Kandara Residents Association is disappointed to learn of the efforts by the US Government through the Ambassador Kyle McCarter to interfere with and politicize the matter regarding the Land Lease Renewal by Fresh Del Monte Produce, a foreign company that has disenfranchised Kenyans and citizens for the last half a decade, and wants to continue to do so for the next 100 years.
Following the meeting between the Governor of Murang’a county and the Ambassador, we are aware of a plot to use politicking and well advertised Press pictures like the one above to go against The President’s Executive Order that all public procurement and disposal should be advertised online.
All this is happening despite two Court cases that are trying to ensure the land is adjudicated as per the Public Procurement & Disposal Act of 2015. We have made it clear through the court systems and through various letters to relevant stakeholders and government officials that arbitrary renewal of long land leases is illegal and perpetuates historical injustices.
In Section 13 of the Land Administration Act 2012, it is clear that foreign companies do not qualify for automatic renewal of leases, and to that end, we have tabled our objections and through the National Land Commision, invited Del Monte for dialogue.
In stead of engaging Kandara Residents Association through the channels provided, Del Monte, through their corrupt MD Stergios Gkaliamoutsas, the US Ambassador Kyle McCarter, The Governor of Kiambu, Ferdinand Waititu and the Governor of Murang’a, Mwangi Wairia have colluded to carefully craft an agreement between their respective County Governments and Del Monte Kenya limited, conspiring to cover and enable them proceed to illegally acquire, money and land from Del Monte Kenya limited contrary to the Constitution, NLC ruling and Executive Order.
It is important to remind The US Government, Del Monte and the Governors that Under Section 13 Of The Land Administration Act 2012, that No Other Body Except The National Land Commission Can Renew Leases. We shall not stay silent, neither shall we be ignored, and neither shall we sit by as this impunity continues.
