Danson Muchemi and Robert Muna of Webtribe limited asked the DPP to review their decision to try them in the case involving the theft of Sh1 billion through the NHIF.
Anti-corruption court has set them free after they agreed to be used as witnesses by the prosecution.
Muchemi vowed to cooperate with the DPP as they will always avail themselves as witnesses in the prosecution of their colleagues.
In a letter dated June 5, the DPP Noordin Haji gave conditions that he would only drop charges if Muchemi and Muna to be witness and make full and frank disclosure of the circumstances under which the contract was awarded.
Haji also demanded that they avail themselves or their employees to testify as witnesses whenever called upon to do so.
He further demanded webtribe directors to commit themselves to implement and complete the contract for the system purchase.
The street company was hired to collect revenue through the Integrated Revenue collection system on behalf of the NHIF on August 15, 2014.
But Muchemi and Muna were charged in 2018 with the fraudulent acquisition of public property. They denied the charges but were freed on Sh2 million cash bail.
In the new twist, the two will testify against 16 others including NHIF C.E.O Geoffrey Mwangi and Simon Kirgotty.
