In Mid-August 2020, Standard Media wrote a story that was carried by its channels, TV, Newspapers and online about a tycoon from Mombasa who lied about land and received Sh18 billion compensation from the Standard Gauge Railway (SGR).
The story said Miritini Free Port Ltd, a company owned by Mohamed Jaffer received the above mentioned money irregularly in December 2015.
Justice Eric Ogola ordered the National Lands Commission (NLC) to issue a notice to recover money erroneously paid for land that does not belong to an individual or a company, according to a report by The Standard.
“It is therefore clear the NLC paid part of the compensation money to a wrong party either knowingly or inadvertently. The amount alleged already paid to interested party is said to be KSh 1,475,486,485 plus a further interruption amount of KSh 360 million,” Justice Ogola ruled.
NLC colluded
Equally corrupt NLC had colluded with the Jaffer to allocate the land despite being aware that it belonged to squatters.
Corrupt Jaffer tried to stop the courts order but his appeal was also thrown out and he was ordered to refund the Sh1.8 billion.
It is an open scam and a thing that goes on in Kenya.
NLC was formed to plug the gap that was at the Ministry of Lands in terms of handling and resolving land issues but it has metamorphosed into what was being tried to be solved; the corruption at the Ministry of Lands. For example, the changing of ownership of lands illegally.
It was reported that the original title deed of the land (MN/VI/3912 and MN/VI/3913) was allocated by government to the petitioners (squatters) in 1996 as compensation after being evicted from Sheikh Sayed Children Centre in Bombolulu.
However, NLC later consolidated the two plots into number into plot number MN/VI/4688 and allocated to Miqdad Enterprises, which sold it to Miritini Free Port Ltd.
