Al-Shabaab militia in Somalia.

The Business Daily reports that the latest exchequer statistics show grants from African Union Mission in Somalia (Amisom), funded by European Union (EU) and its partners, amounted to Sh1.45 billion in the July-December period against a budget goal of nearly Sh9.45 billion.

Compared to a similar period last year, the UN funds to KDF represent a 25.22  per cent-the Amisom receipts represent a Sh489.60 million cut.

A leaked damming audit report by PwC Associates Ltd (Mauritius) queried the payment of KDF soldiers who had left the mission between 2016 and 2018 that resulted in a possible loss of billions.

The National Treasury has slashed its full-year target from Amisom grants for the period ending June 2021 to Sh7.4 billion from an earlier goal of Sh24.1 billion.

According to its budgetary projections, KDF expects a further Sh2.5 billion in the financial year starting July before the funding dries out on full withdrawal of the Kenya Forces from Somalia.

On February 25, the 15-member UN Security Council agreed that the African Union should maintain its troops under Amisom until March 14.

For a frontline mission, AMISON soldiers usually serve for only one year. The contract, however, might be extended by a few months or cut short.

According to estimates from a reliable source, the international community pays Sh112,052 for each soldier per month. Then their governments deduct about Sh21,800 for administrative costs.

With the above estimates, each KDF soldier serving under AMISON takes home about Sh87,200.

Angry World Vision ‘exits’ Kenya

The World Vision is relocating its headquarters from Kenya

The decision has been reached after failure by the Kenyan government to grant staff of the International NGO diplomatic immunity.

World Vision even seduced Kenya with a regional state-of-the-art headquarters but this still backfired.

Irate at the ‘mistreatment’, the World Vision GB started sidelining Kenya in big funding and grants to cripple the work of World Vision Kenya.

Over 250 Kenyan employees were fired in the egoistic exchanges.

In 2018, Uhuru Kenyatta presided over the opening of the new regional headquarters for World Vision. The headquarters in Karen, Nairobi, was to serve as the nerve centre for the World Vision’s operations in the wider Eastern Africa region including Ethiopia and Eritrea.

“That you have chosen Kenya for your new regional headquarters is proof of the strength of our partnership, and of your commitment to the children of the region.  For our part, we thank you for your years of labour, and we welcome this new commitment. We welcome visitors who are coming in to improve life for Kenyans,” said the President as he assured that work permits for World Vision staff will not be subject to undue delays even as he maintained that the government will continue applying strict measures in the issuance and renewal of work permits,” said President Kenyatta.

In December 2020, I was sent the following message:

“Hey Nyakundi, please investigate the issue of World Vision Kenya office firing over 100 staff in the name of restructuring and went ahead recruiting others either on the position or change the position and recruit, it was based on tribalism”.

After exiting Kenya, World Vision will set up its regional office in Rwanda.

World Vision’s East African region’s member countries are Somalia, Sudan, South Sudan, Kenya, Uganda, Tanzania, Rwanda, Burundi, and Ethiopia.

It works with a total staff strength of about 6,000 and an overall budget portfolio of close to $600 million (Sh66 billion).

The INGO signed its agreement with the Rwanda Govt in February 2021.

The virtual signing ceremony was held between Vincent Biruta, the Minister of Foreign Affairs and International Cooperation who signed the pact on behalf of Rwanda, and Dr. Stephen Omollo, World Vision’s Vice President and Regional Director for East Africa.

“This milestone agreement will augment the work we are already doing in Rwanda, provide additional resources, create more opportunities and enhance social-economic development and growth in Rwanda,”- Stephen Omollo

The Christian non-governmental organisation has operated in Kenya since 1974.

Safaricom in Home Fibre installation scandal

Thursday morning a Twitter User Binti Swahiliya (@BintiSwahiliya) narrated how Safaricom Plc traps users with its internet service, Home Fibre, then fails to deliver.

The telco was recently in the news for all the wrong reasons where Kenyans exposed its con game in the increased Home Fibre speeds.

I was recently tasked with sourcing internet for an office space. About three weeks ago, a Safaricom agent, approached us to sell their internet packages.

Actually make it four or five I think. We told him when we need it, we’d give him a call. We didn’t. So he followed up asking us whether we still needed the internet service. You know, usual sales folks stuff.

He sounded sincere and actually won us over because he was really adamant about signing us up. He came on a Friday, told us if we paid by the following Monday, we’d have the internet by Tuesday.

We delayed in paying and paid on the Tuesday. We were told because of the delay, it would be installed on the Wednesday.

The installation guys never show up. No call. Nothing.

So I follow up and I am told they are working on another site but they would come after. Nothing.

I call the agent in the evening and I am told actually their schedule is booked so they will come on Friday.

Guess what happens.

They don’t show up on that Friday either.

So I call the agent because at this time, we are pretty much abandoned and we are constantly doing the follow ups. I tell him hey, if you don’t get this installed just cancel and issue the refund. Hoping it would apply some pressure.

The technicians finally come on Saturday (finally, because it happened once I asked for the cancellation). They do whatever they need to do and then they tell me, that @SafaricomPLC does no have routers.

@Safaricom_Care, a giant telcom service provider, does not have routers.

So they have installed the wiring and everything and locked us in to their service, but we actually can’t use the internet service because there are no routers.

The chase begins. At some point I learned Safaricom sells you the packages but they contract the installation out to. Something that is not disclosed.

At some point the agent tells me to contact the third party about the installation. How now, when it’s Safaricom I paid?

I request a tentative timeline of when the routers will be made available. I am told “to be patient”.

No timeline. No follow up. Just vibes.

This whole time, I am constantly having to follow up with he agent. Hey. What’s going on? This is not the service you sold me.

Same story. There are no routers at the moment and I should just be patient.

Honestly, lol, at this point I am kind of appalled. Because lol it’s Safaricom? How does Safaricom not have routers that the internet is now getting delayed by two weeks?

By end of week two since installation and no routers, I am frankly very irritated. I tell the agent, bro, this is unbelievable.

So you are just going to leave me hanging until you locate these routers? You’ve taken my money so quickly but there is no proper service delivery.

Once again, I am told to “just be patient.”

Which I am not and this is bs. smh.

Point of this thread is to ask: Is this normal? Does this happen frequently? Has anyone else had such a hard time?

Elsa Majimbo Urges Travelers To Boycott Kenya Airways

Elsa Majimbo

Kenyan comedienne Elsa Majimbo on Thursday found her way back on the trends after the popular crisp-eating entertainer decided to take on struggling national carrier KQ by the horns over their disappointing services.

Through her populous celebrity status Twitter account, Elsa blasted Kenya Airways whom she accused of leaving part of her luggage in a different country and only informing her after she had already reached her destination where after agonizingly waiting for over 30 minutes, they finally informed her that the bags were too heavy hence couldn’t be carried on the relatively small aircraft.

“Today morning Kenya Airways left my luggage in another country cause the weight couldn’t enter the plane. I was told this after I waited for my bags for 30 minutes!” read one of her tweets.

She followed this up with another post where she claimed that despite causing her this great inconvenience, Kenya Airways did not bother to issue any apologies.

As a result of the terrible experience, Elsa also urged commuters to avoid travelling with the airline.

“I would not recommend this airline to be honest. For travellers avoid it if you can,” she wrote in the post that immediately sparked reactions from netizens.

Some of them felt like it was some sort of direct attack on a Kenyan brand by Elsa, who dispute being born in Nairobi but generally fond of South Africans.

In several interviews, she recaps that she has received mad love from the South Africans than her motherland.

Perhaps quite evidently, her first viral video circulated in South Africa, an aspect that gave her global traction. She’s thus attached to the South African nation and even has their flag on her social media profiles.

Elsa had been in South Africa where she was working on a project with Valentino, an international luxury company.

Majimbo shot to fame through her monologue style comedy which she often shared in videos on her Instagram page and within no time she catapulted to international recognition.

KQ Woes

Her complaints towards KQ come just hours after emerging reports that the government is set to restructure loans advanced to the struggling national carrier Kenya Airways which could yet again further increase the State’s shareholding in the airline whilst diluting other shareholders.

KQ is in the process of being renationalised, with the National Aviation Management Bill now in Parliament, expected to give direction on how the process will be undertaken once it becomes law.

The airline has been making losses for years with the carrier plunging into deeper and deeper financial woes.

This worsened during the COVID-19 pandemic due to the grounding of services that saw countries worldwide close their airspace for passenger flights.

Shock As Ex-Intelligence Officer Confirms Magufuli’s Death

Hours after Prime Minister Kassim Majaliwa denied multiple media reports that Tanzanian President John Pombe Magufuli was incapacitated as a result of severe COVID-19, a fresh twist to the tale has emerged after a former intelligence officer “confirmed” his death.

Through a controversial social media post which quicky went viral, Evarist Chahali, a popular political analyst, social media commentator, author and blogger sent the East African region into shock late on Friday night when through his heavily followed and VERIFIED Twitter account, he announced that John Magufuli passed away at 5.30pm (EAT) at Mzena Hospital in Dar es Salaam.

In his brief and precise message, Chahali added that the nation’s Vice President was, however, yet to be informed of the latest development.

Evarist Chahali is a former Tanzanian intelligence officer based in Scotland.

He is also a regular interviewee on BBC Swahili, DW Swahili and VOA Swahili.

His claims are, however, yet to be confirmed by any official sources or representatives from the Tanzanian government.

The prime minister’s earlier remarks were the first official statement by the Tanzanian government about Magufuli’s absence from public view amid widespread rumours that he is ill.

The 61-year-old last appeared publicly on February 27 during an official function at the statehouse in Dar es Salaam, the country’s business capital.

Various international media outlets have in recent days been on Magufuli’s public absence and his reported transfer to a hospital outside the country.

Opposition leader Tundu Lissu has cited medical and security sources saying the president was flown to Nairobi Hospital in here in Kenya and then on to India in a coma.

Tanzania’s government has not publicly reported cases of COVID-19 infection since May 2020, when it recorded 509 infections and 21 deaths among the East African country of 60 million people.

As one of the world’s most famous Coronavirus sceptics, Magufuli promoted prayer and steam inhalation as an antidote to the coronavirus, and disparaged new vaccines as “dangerous.”

Idriss who is now tied to an intensive care unit bed at his home has been in a coma for two and half years now.

When we visited his home last month, we were welcomed by the beeping sound of a life support machine as he lay motionless on the bed with his mother sorrowfully staring at him.

The former CEC was shot on August 19th, 2018, outside a mosque in Kileleshwa after disagreeing with Garissa Governor Ali Korane.

The gunman, a David Mwa, fired 3 shots at lose-range. A bullet traveled through the right half of Idriss Mukhtar and lodged in his head could not be removed by a group of specialists who attended to him in India.

They said it would be fatal.

The medical specialists only managed to heal the wound inflicted by the bullet and discharged him to come back home where he is now lying unconscious in a Coma.

The case still lies in limbo because the Mwai died inside police cells alleged by suicide.

Just a day after a family in Donholm, Nairobi is called on the police to arrest a house help who they had employed accusing her of stabbing their two children, detectives from the Directorate of Criminal Investigations (DCI) on Saturday announced they had finally pounced on the suspect.

The young lady who had engaged the sleuths in cat and mouse games for hours was apprehended in Eldoret town where she had booked a Busia-bound bus in an attempt to escape to neighbouring Uganda where she is said to have relatives.

According to a briefing by the DCI, she was also found in possession of two Kenyan identification cards.

 

This past week, videos shared on social media showed the two boys in hospital receiving treatment.

Both had been bandaged following the wounds they had suffered at the hands of the house help yet to be officially identified.

Neighbours who had helped take the children to the hospital asked police to intervene and expedite the search for the arrest of the alleged suspect.

Sources privy to the matter state that the woman had been fired a couple of months ago for several misconducts after her boss noticed her bad behaviour.

However, not knowing that she would later revenge, the suspect is reported to have come back to the house while her bosses were away and stabbed their two children before fleeing from the crime scene.

Further reports about the matter indicate that the suspect was spotted through the CCTV cameras as she was fleeing from the crime scene.

Why is it that when Kenyans are given a chance to manage entities that were previously run by whites they tend to water the standards down?

There are some commendable Kenyans but majority are just thugs; somehow leaning on some ethnicity.

Here below, a hurting parent wonders why her son was beaten up like a thief, expelled and the management is now threatening her.

They allege that the boy in question had put other boys in danger, committed sodomy.

The parent wonders why they had to beat her son, planning to deny him a chance to sit for his final exams.

I am a parent to a KCSE student in Starehe boys center. The school Director Mr. Josephat Mwaura of mobile (withheld) and his deputy Mr. Okono (withheld), expelled my boy after questioning them why they beat my son using kicks and ngumi. They also took my son’s uniform, so that he won’t sit for his KCSE exams.

Please help my boy Nyakundi. Right now the school director keeps on threatening me through text messages. Here are the screen shots

I think it was a case of displinary that went bad. Hey, Prof Magoha, deal with this issue. Have the boy sit his exams. There’s too much pain already.

Police should also investigate the assault on the young man as ‘mob justice’ is not part of discipline.

The school directors should also stop threatening the boy’s parents.

The young man is said to be suicidal after the incident.

Wajir County officials jailed for 4 years for corruption

Wajir County Governor Mohamed Abdi

A Magistrate court has jailed 3 Wajir County government officials for 4 years over stealing of Sh26 million.

The three Ahmed Omar, Daud Abdullahi and Jeff Mworia are accused of withdrawing the money from a KCB Bank account in 2018. Wajir County Governor Mohamed Mohamud testified that ‘he did not issue instructions for the withdrawal of Sh26 million and was unaware of a request by the Finance executive for an overdraft facility of the amount at KCB, Wajir”.

Anti-corruption chief magistrate Teresia Murigi ruled the prosecution had proved its case against the three. She said that Omar had the mandate to approve how many signatures were required to withdraw the cheque from imprest.

“First accused issued instructions on the basis of the approval of the accused person on the money. The bank acted on the instruction of their client on who to remove and who to add as a mandatory signature,” the judgment reads.

In the judgement, the trio can pay a fine of Sh800,000 to escape jail.

Some sections of the Wajir residents believe that the magistrate was compromised as the sentence was lenient.

“What a cooked judgement. The Magistrate was compromised and gave this guy lenient sentence after stealing 26M from wajir county”, lamented a Wajir County resident.

The magistrate ruled the bank could not be faulted as Sh26 million was withdrawn on October 9, 2018 from the imprest account.

Additional charges

Abdullahi is facing a separate count of abuse of office and failure to manage public property.

He is accused of committing the offence between October 5 and October 9, 2018 by unlawfully authorising Mworia as a sole signatory of the Wajir imprest account.

Omar also faces a separate charge of abuse of office in which he is alleged to have used his position to confer a benefit to Mworia by purporting that the County Executive Committee had appointed him the signatory of the imprest account.

Mworia faces four other counts, including the fraudulent acquisition of public property.

A Shitty Morning: City Commuters Showered With Raw Sewage At Kangemi

There was an extended delay in traffic movement along Waiyaki Way this morning due to a broken sewer line that was spilling waste onto one side of the busy road.

From videos of the incident which happened at Sodom, just before the former Kangemi Bridge as you drive up Waiyaki Way, only a few motorists could brave the brown shower with some growing hesitant as they approached what looked like a giant fountain of sh*t.

“Perhaps Cyrus Oguna is right. We should pay taxes without complaining. Just look at the great services we receive,” an angry Kenyan captioned one of the many clips doing rounds

Under the comments section, many other upset netizens called out the current General Badi-led Nairobi Metropolitan Services (NMS) for failing to clean up the mess hours after numerous complaints from road users.

The NMS

The NMS was created by President Uhuru Kenyatta last year after he grew tired of the confusion and impunity in Governor Sonko’s Nairobi City County.

At the time Uhuru said the NMS would be responsible for improving services in the city, including implementing a new rail transport system in measures aimed at modernising the city.

The NMS would now undertake effective garbage collection, take over the operations of health facilities as well as the management of Nairobi Water Company.

Uhuru’s Cousin Banished From Kikuyu Council of Elders

President Uhuru Kenyatta’s cousin Captain (retired) Kung’u Mungai has officially been banished from a Kikuyu Council of elders, “Kiama Kia Ma”.

Kiama Kia Ma is the cultural pillar of the Kikuyu Council of Elders, whose other pillars include economy, politics and social welfare.

Through a press statement on Wednesday, the council announced that Captain Kung’u is no longer their member and does not hold any position of leadership forthwith.

They also warned that he is not allowed to represent elders of Kiama Kia Ma, nor attend, oversee or participate in any Gikuyu cultural ceremony, citing it as disciplinary action against Kung’u over his gross misconduct of falsely misrepresenting himself as a “Patron”.

A position which according to the group does not exist in Kiama Kia Ma.

Additionally, Kung’u is accused of among other things, intimidating, being deceitful and disrespectful to members.

“This is a disciplinary action that has been taken due to gross misconduct, misrepresenting Kiama as a “Patron”, a position that does not exist in Kiama Kia Ma constitution, intimidating elders, deceitfulness, impersonation and disrespect. Specifically, on the 15th Mar 2021, he went to a media house and in a live show insulted all elders of Kiama Kia Ma, disparaged the leadership of Kiama kia Ma and used unacceptable language, innuendos, character assassination, malice and casting aspersions on the leadership of Kiama Kia Ma,” read the notice in part.

This development comes just days after Kung’u had an extensive interview with a local publication where he made a few controversial claims.

For instance, he spoke of how the Gikuyu community should go back to the root and dispose of the dead as fast as possible.

He said that traditionally, the Gikuyu people couldn’t touch the deceased.

He also publicly declared his wish to be buried immediately after death in a funeral service devoid of pomp and colour.

HOT: Sh647 million tender divides National Treasury cartels

A new row has emerged at the National Treasury following the award of a Sh647 million tender on 25 January 2020, to Kingsway Business Systems Ltd in consortium with Kobby Technologies, and Inplenion Eastern Africa Ltd, a firm associated with Sabatia MP Alfred Agoi.

The ADK led consortium filed a request for review at the PPARB on 8th February 2021. The National Treasury compromised a party to the consortium to file for a notice of withdrawal. The Faith Waigwa-led board having considered the notice of withdrawal ruled that it did not have jurisdiction to consider the merits of the request for review.

It appears that the TNT designed a device to scuttle the review process by causing and pressuring a member of the consortium to file a withdrawal notice. The review board suspended the review process claiming that it does not have the jurisdiction to hear the merit of the case thus allowing treasury to get away with hiding that the Kingsway consortium does not meet the specialization criteria and the mandatory disqualifying criteria in the tender provisions.

The Oracle Kenya office, in response to the national Treasury in a letter dated 2nd February 2020, and signed by the Country leader, Mr. Davis Bunei, does not categorically confirm the competency of Kingsway Consortium and only recognizes the Kingsway consortium partners as Resellers, without any service expertise, a mandatory requirement in the bid document.

The ADK led consortium in their appeal bases their claim for fraud on information available in the Oracle partner portal http://partner-finder.oracle.com/ , in which they assert that Kingsway and its consortium partners are not recognized as competent. The Lead Account Manager at Oracle, one David Ochieng confirms this very reference site, http://partner-finder.oracle.com/in an email response to Treasury on 15 Jan 2021, an email seeking to confirm the partner credentials of the Kingsway Consortium partners.

Exhibits supplied by treasury to the Review Board had conflicting due diligence dates and printout pages from the Oracle portal, Oracle had informed Treasury to locate whether the Kingsway consortium possessed the specialization.

Our paper followed the instructions provided by the exhibits provided by Treasury and after following the procedure to verify whether Kingsway consortium possessed the specialization affirmed the expertise page supported the claim that they did not have the specialization.

Instead, TNT was collaborating with the consortium to use as evidence of a solution page editable by Kingsway consortium as proof that had the specialization.

The ADK led consortium moved to the High Court seeking to nullify the award to the Kingsway led consortium for “The Provision of Onsite Support for IFMIS, an Oracle –based product”. The High court has since temporarily suspended the award to the consortium led by Kingsway Business Systems Ltd following a case filed by the rival Consortium ADK Technologies citing fraud in the tendering process.

According to records at Treasury Kingsway Business Systems Limited, listed directors include Simeon Ogendo, Seth Asuza Changilwa, Alfred Agoi Masadia and Beatrice Kosgei. It is noteworthy that Kingsway Technologies was irregularly awarded another Tender TNT//025/2020-2021 on the 1st February, 2021 for the Development of the Public Investment Management Information Systems Ltd (PIMIS), an award that was challenged by GIBB AFRICA LTD, which the board directed for re-evaluation of Bids, in what seems to be a real sham to give treasury the lee-way to re-evaluate and award Kingsway Systems Ltd in the customary unusual manner.

ADK led consortium through lawyer Duncan Kiprono wants the high court to compel the Public Procurement Administrative Review Board) PPARB) to review the case afresh on merits. He has listed PPARB as respondent while the PS National Treasury and Kingsway Business Systems are listed as interested parties.

On 6th March 2021, Justice Jairus Ngaah issued an order temporarily stopping the Treasury from awarding the contract. According to suit papers, ADK Consortium claims that Kingsway Business Systems Limited has been providing to the National Treasury with Group Personal Accident services for the last 10 years but not IT services.

ADK claims that in March 2020 Kingsway purchased an entry-level partnership from Oracle in what appears to be credential acquisitions in preparation for the tender.

“Based on the evaluations of Oracle Partner Finder’s website; Kingsway Consortium does not have the Customer references, the Implementation experience, the resources and the development skills and the know how to support the IFMIS Application and the extensive planning and budgeting application for Public Finance Management as required in the bid document,” ADK says.

ADK’s Project Manager, in their affidavit adds; “I verily believe that the procuring entity might have engaged in a flawed procurement process and acted against the laid down laws and procedures, to tilt the scales to enable them carry out a sham procurement process and act in breach of the provisions of law in order to favour Kingsway Business Systems.”

Manoah Esipisu, Kenya’s ambassador to London, United Kingdom was appointed to that office in July 2018. But 2 years into the management, Kenyans in London are crying foul.

Hi Nyakundi,

The Kenyan London Embassy has been closed to Kenyans since last year March. The embassy services are available based on tribal lineage and must now be called back by state House Kenya. Kenyans cannot renew passports not able to obtain IDs as expected. We have held a town hall meeting with HE Ambassador but was provided with very vague and website based narratives.

Please pass this message to Dr Matiang’i as we contemplate others means, including Uk Parliament and Commonwealth offices, to highlight the impact of this abandonment and dereliction of duty by the Kenyan government.

A question posted on Twitter by Droid254 has elicited mixed and interesting reactions from Kenyans on Twitter (KOT).

Kenya is said to be 80 percent Christian, but also very corrupt.

The church has over the year deteriorated morally and cannot be trusted as a compass for anything good.

Perhaps the greatest bad PR for the church is the acceptance of a man such as DP William Ruto to its circles. Yes, Ruto is a Christian, but no other politician has had his name associated with so much filth.

Maybe, the good Lord says, ‘Come just as you are’, but that doesn’t mean he hasn’t also warned against going back to sin.

But this also leads us to another new world view, that one of rationality. Many bad people hide in the walls of the church, they use it to the maximum to hurt others.

Better a secular world, one which uses the rational mind to deduce things.

Well, back to the question, ‘Why did you stop going to church?’, here are some interesting takes:

Help find 15 year old Zubeir Ashraf who has just been abducted in Mombasa

Abductions and murder of civilians is on the rise this pandemic season.

One thing has also accompanied this, the criminal justice system is dead. In gangland Kenya, it is the police who do the most killing.

It is a serious then that a young boy of 15 years of age is abducted in broad daylight by men carrying guns.

Am uncle to the abducted boy says the men used a Toyota Hilux Pick up Registration Number KCF 735U, they picked him up near Zedco in Majengo, Mombasa. They also assaulted the boy.

If you don’t speak against such ills as abduction, extra judicial killings and missing person’s; then you have none to blame as the scourge eats into the moral fabric of the society, and soon, everyone will be affected.

Where is Zubeir Ashraf?

Police should move with speed to return minor Ashraf home safely.
