“Please give me access to my Kitisuru home, I’m spending too much on clothes and accessories” – Sarah Cohen cries out

Sarah Cohen on Wednesday revealed that she is spending a lot of money buying new clothes as she sought the court’s permission to access her Kitusuru home.

In an oral application through her lawyer Philip Murgor, the accused said she also wants her car which is parked at the house adding so that she doesn’t depend on lifts from relatives and friends.

“She’s had to buy clothes, shoes and accessories, she needs to take these items from her bedroom …all be released to her as a matter of urgency, ” Murgor said.

Sarah Cohen was charged with killing her husband Tob but pleaded not guilty.

She was released on a cash bail of Ksh. 2 million on conditions that she should not access her matrimonial home without the court’s permission.

On Wednesday, her lawyer said she has been forced to use taxis to move from one point to another.

“We are asking the court to grant the accused person permission to get her personal car which has never featured in this case, she has had to purchase clothes and ask for lifts from friends and relatives which is expensive,” the court heard.

The prosecution objected to the application saying that everything in the house forms part of exhibit and the car cannot be released to her.

State Prosecutor Catherine Mwaniki told the court that investigations are ongoing and therefore she cannot be allowed access to the house.

“Unless the analysis is done we can’t release anything in that house as it is exhibit,” court heard.

Justice Stella Mutuku declined to issue any orders and instead directed the accused to file a formal application which will be heard next Tuesday.

Meanwhile, the Director of Criminal Investigations (DCI) through lawyer Donald Kipkorir has asked the court to prioritize an application on jurisdiction

Kipkorir objected to the accused’s move to file supplementary affidavit in the application saying that she should ask for leave to file them.

“He can’t file new evidence without the leave of this court therefore the supplementary affidavit ought not to be in the record,” the advocate said.

A second suspect, Peter Karanja, was also charged and later released on a cash bail of Ksh. 2million. The cases are yet to be consolidated.
